## BY-LAW NO. 87-35
## A BY-LAW RESPECTING DISTURBANCE BY NOISE
Pursuant to the authority of Section 11 (1) (1) of The Municipalities Act, BE IT ENACTED BY the Council of the Village of Blacks Harbour as follows:
- No person shall make or permit to be made any noise within the Village of Blacks Harbour likely to cause a public nuisance or otherwise disturb the inhabitants of the Village.
- Without restricting the generality of Section 1, a noise likely to cause a public nuisance or otherwise disturb the inhabitants shall be deemed to be any noise or sounds of such volume or of such nature as to cause annoyance to residents of the Village including shouting, singing, whistling, music, motor vehicles (including motorcycles and motor bikes), snowmobiles, pneumatic hammers, construction equipment and machinery and animal noises.
- This By-Law shall not apply to pneumatic hammers, construction equipment or machinery, vehicles of business and trade between the hours of six o'clock in the forenoon and nine o'clock in the afternoon from Monday to Saturday, inclusive, or to snow removal and emergency equipment at any time.
- Any person who violates a provision of this By-Law is guilty of an offence and liable on summary conviction to a fine twenty-five ($25) dollars and not more than two hundred dollars ($200) and in default of payment is liable to imprisonment in accordance with the appropriate provisions of The Summary Convictions Act.
