N.-B. 1973, c.M-22 et ses modifications. Le Conseil municipal d'Edmundston dûment réuni adopte ce qui suit : ## APPLICATION 1. Ill est interdit de causer ou de faire des bruits destinés à déranger ou susceptibles de déranger une ou des personnes se trouvant à l'intérieur les limites d'Edmundston entre 23h00 et 7h00. 2. Sans restreindre la généralité de l'article 1. ci-haut, ne constituent pas un bruit destiné à déranger ou susceptible de déranger une ou des personnes se trouvant à l'intérieur des limites d'Edmundston, les activités suivantes : - a) les employés, agents, mandataires ou représentants de la municipalité d'Edmundston ou de la Province du Nouveau-Brunswick agissant dans l'exercice de leur fonction; - b) les travaux de construction de nature urgente, préalablement approvés par le Directeur du service des Travaux publics Environment d'Edmundston ou son représentant; - c) les véhicules de secours autorisés; - d) les cloches d'église; - e) les alarmes ne sonnant pas plus de vingt minutes; - f) les activités spéciales autorisées par la municipalité; - g) les mécanismes de sécurité conçus pour signaler ou avertir d'un danger à la santé ou à la vie d'une ou plusieurs personnes. 3. Il est interdit en tout temps de causer ou faire un bruit destiné à déranger ou susceptible de déranger une ou des personnes se trouvant à l'intérieur des limites d'Edmundston en exerçant une ou plusieurs des activités suivantes : ## BY-LAW NO.19R ## MUNICIPAL BY-LAW REGARDING NOISES WITHIN EDMUNDSTON CITY LIMITS its amendments The council of the City of Edmundston duly assembled enacts as follows: ## ENFORCEMENT 1. It is prohibited to cause or to make any noise intended to disturb or likely to disturb one or more persons within the Edmundston limits between 11:00 pm and 07:00 am. 2. Without restricting the generality of section 1, the following activities do not constitute a noise intended to disturb o1 likely to disturb one or more person within the Edmundston limits: - 1) the employees, agents, contractors servants of the City of Edmundsto or the Province of New Brunswick while engaged in the execution of their duties; - b) emergency construction work approved by the director of publics works of the city of Edmundston or his representative; - c) authorized emergency vehicles; - d) church bells - e) alarms sounding not more than twenty minutes; - f) special activities authorized by th ity of Edmundston - g) security devices made to alert one or more persons of injury or life threatening emergencies; 3. It is prohibited at any time to cause or make noise intended to disturb or likely to disturb one or more persons within the Edmundston limits when carry on one or more of the following activities: - a) l'utilisation d'un système de son, radio ou tout autre appareil de diffusion de sons branché dans ou sur un véhicule à moteur circulant sur les rues, routes, chemins ou toutes voies de circulation publique ou sur toute propriété publique dans le but de produire ou diffuser des annonces publicitaires sonores; - b) la conduite d'un véhicule à moteur produisant des bruits provenant d'un silencieux non réglementaire ou de faire accélérer le moteur pendant qu'il est immobilisé; - c) l'utilisation de freins moteurs, étant plus particulièrement connus en tant que freins « Jacobs » ou autre équipement similaire, dans la conduite de camions ou camionlimites de la municipalité d'Edmundston; 4. Pour les fins du présent arrêté, « véhicule à moteur », « véhicule de secours «camion», tracteur » désignent un véhicule à moteur, un véhicule de secours autorisé, camion et camion-tracteur tel que stipulé dans la Loi sur les véhicules à moteur, L.R.N.-B. 1973, c. M-17 et ses modifications. 5. Les membres de la Force policière ainsi que l'Agent d'exécution des Arrêtés municipaux d'Edmundston sont chargés de l'application du présent arrêté. ## INFRACTION - applicables proviaciales, L.N.-B. 1987, c. P-22.1 et ses modifications, à titre d'infraction de la Classe C. ## ABROGATION - L'Arrêté municipal N° 19, municipal concernant les bruits à l'intérieur des limites d'Edmundston, adopté le 21 mai 2002, est par la présente abrogé. - a) the use of a sound system, radio or other sound producing apparatus connected in or on a motorized vehicle circulating on a public streets, roads or highway or on any public properties in the purpose of producing or broadcasting any advertisement public announcements; - b) driving a motor vehicle producing noise from a non regulated muffler or accelerating the motor of an stall motor vehicle. - c) the use of an engine brake, known as "Jacob" brakes or other similar equipment while driving a truck or a truck trailer on a public streets, roads or highway or on any publi properties within the limits of the cits of Edmundston; 4. For the purpose of this by-law, "motor vehicle"», "authorized emergency vehicle, truck and tractor truck as stipulated in the Motor vehicle Act, R.S.N.B. 1973. c. M-17 and its amendments. - The members of the police force and the Officer ## PENALTIES 6. Every person who violates any provision of this by-law shall be liable of a category 'C' offence pursuant to Part II of the Provincial Offences Procedure Act being Chapter P-22.1 of the Statutes of New Brunswick 1987 and amendment thereto. ## REPEAL PROVISION 7. The By-Law No. 19, Arrêté municipal concernant les bruits à l'intérieur des limites d'Edmundston, adopted on May 21*, 2002, is hereby repealed.  ## ADOPTION  ## ENACTMENT - Cet arrêté municipal entre en vigueur à la date de son adoption.
