Bil Hogan Minister of Public Safety <!-- image --> C A <!-- image --> <!-- image --> ## MUNICIPAL BY-LAW NO. 56 ## VILLAGE OF HILLSBOROUGH MUNICIPAL BY-LAW DESIGNATING PORTIONS OF ROADS WITHIN THE VILLAGE OF HILLSBOROUGH AS ACCESSIBLE TO ALL-TERRAIN VEHICLES Pursuant to the powers conferred by the Off-Road Vehicle Act, S.N.B. 1985, c. O-1.5 and its amendments, the Council of the Village of Hillsborough duly assembled enacts as follows: ## Definitions: "All-terrain vehicle" means all vehicles included in the definition of "All-terrain vehicle" as defined in the aforementioned Off-Road Vehicle Act, with the exception of amphibious vehicles. ## General Provisions: 1. All-terrain vehicles may be driven on a portion that connects with trail 3219 on Golf Club Road, on Nicholas Drive, and Surrey Hill Drive between Nicholas Drive and Route 114, as set out in the Annex 'A' at a speed not exceeding 40 km/h 2. All-terrain vehicles may be driven on the traveling portion of Route 114 between Surrey Hill Drive and the civic address 2995 to allow access to Cooke's Country Store, on a distance of approximately 70 meters as set out in the Annex 'A' at a speed not exceeding 40 km/h. 3. Annex 'A' form an integral part of this by-law. 4. All-terrain vehicles are allowed to travel as specified above under the following conditions: - a) Have a valid trail permit as required under the Off-Road Vehicle Act or a valid permit from another Province member of a reciprocal agreement with New Brunswick, this permit being in the form of a sticker which must be clearly and permanently displayed on the ATV or side-by-side. - b) The driver must be able to provide on request a valid registration document, an insurance document for the vehicle, and a visible license plate with a valid sticker must be visible. - c) No person shall operate an All-terrain vehicle on the travelled portion of Golf Club Road, Nicholas Drive and Surrey Hill Drive unless they are in possession of a valid driver's license. - d) Respect all regulations specified in the Motor Vehicle Act as they apply to the OffRoad Vehicle Act. 5. The driver or any occupant of the all-terrain vehicle must be properly wearing a helmet that complies with the standards prescribed by Regulations under the Motor Vehicle Act. 6. The all-terrain vehicle must be outfitted with the necessary equipment as described in the Off-Road Vehicle Act. 7. All-terrain vehicles must operate in the same direction as traffic and travel in a single file to the extreme right of the street. 8. All-terrain vehicles shall give the appropriate signals as required under the Motor Vehicle Act and obey all traffic control devices. 9. Any other vehicle utilizing the street shall have the right of way. <!-- image --> ## Offence: 10. Anyone who violates this by-law commits a punishable offence and is liable to a fine of $100.00, under the Off-Road Vehicle Act, SNB 1985, c. O-1.5 and its amendments. 11.
