## BY-LAW #28 A
## A BY-LAW REGULATING THE COLLECTION, STORAGE, AND DISPOSAL OF SOLID WASTE IN THE MUNICIPALITY OF THE VILLAGE OF RIVERSIDE-ALBERT
BE IT ENACTED by the Council of the THE VILLAGE OF RIVERSIDE-ALBERT under the authority vested in it by the Municipalities Act, R.S.N.B, c.M-22, and amendments thereto as follows:
## 1. Definitions
"Ash" or "Ashes" means the residue, including soot, of any fuel or waste after it has been consumed by fire;
"Bulky Item" includes, but not limited to, weighty or large articles such as major household appliances, stoves furnaces, barbecues, bed springs, mattresses, furniture, boxes, barrels, water tanks, tires;
- "VILLAGE Engineer/By-law Enforcement Officer" means the VILLAGE Engineer of the VILLAGE OF RIVERSIDE-ALBERT or his or her designate/any person designated by the Municipal Council to enforce the provisions of municipal by-laws;
"Collection Day" means the day of the week on which waste is collected;
"Clerk" means the Clerk of the Village of Riverside-Albert.
"Council" means the Council of the Village of Riverside-Albert.
- "Garbage" means household waste material that is not recyclable, compostable, hazardous or otherwise noncollectable, as set out in Schedule "C" to this By-Law;
- "Household Hazardous Waste" means hazardous waste as set out in Schedule "D" to this By-Law;
"Municipality" means the Village of Riverside-Albert.
- "Non-collectable Waste" means waste as set out in Schedule "E" to this By-Law;
- "Organics" means compostable and organic waste as set out in Schedule "A" to this By- Law;
- "Recyclables" means recyclable waste material as set out in Schedule "B" to this By-Law;
- "Waste" includes any garbage, recyclable material, compostable material, ashes, and bulky Items, dry waste, household hazardous waste, non-collectable waste, wet waste and yard waste, including, but not limited to, all items listed in Schedules "A", "B", "C", "D", and "E";
"Regular Collection" means weekly and bi-weekly regular pickup for residential Recyclables, Organics, and Waste;
"Residential Dwelling" means a building or part of a building fronting on a public street, occupied or capable of being occupied as a home or residence by one or more persons, and containing one or more dwelling units but shall not include a hotel, a motel, apartment hotel, hostel or a building containing a professional, industrial, commercial or institutional;
"Village" means the municipal corporation of the VILLAGE OF RIVERSIDE-ALBERT.
- "Yard Waste" means grass clippings including thatch, leaves, and bundled brush, and branches and tree limbs having a diameter not greater than 2.5 centimetres (1 inch), hedge trimmings, and all woody plants including vines, rose bushes and the like.
2. The VILLAGE OF RIVERSIDE-ALBERT shall provide three-stream "Organics", "Recyclables" and "Garbage" collection and disposal service for all residential dwellings.
3. A person who disposes of waste through the waste collection and disposal service provided by the VILLAGE OF RIVERSIDE-ALBERT shall ensure that waste that is placed for collection at curbside or roadside is properly separated into "Organics", "Recyclables", and "Garbage" according to the lists set out in Schedules "A", "B", and "C" of this bylaw, and placed into separate bags or in a receptacle or container, as provided for herein.
4. (1) A person who disposes of Organics through the waste collection and disposal service provided by the VILLAGE OF RIVERSIDE-ALBERT shall ensure that Organics are properly sorted according to Schedule "A" to this by-law and drained of liquids before being placed in:
(a) a green transparent bag no greater than 35" (89 cm) wide and 47" (120 cm) long, and no less than 20" (51 cm) wide and 22" (56 cm) long and at no time weighs more than 15 kilograms (33 pounds), or
(b) a transparent BPI®, BNQ and Compost Council of Canada certified compostable bag clearly marked with the BPI® and Compost Council of Canada Compostable logos (as shown in Schedule "A") and no greater than 35" (89 cm) wide and 47" (120 cm) long, and no less than 20" (51 cm) wide and 22" (56 cm) long and at no time weighs more than 15 kilograms (33 pounds), or
(c) a receptacle or container, provided such organics are placed in a bag as described in subsections (a) or (b), and such bag or receptacle does not weigh more than 15 kilograms (33 pounds).
(2) A person who disposes of pet or animal feces through the waste collection and disposal service provided by the VILLAGE shall ensure that such waste is drained of liquids and placed in bags as described in subsection (1)(a), (b) and (c).
(3) A person disposing of Yard Waste through the waste collection and disposal service provided by the VILLAGE shall ensure that such yard waste be packaged:
(a) in plastic bags or receptacles as described in subsection (1) provided such bag or receptacle weights no more than 15 kilograms (33 pounds), or
(b) in any transparent green, orange or clear plastic bags no greater than 35" (89 cm) wide and 47" (120 cm) long, and no less than 20" (51 cm) wide and 22" (56 cm) long and at no time weighs more than 15 kilograms (33 pounds), or
(c) such that, branches and limbs (no greater than 2.5 centimeters or 1 inch in diameter) must be securely bundled and no longer, taller, or wider than 600 mm (2 feet).
5. 1) A person who disposes of Recyclables through the waste collection and disposal service provided by the VILLAGE shall ensure that such waste is properly sorted according to Schedule "B" to this by-law and contained in
(a) a blue transparent bag no greater than 35" (89 cm) wide and 47" (120 cm) long and no less than 20" (51cm) wide and 22" (56 cm) long and at no time weighs more than 15 kilograms (33 pounds) or.
(b) a receptacle or container provided such waste is placed in a plastic bag as described in subsection (a) and such bag, receptacle or container does not weigh more than 15 kilograms (33 pounds).
6. (1) A person who disposes of Garbage through the waste collection and disposal service provided by the VILLAGE shall ensure that such waste is properly sorted according to Schedule "C" to this by-law and contained in
- (a) a clear transparent bag no greater than 35" (89 cm) wide and 47" (120 cm) long and no less than 20" (51cm) wide and 22" (56 cm) long and at no time weighs more than 15 kilograms (33 pounds) or.
- (b) a receptacle or container provided such waste is placed in a plastic bag as described in subsection (a) and such bag, receptacle or container does not weigh more than 15kilograms (33 pounds).
(2) A person who disposes of broken glass through the waste collection and disposal service provided by the VILLAGE shall ensure that such glass is placed within a cardboard box which is taped and clearly labeled "Broken Glass" and placed in a clear transparent bag.
7. Every person who disposes of waste through the waste collection and disposal service provided by the VILLAGE shall ensure that such waste is placed at curbside or roadside immediately in front of his/her property no earlier than 7:00 a.m. on the day of collection and no later than 8:00 a.m. on the day of collection and in such a location as to not impede or obstruct pedestrian or vehicular traffic.
8. Every person shall ensure that waste set out for collection is not located on top of any snow bank or in an area not cleared of snow and ice.
9. Every person shall ensure that all waste not collected and all containers and receptacles are removed from the collection area prior to 8:00 p.m. on the day of collection.
10. Solid Waste Receptacles shall be maintained in good condition at all times and must be acceptable to the Municipality.
11. The owner or occupant of any housing unit, shared accommodation, or property shall not permit waste to be stored on the property or premises for a period of more than seven days without same being placed for collection on the day of collection set by the Council of the Municipality.
12. For the purposes of carrying out the waste collection and disposal service the Village Collector shall determine the collection routes at the approval of the Village Council.
13. Waste collection shall be collected once every 7 days and the Village Council may fix a day or days on which household solid waste shall be collected or such other days as may be necessary to accommodate emergency situations or exceptional circumstances.
14. Where a collection day, as set out in Schedule "F", falls on New Years Day, Christmas Day or Boxing Day, the collection of waste shall be carried out on an alternate day, notice of which will be made by a Special newsletter with general circulation to the municipality, by mail-out or by any other means of communication.
15. The VILLAGE may introduce programs to collect waste other than Organics, Recyclables, and Garbage at such times and under such conditions as the VILLAGE may deem advisable. Notice of such programs, the terms and conditions and collection times shall be published in a local newspaper having general circulation in the municipality, by mail-out or by any other means of communication.
16. The Municipality may collect waste other than the three bag program designed for a specific purpose, which shall be referred to as Special Collection Waste. Such programs may be provided by the Municipality at times and under conditions as determined by the Council, and may include but not limited to:
5. (a) A special spring and fall bulky item and yard waste program.
6. (b) A Hazardous Waste Collection Program, which shall consist of a designated special site where citizens will be able to drop off Hazardous Waste at least once a year to the eco 360 mobile facility. Or, hazardous waste may be dropped off at the eco 360 facility, 2024 Route 128, Berry Mills at times set by the facility.
7. (c) The Municipality will publish notice of any Special Collection Waste Program in a local newspaper or by special newsletter to every household within the Municipality.
8. (d) The Municipality may set conditions for the provision of any Special Collections Waste Program.
17. No person engaged in the business of collecting, hauling or transporting waste shall transport such waste within the Village of Riverside-Albert unless such person does so with a vehicle specifically designed, constructed, or intended for such purpose, and unless such vehicle has an enclosed body or a covering securely fastened to the body of the vehicle or, in the case of a packer-type vehicle, has hopper doors securely and tightly closed so as to prevent the escape of the contents of the vehicle to the outside.
18. Waste material and rubbish left on premises following the construction, alteration, demolition, or repair of a building or structure shall be removed and disposed of by the owner of such property as promptly as possible at the owner's expense.
19. The Council may give direction to the owner of a premises to remove, within a specified period of time, all waste materials, household waste and rubbish from the premises of which he/she is the owner. Upon failure to do so, the Council may cause such waste material, household waste, or rubbish to be removed at the expense of the owner of the

2. No person may dispose or cause to be disposed of any hazardous waste on any private or public lands or in any body of water with the Village of Riverside-Albert.
3. No person shall allow their pet to run at large so as to endanger the safety of the Village Collector on the waste collection day. If the solid waste is not collected under this circumstance, the Municipality shall notify the homeowner.
4. No person may dispose or cause to be disposed the waste of any septic tank, raw sewage, or human feces in the solid waste pick-up.
20. The VILLAGE may refuse to accept an item for disposal if it is not sorted, packaged or placed for collection in accordance with the provisions of this by-law or if it is non-collectable waste.
21. Any peace officer or by-law enforcement officer is hereby authorized to take such action or issue such tickets as they may deem necessary to enforce any provision of this by-law.
22. The VILLAGE Engineer is designated as the officer responsible for the administration and enforcement of this by-law.
23. No person shall place for collection any Waste except as provided for herein.
24. Any person who violates any provision of this by-law is guilty of an offence, and liable on conviction to a minimum fine of one hundred ($100.00) dollars, and a maximum fine of one thousand and seventy ($1070.00) dollars.
25. A By-law entitled "Village of Riverside-Albert By-law No. 28 - A By-law Regulating the Collection, Storage, and Disposal of Solid Waste and Other Materials in the Municipality of The Village of Riverside-Albert", ordained and passed on April 2, 2007 and all amendments thereto, is hereby repealed.
26. No person shall place for collection any Waste except as provided for herein.
27. Any person who violates any provision of this by-law is guilty of an offence, and liable on conviction to a minimum fine of one hundred ($100.00) dollars, and a maximum fine of one thousand and seventy ($1,070.00) dollars.
A By-law entitled "BY-LAW NO. 28 - A BY-LAW REGULATING THE COLLECTION, STORAGE, AND DISPOSAL OF SOLID WASTE AND OTHER MATERIALS IN THE MUNICIPALITY OF THE VILLAGE OF RIVERSIDE-ALBERT" ordained and passed on April 2, 2007, and all amendments thereto, is hereby repealed.

Organics - All organic and compostable waste only. Food and yard waste, never glass or plastic.
Organics include but are not limited to the following list of materials and must be placed in a green transparent plastic ba or certified compostable transparent bag for collection curbside. All containers and packaging (plastics, metals, glass Styrofoam, cardboard and paper) must be separated or emptied and removed; their contents only belong in Organics.

## SCHEDULE B: RECYCLABLES
Recyclables -Paper, cardboard, hard plastic, metal and aluminum, electronics and cell phones, milk and juice cartons, and Styrofoam.
Recyclables include but are not limited to the following listed items and materials and must be placed in a transparent blue bag for bi-weekly collection curbside. All recyclables should be emptied, rinsed, scraped or wiped clean before going into the blue bag for collection. It is essential that recyclables not be dripping or sopping with food or other organics.

## SCHEDULE D: HOUSEHOLD HAZARDOUS WASTE
Household Hazardous Waste (HHW) - Anything dangerous, poisonous, or corrosive.
Household Hazardous Waste includes but is not limited to the items and materials listed below. Never put HHW in with your Organics, Recyclables or Garbage. FREE drop-off is available at the Solid Waste Site's Hazardous Waste Depot located at 100 Bill Slater Drive in Berry Mills, NB. Eco360 also operates a Mobile HHW Unit in the Spring and Fall of each year. For directions and hours of operation please consult www.eco360.ca or call 877-1040.

## SCHEDULE E: NON-COLLECTABLE WASTE
The following items are not acceptable as residential/household waste and will not be collected if deposited curbside or in a clear, transparent blue or green bag. If you wish to dispose of any of the following items, please consult eco360 at (506) 877-1040 or www.eco360.ca for safe and proper disposal instructions.
- Explosive or highly combustible materials such as a celluloid cutting, moving picture film, or oil-soaked or gasolinesoaked rags and the like;
- Plaster, drywall, fiberglass insulation, lumber, concrete, a boulder or other waste residue resulting from construction, building renovation or a demolition operation;
- Tree limbs, firewood, stumps, trunks, and branches larger than 1" diameter;
- Swill, liquid waste, or organic matter which has not been drained and wrapped in accordance with the provisions of this By-Law;
- A syringe, blade, lancet, needle, clinical glass, dressing, bandage, gauze, swab, pipet, cast, speculum, urine, colostomy or enema bag, an intravenous bag, a catheter or other tubing, dentures, an alginate impression or like material, a stool sample, flesh or tissue from any animal or human, bodily fluid-stained material infectious or otherwise including clothing and bedding, an incontinence or feminine hygiene product known to be infectious, a piece of surgical clothing including a gown, mask, glove, patient bib, gown or sheet and the like, a liquid or solid medicine including a pill or vaccine, a container or vial from which a pill or vaccine is extracted that contains any amount of such pill or vaccine, petri-dish, test tube, surgical equipment, microscope slide, scope, electrode and the like, any of which is generated from a clinic, hospital, surgery, an office of a physician, surgeon, dentist, veterinarian or the like;
- A syringe from a household;
- An animal carcass, other part or any portion thereof of any dog, cat, fowl or any other creature with the exception of bona fide kitchen or food waste;
- All Household Hazardous Waste as included in the previous section;
- Green or Blue Waste which has not been prepared or packaged for collection in accordance with the provisions of this By-Law;
- A tire, car battery, gas or oil tank, automotive part or body;
- Any material which is frozen or stuck to the waste receptacle or container and cannot be removed by shaking manually;
- Any material or substance which may cause damage to the natural environment;
- Any septic tank pumping, raw sewage, sewage sludge or industrial process sludge;
- Any radioactive material;
- Any ash or ashes defined as the residue, including soot, of any fuel or waste after it has been consumed by fire.
