BY-LAW NO. 100
A BY-LAW RELATING TO TRAFFIC
AND PARKING IN THE
VILLAGE OF ALMA
Pursuant to the authority vested in it by the Local Governance Act, R.S.N.B 2017, Chapter 18,
and the Motor Vehicle Act, R.S.N.B., 1973, Chapter M-17, the Council of the Village of Alma, duly
assembled, enacts as follows:
1. DEFINITIONS
In this by-law:
«By-Law Enforcement Officer» means a person appointed and designated by the Council
of the Village of Alma to enforce the municipal by-laws;
«alley» means a driveway providing access to a property, whether vacant or not;
«Council» means the mayor and councillors of the Village of Alma;
«heavy equipment» means any heavy equipment, generally motorized, used to perform
work;
«highway» means the entire width between the boundary lines of every street, road, lane,
alley, park, parking lot, drive-in theatre, school yard, picnic site, beach, winter road across
ice or place when any part thereof is used by the general public for the passage or parking
of vehicles, and includes the bridges thereon and, unless the context indicates otherwise
or unless the reference is contained in a provision that is in conflict with a provision of the
New Brunswick Highway Corporation Act, a highway under the administration and control
of the New Brunswick Highway Corporation or a project company;
«provincial highway» means a highway built and maintained by or under the supervision
of the Department of Transportation, the New Brunswick Highway Corporation or a project
company, whether or not such highway lies within the geographical boundaries of a local
authority;
«school zone» means a portion of a highway designated as such pursuant to section
142(2) of the Motor Vehicle Act;

«shipment, offloading and delivery zone» means a location where a vehicle may be parked
to load or unload merchandise; make deliveries of goods, wares or merchandise, or assist
or allow passengers to enter or alight from a vehicle;
«street» means any public place, avenue, road, alley, highway, court, trail or any other
public place in the Village of Alma intended for vehicle traffic or used by the public for that
purpose;
Terms used in this by-law and not defined herein shall have the same meaning as defined
in the Motor Vehicle Act, R.S.N.B., 1973, c. M-17 and amendments thereto, when they
appear in this by-law.
2. PROVINCIAL, REGIONAL AND MUNICIPAL STREETS
1) The streets and portions of streets set out in the official municipal kilometer list between the
Village of Alma and the New Brunswick Department of Transportation and Infrastructure are
designated municipal, provincial and regional streets.
3. TRUCK ROUTES
(1) Provincially designated highways are established as truck routes and shall be marked
with signs approved by the New Brunswick Department of Transportation and
Infrastructure.
(2) The driver of any commercial vehicle which registered gross mass is 7500 kg or more,
shall not use any highways within the Village of Alma except a truck route, provided that
such driver may for the purpose of delivering or taking delivery of a load at a point of
delivery within the Village of Alma which is not immediately accessible to a truck route,
and on returning therefrom use the truck route to and from the entrance thereon nearest
the point of delivery, and use the highway not being a truck route which provides the
shortest route between a truck route and the point of delivery.
(3) Subsection (2) does not apply to motor vehicles owned by the Village or to Her Majesty
the Queen in right of the Province of New Brunswick, their contractors or agents involved
in the performance of their duties for the Village or the Province of New Brunswick.
4. SIGNS OR OTHER TRAFFIC CONTROL DEVICES
Subject to Section 116 of the Motor Vehicle Act, the Council may from time to time or for special
purposes erect signs or other devices for the purpose of directing or regulating traffic.

5. PROHIBITED PARKING
(1) It is prohibited to park a motor vehicle:
a) on any street or section thereof listed in Schedule A of this by-law;
b) less than 1.5 m from an alley unless otherwise indicated by a sign;
c) less than 5 m along a curb or roadside directly in front of a fire hydrant;
d) in a fire lane;
e) less than 5 m from a crosswalk unless otherwise indicated by a sign;
f) in a location where prohibited by a sign;
g) between a sidewalk and a curb;
h) for a period exceeding that indicated by a sign;
i) less than 10 m before a flashing light, a stop sign, or a traffic signal placed along
the edge of a roadway, unless otherwise indicated by a sign;
j) on any street between midnight and 7:00 a.m., from November 1st to April 30th
inclusive;
k) on Main Street between 2:00 a.m. and 5:00 a.m., from April 1st to November 30th
inclusive;
l) in an area designated as a parking space for disabled persons by a traffic control
device, erected by the Village of Alma unless the motor vehicle is being used to
transport a disabled person and a valid disabled person's identification plate,
permit or placard issued by the Registrar of Motor Vehicles for the Province of New
Brunswick or issued by a province, state, territory or country with which a mutual
recognition arrangement or agreement has been concluded, is displayed in a
prominent place on or in of the motor vehicle;
m) it is prohibited to park a vehicle or equipment in a manner that completely or
partially blocks a sidewalk;
n) it is prohibited to park a vehicle or equipment in such a way as to completely or
partially encroach on a traffic lane; or
o) no person shall pitch a tent or park a trailer or mobile home overnight on any
municipal street.
(2) It is prohibited to park on the street all heavy equipment, large vehicles, commercial
vehicles, or trailers.

6. SHIPMENT, OFFLOADING AND DELIVERY ZONE
No person shall stop, stand or park a motor vehicle on any of the streets set out in Schedule A,
except in the circumstances where the driver of the motor vehicle is actually engaged in the
loading or unloading of merchandise, making deliveries of goods, wares or merchandise or
assisting or allowing passengers to enter or alight therefrom.
7. IMPOUNDMENT
(1) A police officer, a By-Law Enforcement Officer, or any person designated by Council
for such a purpose may remove and impound, in addition to subjecting its owner to a fine,
any vehicle:
a) that is illegally parked;
b) that fully or partially blocks traffic;
c) that is abandoned for at least 48 consecutive hours;
d) that obstructs snow removal or other Village operations.
(2) Vehicle removal, care, stowage and impoundment costs shall be paid by the owner
before the vehicle is returned to him or her.
8. EMERGENCY
(1) Notwithstanding the provisions of this by-law, any police officer, a By-Law Enforcement
Officer, employee authorized by the Council or by the Province of New Brunswick, or any
firefighter, may direct, suspend or disrupt traffic or authorize parking and have lines and
barricades set up temporarily in an indicated manner that they deem appropriate, if an
emergency or special circumstance warrants.
(2) Failure to comply with instructions or orders from any police officer, By-Law
Enforcement Officer, employee authorized by the Council or by the Province of New
Brunswick, or any firefighter, is prohibited.
10. VIOLATIONS AND PENALTIES
(1) No person other than the driver or owner of a vehicle shall remove any notice or ticket
which has been placed thereon by a person authorized by Council to enforce this by-law.
(2) Any person who violates any provision of this bylaw is guilty of an offence and liable
on conviction to a minimum fine of $30 and a maximum fine of $125.
This by-law comes into full force on the date of final passing thereof and upon assent.

11. REPEAL
By-Law No. 99 entitled A By-Law relating to traffic and parking in the village of Alma ordained
and passed July 19, 2021 is hereby repealed.
