Rural Community of Fundy Shores 31 Malcolm Meehan Road Musquash NB E5J 2G2 www.fundyshores.ca POLICY TITLE: STREETLIGHT POLICY POLICY NUMBER: 2024-01 VERSION NUMBER: 1 DATE APPROVED: JULY 3, 2024 EFFECTIVE DATE: JULY 3, 2024 Policy Statement This policy presents operating, safety and financial guidelines for the Rural Community of Fundy Shores rented streetlights and describes the criteria for reviewing requests for new streetlight installations. Objectives The Rural Community of Fundy Shores recognizes that residents have separate views on street lighting and consideration must be given to balance the needs of safety for the public and the wishes of the public in the affected areas. The objectives of the streetlight policy are to: - Provide policy direction with respect to streetlight service levels and overall streetlight administration. - Provide taxpayers with direction on how to request changes to the streetlight service; - Provide standards and conditions for evaluating the installation of streetlights on publicly maintained roads. Exclusions The Rural Community is not responsible for the installation of streetlights on private roads, and they are therefore excluded from this policy and will not be considered for installation. Subdividers/Developers/Private Road owners are required to pay for and coordinate the installation of their own streetlights. General Conditions The Rural Community of Fundy Shores is responsible for the rental cost of streetlights ordered for installation by the Rural Community. Streetlights and/or dusk till dawn lights installed by private individuals are the responsibility of those individuals and shall not be turned over to the Rural Community unless approved by Council for public safety reasons. Streetlights rented by the Rural Community are provided for public safety, not property security. The Rural Community shall recover any streetlight-related costs not financed by reserves, private road owners or subdivision/developers, by the following method - administered through the tax rate per $100 of assessed property value. This charge will become part of the total property taxes due to the Rural Community. All property tax rates are approved by Council on an annual basis. Rural Community of Fundy Shores 31 Malcolm Meehan Road Musquash NB E5J 2G2 www.fundyshores.ca The annual operating budget will be proposed to Council, which will include the installation and rental/operational fees associated with the cost of streetlighting within the Rural Community. Over-expenditure as a result of streetlights will be managed as any overage and that is at the direction of Council. Any individual resident and/or organization may, with documented support from a minimum of 30% of the population within a 5km range and justification of the public safety issue it will address, apply directly to the Rural Community for a new streetlight. A streetlight map/list will be managed by the Office of the Chief Administrative Officer or their designate. Application & Review Process The Rural Community does not have a comprehensive streetlight design plan. Therefore, in the absence of such a plan, the installation will be reviewed and approved or denied based upon the following: - Is the request being made within the Rural Community of Fundy Shores boundaries, - Is there an existing utility pole at the requested location, including sufficient electrical equipment, wiring and pole spacing, - Is the light located on public property or within the roadway easement - Is the light roadway facing - Does lighting provide necessary improvements to public safety, - Is there sufficient monies allocated to the general operating budget to pay for such installation and maintenance Priority of installation requests will be given to: - Roadway intersections - Areas with high night-time traffic accident history (per Fire Department/Police) - Areas of heavy pedestrian or vehicular traffic, such as public or community buildings, schools, community centres etc. Removal of Streetlights Removal of existing streetlights may be requested. The request should include the following: - Identify the area of impact - Identify the property and owners impacted by the change - Signatures of the property owners in favour of removing the streetlight. Repairs and Replacement of Malfunctioning Streetlights Anyone noticing a streetlight that is damaged or not functioning properly can report it to the Community Office and they will request the repairs be completed by the utility.
