TRADERS (PEDDLER) AND
TEMPORARY SALES BUSINESSES IN
GRAND FALLS

Loi sur la gouvemance locale, le conseil
municipal de Grand-Sault, dûment réuni,
adopte ce qui suit :
l. Titre
Le présent arrêté peut être cité sous le
nom « Arrêté sur les colporteurs ».
2. Définitions:
Les définitions qui suivent s'appliquent
au présent arrêté:
a) Colporteur signifie les personnes
morales ou physiques qui colportent ou
vendent de porte à porte des articles ou
marchandises et qui les transportent
d'un endroit à un autre dans ce but.
b) Commerce temporaire de vente
signifie les personnes, morales ou
physiques, qui n'ont pas un endroit
permanent de vente dans les limites de
Grand-Sault et qui opèrent un
commerce temporaire de vente et qui
louent, utilisent ou occupent n'importe
quels emplacement, intérieur ou
extérieur dans Grand-Sault.
N'est pas considéré un commerce
temporaire de vente, les personnes,
morales ou physiques, qui louent,
utilisent ou occupent n'importe quel
emplacement intérieur ou extérieur
avec l'intention d'opérer un endroit
permanent de vente à l'intérieur de
Grand-Sault.
e) Camions-restaurants signifie un
véhicule motorisé, immatriculé ou un
chariot de vente de trottoir utilisé pour
vendre de la noumh-ire au public en
général.
d) Conseil signifie le Conseil
municipal de Grand-Sault.
e) Municipalité signifie la
Municipalité régionale de Grand-Sault
Act under the authority vested in it and its
amendments as follows:
l. Title
This by-law may be referred to as
"Peddler by-law".
2. Définitions:
The following définitions apply to this
by-law:
(a) Transient trader (peddler) means
any individual or légal entity that peddles
or hawks goods or merchandise and
carries or transports them from place to
place for the purpose ofselling said goods
or merchandise.
(b) Temporary sales business means an
individual or légal entity that does not
have a permanent place of business within
the limits of Grand Falls and who
opérâtes a temporary business of selling
goods or merchandise and leases, uses or
occupies any location, whether interior or
exterior in Grand Falls.
Is not considered a temporary sales
business, an individual or légal entity that
leases, uses or occupies any location,
whether interior or exterior with the intent
to operate a permanent place of business
in Grand Falls.
(e) Food truck means a licensed,
motorized vehicle or mobile food unit
that's used for selling food items to the
général public.
(d) Council means the Grand Falls
municipal council.
(e) Municipality means the Grand Falls
Régional Municipality or Grand Falls.

to peddle in conformity to this by-law.
(g) IVIunicipal représentative means a
Clerk, or a person designated by the
Municipality to issue Peddler's Licenses,
collect fees and/or apply this by-law.
Genre et nombre
Les règles qui suivent s'appliquent à
l'ensemble des arrêtés :
3(1) La forme masculine utilisée dans le
présent arrêté désigne aussi bien les
femmes, les hommes et les personnes
non binaires. Le genre masculin est
utilisé sans aucune discrimination dans
le but d'alléger le texte.
3(2) Le pluriel ou le singulier
s'appliquent également à l'unité ou à la
pluralité.
Permis de colporteur
4(1) Incluant les exceptions décrites au
paragraphe 7, nul ne peut colporter ou
vendre des articles ou de la
marchandise de porte à porte ni
s'engager dans un commerce
temporaire de vente, s'il ne s'est pas, au
préalable, procuré im permis de
colporteur auprès du représentant
municipal.
4(2) Toute personne, morale ou
physique, désirant colporter ou vendre
de porte à porte ou s'engager dans un
commerce temporaire de vente devra
compléter une demande de permis
auprès du représentant municipal au
moins 5 jours ouvrables avant le début
de ces activités.
Frais d'acauisition et durée du permis
Les frais d'acquisition du permis de
colporteur et sa durée sont tels que suit :
a) Des frais de 500 $ pour chaque jour
d'activité
b) Tous frais d'acquisition de permis de
colporteur devra être acquitté avant
Gender and number
The following mles apply to all by-laws:
3(1) The masculine form is used in this
by-law to designate women, men, and
non-binary people. The masculine gender
is used without any discrimination to
lighten the text.
3(2) The plural or singular also applies to
unity or plurality.
Peddler's License
4(1) Including the exceptions described in
section 7, no person shall peddle or hawk
goods or merchandise or engage in a
temporary sales business, if that person
has not, beforehand, obtained a Peddler's
License fi-om the municipal

4(2) Individuals or légal entities, desiring
to peddle or hawk goods or merchandise
or engage in a temporary sales business,
must apply to the municipal
représentative at least 5 working days
before the start oftheir business.
License fee and duration
The Peddler's License fee and its duration
are as follows:
(a) a fee of $500 for each day ofbusmess.
(b) all licensing fees for peddling will
have to be paid before the said license is

Temporary sales business
A permit for a temporary sales business
may be granted by the Municipality on
the condition that the said temporary sales
business does not unduly interfere or
cause hardship to businesses permanently
established in Grand Falls.
Exemptions
L'opération des exceptions suivantes

a) Une personne qui colporte ou vend
de porte à porte des fi-uits, des légumes,

provenant de sa ferme ou de son jardin;
b) Un pêcheur colportant ou vendant de
porte à porte le poisson, les huîtres ou
tout autre finit de mer qu' il a pêches lui-
même. Le demandeur doit fournir une
preuve de licence de pêche
commerciale obtenue du ministère des
Pêches et Océans Canada;
e) Aux personnes employées par des
associations de tempérance ou de
bienfaisance ou des associations
religieuses de la province, qui
colportent ou vendent des brochures sur
la tempérance ou d'autres publications
morales ou religieuses sous la direction
de ces associations, à l'exclusion de
tout autre objet ou marchandise.
d) Aux associations caritatives,
reconnues par la Municipalité, qui
colportent dans le but de servir

e) Aux personnes, morales ou
physiques, vendant directement aux
commerçants locaux.
f) Aux vendeurs de produits maison,
artisanaux ou saisonniers, comme les
produits d'érable, arbres de Noël et
accessoires et tous autres produits
7. Exceptions
The following exceptions will be allowed
to operate within Grand Falls subject to
section 4. Licensing fees for peddling will
not apply.
(a) a person peddling or hawking fruits,
vegetables, meats and other products
harvested by him from his farm or garden;
(b) A fisherman peddling or hawking fish,
oysters or any product harvested by him
fi-om the sea. The applicant must provide
proof of a commercial fishing license
from the Department of Fisheries and
Océans Canada;
(e) Persons employed by any temperance,
benevolent or religious society in the
Province for the peddling or selling of
temperance tracts or other moral or
religions publications under the direction
of such society, to the exclusion of other
goods and merchandise.
(d) non-profit organizations, recognized
by the Municipality, who peddle with the
intention of serving the society or in its
name;
(e) individuals or légal entities, selling
directly to the local merchants;
(f) vendors ofhomemade products, crafts
or seasonal items such as maple products,
Christmas trees and accessories and other
similar products.

8. Camions-restaurants
Grand-Sault souhaite autoriser
F opération des camions-restaurants
dans la municipalité d'une façon
responsable et contrôlée.
Les règlements pour les camions-
restaurants sont tels que déterminés
dans la politique 2023-04 concernant
les Restaurateurs de mes. Tout
règlement applicable inclus dans le
présent arrêté s'applique aussi aux
camions-restaurants.
9. Disuositions générales
a) Emplacement
i) Nul ne peut colporter en utilisant,
s'installant ou se stationnant sur
une propriété municipale, une me
ou une emprise de me ou dans un
bâtiment municipal sauf avec
l'approbation expresse du conseil.
ii) Tout individu ou entité morale
ou physique qui vend des produits
périssables à partir d'un véhicule
motorisé, incluant les camions-
restaurants, sont encouragés de
s'installer au Marché agricole au 68
chemin Madawaska sujet à une
entente avec le Marché agricole et
le paiement des droits requis par le
marché.
iii) Distance d'une entreprise
semblable - Les personnes,
morales ou physiques, qui vendent
des produits semblables à une
entreprise établie dans la
municipalité ne sont pas autorisées
dans im rayon de 150 mètres de la
propriété où l'entreprise établie
opère.
(g) individuals or légal entities who sell
products and items in the course of
spécial or popular activities and which
have beforehand paid a right of
concession to the organizers ofthe spécial
or popular activity including but not

Grand Falls Régional Potato Festival.
8. Food ti-ucks
Grand Falls wishes to authorize the
opération of food tmcks in the
municipality in a responsible and
controlled marner.
Rules and requirements for food tmcks
are set out in Policy 2023-04 conceming
the Food Tmck Program. Any applicable
régulations included in this by-law also
apply to Food trucks.
Général urovisions
(a) Location
i) No individual or légal entity shall
sell in a municipal building, on a
sù-eet, a right of way or other
municipal property, except with the
express approval ofCouncil.
ii) Any individual or légal entity
selling perishable goods from a
motorized vehicle, including food
trucks, are encouraged to set-up at the
Farmers' Market at 68 Madawaska
Road subject to an agreement with
the Farmers' Market and payment of
the required fees to the Market.
iii) Distance from similar businesses
- Individuals or légal entities selling
products similar to an established
business in the municipality shall not
be authorized to sell said products
within a radius of 150 meters ofthe
property where the established
business is operating.

présent arrêté n'est pas respectée ou si
la force policière ou im représentant de
la Municipalité reçoit une ou des
plaintes à l'égard du comportement ou
des agissements du détenteur.
10. Inspections et application
a) Les personnes régulièrement
nommées agents d'exécution des
arrêtés par le conseil municipal sont
autorisées à réaliser les inspections
nécessaires à l'adminisû-ation ou à
l'application du présent arrêté.
b) Les agents de la paix et les agents
d'exécution des arrêtés sont habiletés à
prendre les mesures et à exercer les
pouvoirs et les fonctions énoncés dans
le présent arrêté et dans la Loi sur la
gouvemance locale qu'ils estiment
nécessaires à l'application des
dispositions du présent arrêté.
11. Pénalités administratives
11(1) La Municipalité peut exiger
qu'une pénalité administrative soit
payée relativement à l'infraction d'une
disposition de cet arrêté, selon le
paragraphe 11(2).
11(2) A moins d'indication contaire,
toute personne qui contrevient à une
disposition du présent arrêté peut payer
à la Municipalité, dans un délai de 45
jour civil à compter de la date de ladite
infraction, une pénalité administrative
de 250$ pour la première infraction,
500 $ pour la deuxième infraction et de
l 000 $ pour la troisième infraction et
chaque infraction subséquente et, une
fois payée, la personne n'est plus
susceptible de poursuites judiciaires

(b) The holder of a license shall keep the
license on his person and display it at the
request ofthe municipal représentative or
of a member of the Grand Falls Police
Force.
(e) The license may be revoked if any
provision of this By-law is violated or if
the police force or a municipal officiai
receives one or more complaints
regarding the conduct or behavior of its
holder.
10. Inspections and Enforcement
(a) Every person duly appointed by
Council as a by-law enforcement officer
is hereby authorized to carry out any
inspection that is necessary for the
administration or enforcement ofthis by-
law.
(b) Any peace officer or by-law
enforcement officer is hereby authorized
to take such actions, exercise such powers
and perform such duties, as may be set out
in this by-law or in the Local Govemance
Act and as they may deem necessary to
enforce any provision ofthis by-law.
11. Administrative penalties
11(1) The Municipality may require an
administrative penalty to be paid for
violatmg a provision ofthis by-law as set
out in subsection 11(2).
11(2) Unless otherwise indicated, a
person who violâtes any provision ofthis
by-law may pay to the Municipality,
within 45 calendar days fi-om the date of
such violation, an administrative penalty
in the amount of $250 for the lst offence,
$500 for the 2nd offence and $1,000 for
the 3rd and each subsequent offence and,
upon such payment, the person who
committed the violation is not liable to be
prosecuted therefor.

12. Infraction et pénalités
a) Quiconque omet de se conformer à
une disposition du présent arrêté

e. P-22.1 et ses modifications, à titre
d'infraction de la Classe D.

une disposition du présent arrêté pourra

représentant municipal ou son agent
désigné.
13. Divisibilité
Lorsque tout ou partie d'une disposition
du présent arrêté est déclarée invalide
par un tribunal compétent, le reste du
présent arrêté demeure en vigueur, sauf
sur ordonnance contraire du tribunal.
14. Abrogation
L'adoption du présent arrêté abroge les
arrêtés suivants :
Arrêter no. 71 de la ville de Grand-Sault
et ses modifications;
Arrêté no. 9-2018 de la communauté
rurale de Saint-André et ses
modifications.
15. L'abrogation des arrêtés indiqués au
paragraphe 14 n'affectera pas une
sanction, confiscation ou obligation
imposée avant l'abrogation ou une
procédure d'exécution complétée ou en
suspens au moment de l'abrogation, et
n'aura pas pour effet de révoquer,
d'annuler, de modifier ou d'invalider
quoi que ce soit qui serait complété,
existant ou en suspens au moment de
Pabrogation, ni de lui porter préjudice.
16. Date d'entrée en vigueur
Le présent arrêté entre en vigueur lors
de son adoption.
12. Offences and penalties
(a) Any person who omits to conform to
any provision ofthis municipal by-law is
guilty of an offence pursuant to Part II of
the Provincial Offences Procédure Act,
S.N.B. 1987, C. p-22.1 and its
amendments, as a Class D offence;
(b) Any person who omits to conform to
any provision ofthis by-law may see his
license revoked by the municipal
représentative or his designated agent.
13. Severability
Where a court of compétent jurisdiction
déclares any section or part ofa section of
this by-law invalid, the remainder of this
by-law shall continue in force unless the
court makes an order to the contrary.

The adoption of this by-law repeals the
following by-laws:
By-law no. 71 ofthe Town of Grand Falls
and its amendments;
By-law no. 9-2018 of the rural
comrmmity of Saint-André and if s
modifications.
The repeal ofby-laws listed in section 14,
shall not affect any penalty, forfeitnre, or
liability, incurred before such repeal or
any proceeding for enforcing the same
completed or pending at the time of
repeal; nor shall it repeal, defeat, disturb,
invalidate or prejudicially affect any
matter or thing whatsoever completed,
existing or pending at the time ofrepeaL
16. Effective Date
This municipal by-law comes into effect
on the date ofits adoption.
