MUNICIPALITÉ RÉGIONALE DE GRAND-SAULT GRAND FALLS REGIONAL MUNICIPALITY ARRÊTÉ S-l UN ARRÊTÉ DE GRAND-SAULT RELATIF AUX LIEUX DANGEREUX OU INESTHÉTIQUES En vertu des pouvoirs que lui confère la Loi sur la gouvemance locale, le conseil municipal de Grand-Sault dûment réuni, adopte ce qui suit: BY-LAW S-l A BY-LAW 0F GRAND FALLS RESPECTING DANGEROUS OR UNSIGHTLY PREMISES Pursuant to the powers conferred by the Local Govemance Act, the Grand Falls municipal council, duly assembled, enacts as follows: l. Titre Le présent arrêté pourra être cité sous le nom « Arrêté sur les lieux inesthétiques ». 2. Genre et nombre Les règles qui suivent s'appliquent à F ensemble des arrêtés : 2(1) La forme masculine utilisée dans le présent arrêté désigne aussi bien les femmes, les hommes et les personnes non-binaires. Le genre masculin est utilisé sans aucune discrimination dans le but d'alléger le texte. 2(2) Le pluriel ou le singulier s'appliquent également à l'unité ou à la pluralité. 3. Champs d'application La partie 13 Lieux dangereux ou inesthétiques de la Loi sur la gouvemance locale, y compris ses modifications, s'applique à l'intérieur des anciennes limites administratives de la ville de Grand-Sault, de la municipalité de Drummond et de la communauté rurale de Saint-André. 4. Inspection et application 4 (l) Les personnes régulièrement nommées agents d'exécution des arrêtés par le conseil municipal sont autorisées à réaliser les inspections nécessaires à l'administration ou à l'application du présent arrêté. 4(2) Les agents de la paix et les agents d'exécution des arrêtés sont habiletés à prendre les mesures et à exercer les pouvoirs et les fonctions énoncés Short title This By-law may be referred to as the "Unsightly Premises By-law". Gender and number The following mles apply to all by- laws: 2(1) The masculine form is used in this by-law to designate women, men and non-binary people. The masculine gender is used without any discrimination to lighten the text. 2(2) The plural or singular also applies to unity or plurality. Application fields That Part 13, Dangerous or Unsightly Promises, of the Local Govemance Act and its amendments applies within the former administrative limits ofthe Town of Grand Falls, the municipality of Drummond and the rural community of Saint-Andre. Inspection and Enforcement 4(1) Every person duly appointed by council as a by-law enforcement officer is hereby authorized to carry out any inspection that is necessary for the administration or enforcement ofthisby-law. 4(2) Any peace officer or by-law enforcement officer is hereby authorized to take such actions, exercise such powers, and perfomi ARRÊTÊ/BY-LAW S-l Page 2 dans le présent arrêté et dans la Loi sur la gouvemance locale qu'ils estiment nécessaires à l'application des dispositions du présent arrêté. such duties, as may be set out in this by-law or in the Local Govemance Act and as they may deem necessary to enforce any provision of this by- law. 5. Divisibilité Lorsque tout ou partie d'une disposition du présent arrêté est déclarée invalide par un tribunal compétent, le reste du présent arrêté demeure en vigueur, sauf sur ordonnance contraire du toibunal. 6. Abrogation L'adoption du présent arrêté abroge les arrêtés suivants : Arrêté 56 de la ville de Grand-Sault et ses modifications; Arrêté 5-2012 de la communauté rurale de Saint-André et ses modifications; Arrêté 61-1 de la municipalité de Drummond et ses modifications. 7. L'abrogation des arrêtés indiqués au paragraphe 6 n'affectera pas une sanction, confiscation ou obligation imposée avant l'abrogation ou une procédure d'exécution complétée ou en suspens au moment de l'abrogation, et n'aura pas pour effet de révoquer, d'annuler, de modifier ou d'invalider quoi que ce soit qui serait complété, existant ou en suspens au moment de l'abrogation, ni de lui porter préjudice. 8. Date d'entrée en vigueur Cet arrêté entre en vigueur lors de son adoption. Il est par conséquent édicté tel qu'adopté par le conseil municipal de Grand-Sault au Nouveau-Brunswick. Severability Where a court of compétent jurisdiction déclares any section or part of a section of this by-law invalid, the remainder of this by-law shall continue in force unless the court makes an order to the contrary. The adoption of this by-law repeals the following by-laws: By-law no. 56 ofthe Town of Grand Falls and its amendments; By-law 5-2012 of the rural community of Saint-André and its amendments; By-law 61-1 of the municipality of Drummond and its amendments. The repeal ofby-laws listed in section 6, shall not affect any penalty, forfeiture or liability, incurred before such repeal or any proceeding for enforcing the same completed or pending at the time of repeal; nor shall it repeal, defeat, disturb, invalidate or prejudicially affect any matter or thing whatsoever completed, existing or pending at the time ofrepeal. 8. Effective Date This by-law shall come into force on the date of its adoption. Therefore, be it enacted as adopted by the municipal council of Grand Falls, New Brunswick.
