BY-LAW RESPECTING TALL
GRASSES IN GRAND FALLS
En vertu des pouvoirs que lui confère la Loi
sur la gouvemance locale, le conseil
municipal de Grand-Sault dûment réuni,
adopte ce qui suit:

Titre
Pursuant to the powers conferred by the
Local Govemance Act, the Grand Falls
municipal council, duly assembled, enacts as
follows:

motorisé, y compris la réduction de la

et des mes publiques;
d) Herbes hautes S'entend du gazon
et des herbes ou mauvaises herbes
dont la hauteur est supérieure à 0,2
mètre;
e) Propriétaire S'entend notamment
du propriétaire inscrit, de l'occupant,
du locataire, du responsable des lieux
ou des terrains ou de la personne qui,
pour le moment, gère les terrains ou
en perçoit le loyer pour son propre
compte ou pour le compte d'un
mandataire ou d'un fiduciaire d'un
tiers ou l'une des personnes
susmentionnées;
f) Terrain S'entend d'un bien-fonds,
de lieux, de terres et d'une cour
privée.
Genre et nombre
Les règles qui suivent s'appliquent à
l'ensemble des arrêtés :
This by-law may be referred to as the
"Tall Grasses By-law".
2. Définitions
In this By-law:
(a) Council means the Grand Falls
Municipal Council;
(b) Municipality means the
municipality of Grand Falls;
(e) Publie Safety Hazard means,
without limitation, impediments to
pedestrian, cyclist and motorized
travel, including sight restrictions
along public sidewalks and public
streets;
(d) Tall Grasses means any lawns,
grasses and / or weeds which exceed
0.2 mètre in height;
(e) Owner means ajnd includes the
registered owner, occupant, tenant,
person in charge of the premises or
lands, or the person for the time being
managing or receiving the rent from
the lands whether on his own account
or on the account of an agent or
tmstee for any other person or one of
the aforementioned persons;
(f) Lands means any private
property, premises, grounds, and
yards.
3. Gender and number
The following mles apply to all by-
laws:

3(1) La forme masculine utilisée dans
le présent arrêté désigne aussi bien les
femmes, les hommes et les personnes
non-binaires. Le genre masculin est
utilisé sans aucune discrimination
dans le but d'alléger le texte.
3(2) Le pluriel ou le singulier
s'appliquent également à l'unité ou à
la pluralité.
Champs d'application
Cet arrêté s'applique à l'intérieur des
anciennes limites administratives de
la ville de Graad-Sault; de la
municipalité de Drummond et dans le
quartier de Saint-André pour les
propriétés ayant façade sur les mes
suivantes : chemin Saint-André,
chemin Moulin, chemin Grenier, me
Kennebec, me Olympic, me
Godbout, lière, 2e, 3e, 4e et 5e avenues,
me Michaud, route 255 jusqu'à
l'intersection du chemin de l'Eglise,
me Monica, me Jaaick, me de
l'Eglise allant jusqu'à l'intersection
de la me Noé, me Levesque, me
Mazerolle, me Poitras, me Des
Erables, me Des Plaines et me La
Villa.
Cet arrêté n'est pas applicable à
l'intérieur des zones susmentionnées
pour les terrains à vocation agricole.
Entretien de l'herbe
5(1) Les propriétaires de terrains
situés à l'intérieur des limites décrites
à l'article 4 devront s'assurer que
toute partie d'un terram n'étant pas
occupée par une constmction, un
usage, un stationnement, un trottoir,
une allée d'accès ou de circulation, un
espace de chargement ou de
déchargement, un boisé ou une
plantation, doit être nivelée et
recouverte de pelouse ou de plantes
couvre-sol.
5(2) Le propriétaire de tout terrain à
l'intérieur des limites décrites à
F article 4 devra couper le gazon et
contrôler les herbes ou plantes
nocives.
5(3) Le gazon, l'herbe, les plantes
couvre-sol ou les mauvaises herbes
3(1) The masculine form is used in
this by-law to designate women, men
and non-binary people. The
masculine gender is used without any
discrimination to lighten the text.
3(2) The plural or singular also
applies to unity or plurality.
Application fields
This by-law applies within the former
administrative limits of the town of
Grand Falls, of the municipality of
Drummond and in the Saint-André
ward for properties fronting on the
following streets: Saint-André Road,
Moulin Road, Grenier Road,
Kennebec Street, Olympic Street,
Godbout Strcet, lst, 2nd, 3rd, 4th and 5th
Avenues, Michaud Street, Route 255
up to the intersection of De l'Eglise
Road, Monica Street, Janick Street,
De l'Eglise Street going up to the
intersection of Noé Street, Levesque
Street, Mazerolle Street, Poitras
Street, Des Erables Street, Des
Plaines Street and La Villa Street
This by-law is not applicable within
the aforementioned areas for
agricultural land.
Maintenance of grasses
5(1) Any owner of land situated
within limits described in section 4
shall ensure that all parts of a lot not
occupied by a construction, a use, a
parking lot, a sidewalk, an access or
circulation alley, a loading or
unloading space, a woodland or a
plantation must be levelled and
covered with grass or ground-cover
plants.
5(2) The owner of any land located
within limits described in section 4
must eut the grass and control noxious
plants.
5(3) Lawn, grass, ground-cover
plants, or weeds growing on this land

Il est requis d'entretenir la marge

maintenu en bon état en tout temps
par le propriétaire dudit terrain
adjacent à la marge d'emprise.
Inspection et application
8(1) Les personnes régulièrement
nommées agents d'exécution des
arrêtés par le conseil municipal sont
autorisées à réaliser les inspections
nécessaires à l'administration ou à
l'application du présent arrêté.
8(2) Les agents de la paix et les agents
d'exécution des arrêtés sont habiletés
à prendre les mesures et à exercer les
pouvoirs et les fonctions énoncés
dans le présent arrêté et dans la Loi
sur la gouvemance locale qu'ils
estiment nécessaires à l'application
des dispositions du présent arrêté.

5(4) Every lot must be kept clear of
dead or decomposing trees, shmbs or
undergrowth that may cause a public
safety hazard.
Properties must be well maintained
from June l until October 31 each
year.
It is required to maintain the setback
of the public road adjacent to a
building or construction. This space
must be maintained by the owner of
the lot abutting the setback.
Inspection and Enforcement
8(1) Every person duly appointed by
council as a by-law enforcement
officer is hereby authorized to carry
out any inspection that is necessary
for the administration or enforcement
ofthisby-law.
8(2) Any peace officer or by-law
enforcement officer is hereby
authorized to take such actions,
exercise such powers, and perform
such duties, as may be set out in this
by-law or in the Local Govemance
Act and as they may deem necessary
to enforce any provision of this by-
law.
9. Infractions et pénalités
Quiconque contrevient à l'une des

Any person who violâtes any
provision ofthis by-law is guilty ofan
offence and is liable on conviction to
a fine under Part II of the Provincial
Offences Procédure Act, Class D, and
its amendments.

10(2) Toute personne qui contrevient
à une disposition du présent arrêté
peut payer à la Municipalité, dans un
délai de 45 jour civil à compter de la
date de ladite infraction, une pénalité
administrative de 250$ pour la
première infraction, 500 $ pour la
deuxième infraction et de l 000 $
pour la troisième infraction et chaque
infraction subséquente et, une fois
payée, la personne n'est plus
susceptible de poursuites judiciaires.
Divisibilité
with respect to the violation of a
provision of this by-law as set out in
subsection 10(2).
10(2) A person who violâtes any
provision of this by-law may pay to
the Municipality, within 45 calendar
days from the date of such violation,
an administrative penalty in the
amount of $250 for the Ist offence,
$500 for the 2nd offence and $1,000
for the third and each subsequent
offence and, upon such payment, the
person who committed the violation
is not liable to be prosecuted therefor.
11. Severability
Lorsque tout ou partie d'une
disposition du présent arrêté est
déclarée invalide par un tribunal
compétent, le reste du présent arrêté
demeure en vigueur, sauf sur
ordonnance contraire du tribunal.
12. Abrogation
Where a court of compétent
jurisdiction déclares any section or
part of a section of this by-law
invalid, the remainder of this by-law
shall continue in force unless the
court makes an order to the contrary.

L'adoption du présent arrêté abroge
les arrêtés suivants :
Arrêté 40 de la ville de Grand-Sault et
ses modifications.
The adoption of this by-law repeals
the following by-laws:
By-law no. 40 ofthe Town of Grand
Falls and its amendments.
13. L'abrogation des arrêtés indiqués au
paragraphe 12 n'affectera pas une
sanction, confiscation ou obligation
imposée avant l'abrogation ou une
procédure d'exécution complétée ou
en suspens au moment de
Pabrogation, et n'aura pas pour effet
de révoquer, d'annuler, de modifier
ou d'invalider quoi que ce soit qui
serait complété, existant ou en
suspens au moment de Pabrogation,
ni de lui porter préjudice.
14. Date cT entrée en vigueur
13. The repeal ofby-laws listed in section
12, shall not affect any penalty,
forfeiture, or liability, incurred before
such repeal or any proceeding for
enforcing the same completed or
pending at the time of repeal; nor
shall it repeal, defeat, disturb,
invalidate or prejudicially affect any
matter or thing whatsoever
completed, existing or pending at the
time ofrepeal.
14. Effective Date
Cet arrêté enb-e en vigueur lors de
son adoption.
This by-law shall come into force on
the date ofits adoption.

Nouveau-Brunswick.
Therefore, be it enacted as adopted by the
municipal council of Grand Falls, New
Bnmswick.
