THE VILLAGE OF GRAND MANAN BY-LAW NO. 20-99 A BY-LAW OF THE MUNICIPALITY OF THE VILLAGE OF GRAND MANAN RESPECTING THE MUNICIPAL SOLID WASTE TRANSFER STATION. THE COUNCIL OF THE VILLAGE OF GRAND MANAN, UNDER THE AUTHORITY VESTED IN IT BY THE MUNICIPALITIES ACT, ENACTS AS FOLLOWS: TITLE 1. This by-law may be cited as the Municipal Solid Waste Transfer Station By-Law. INTERPRETATION 2. In this by-law, a. "Transfer Station Property" means all of that parcel of property owned by the Village Of Grand Manan on which the Municipal Solid Waste Transfer Station and its access road are located and includes all structures on this property. b. "Transfer Station Area" means that portion of the Transfer Station Property containing the area in which the public and commercial waste collection operations are permitted access for the purpose of waste materials and includes those portions of buildings use in connection with the receipt of waste at the Municipal Solid Waste Transfer Station. c. "Transfer Station Manager" means any person or corporation appointed by the Council to be responsible for the day to day management of the Municipal Solid Waste Transfer Station. d. "Transfer Station Staff" means any person or persons (other than the transfer Station Manager) employed by the Transfer Station Manager or the Village at the Transfer Station Property as an attendant or performing other functions related to the use, maintenance or operation of the Transfer Station while acting in performance of his, her or their duties. e. "Transfer Station Rules" means rules for the public and commercial waste collection operations regarding use of and conduct in the Transfer Station Area including rules relating to the locations at which waste materials may be deposited by the public or commercial waste collection operations and the types and quantities of waste which may be deposited by the public or commercial waste collection operations. PUBLIC ACCESS TO THE TRANSFER STATION 3. 1. Access to the Transfer Station Property is a privilege. Except under the direction of the Transfer Station Staff no one shall have access to the Transfer Station Property except the Transfer Station Area portion. 2. Council may prescribe fees for the use and access by the public and commercial waste collection operations to the Transfer Station Property. 3. Any person who has had his or her Transfer Station Area access privileges suspended by the Transfer Station Manager may appeal the suspension to Council at its next regularly scheduled meeting and Council may substitute such suspension and or attach such conditions to Transfer Station Area access as it deems appropriate. TRANSFER STATION AREA MANAGEMENT 4. 1. The Transfer Station Manager shall be responsible for the maintenance and operation of the Transfer Station Area and shall supervise the work of the Transfer Station Staff. 2. The Village may set hours of operation during which the public may have access to the Transfer Station Area. The Transfer Station Manager shall post the hours of operation at the Transfer Station Area. 3. The Village and also the Transfer Station Manager may make rules for the use by the public and commercial waste collection operations of the Transfer Station Area and the conduct of the public and commercial waste collection operations in the Transfer Station Area. The Transfer Station Manager shall post those rules at the Transfer Station Area. 4. The Transfer Station Manager may suspend the Transfer Station Area access privileges of any person (including commercial waste collection operations) breaching Transfer Station Rules or engaging in inappropriate behaviour in the Transfer Station Area for such period of time that the Transfer Station Manager determines appropriate to a maximum of 90 days. 5. Transfer Station Staff may give directions to persons (including commercial waste collection operations) in the Transfer Station Area and may require person in breach of those directions or the Transfer Station Rules to leave the Transfer Station Area for the remainder of the day. OFFENCES AND PENALTIES 5. A person (including a commercial waste collection operation) commits an offence under this by-law if, a. he is present on the Transfer Station Property outside of the Transfer Station Area other than under the direction of the Transfer Station Staff, or b. He is present in the Transfer Station Area other than during the posted hours of operation, or c. He deposits waste materials in any place on the Transfer Station Property other than in the area designated for receipt of those types of materials. d. He deposits any prohibited types of waste materials on the Transfer Station Property, or e. He uses, interferes with the use of by the Transfer Station Staff or the Transfer Station Manager, or damages any of the equipment, waste or other material, or contents of structures, located on the Transfer Station Property, or f. He remains in or returns to the Transfer Station Area during the remainder of the day on which he has been required to leave the Transfer Station Area by any of the Transfer Station Staff, or g. He is present in the Transfer Station Area during the period of suspension of his Transfer Station Area access privileges, or h. He does not pay the prescribed transfer Station Area access fee for deposit of waste materials. 6. A person convicted of an offence under this by-law is punishable by a fine of not less than $100.00 (one hundred dollars) together with all legal and court costs of proceedings to that date.
