Policy #2022-05 ## Rural Community of Hanwell Fee Schedule ## Policy Objective: To provide a policy regarding the issuance of fines for persons that violate a by-law of the Rural Community of Hanwell, and to define specific fees for services that are performed by members of the Rural Community of Hanwell staff when requested by individuals that reside within the municipality. ## Authorization: Fines under this schedule are set in accordance with the New Brunswick Provincial Offences Procedure Act, SNB 1987, hereby referred to as the Offences Act. Authorization for a local government to enact and enforce by-laws is defined in the Local Governance Act, SNB 2017, S.147-160, hereby referred to as the LGA. ## Fines: Fines issued by an authorized by-law enforcement officer of Regional Service Commission 11 (RSC11) shall follow the schedule as defined in policy by the Commission. Any fines not specified by RSC11 policy shall follow the schedule as defined in section 56 of the Offences Act. Fines that may also be enforced by Hanwell staff or a person authorized by the local government also include: - Dust by-law infraction $100 first offence, $250 second offence, $500 each subsequent offence - Parking by-law infraction $20 first offence, $50 second offence, $100 each subsequent offence Per section 156 of the LGA, the maximum fine for a by-law infraction shall not exceed $1,500 per infraction. <!-- image --> <!-- image --> <!-- image --> Fees for government services: None currently defined.
