## BY-LAW NO. 2024-01
## A BY-LAW RELATING TO ANIMAL CONTROL IN THE TOWN OF HERON BAY
WHEREAS: The enactment of this by-law repeals the following by-law(s).
- BY-LAW NO. 601-18: A By-law regulating the keeping and controlling of animals in the Town of Dalhousie.
- BY-LAW NO. 2002-06: A By-law of the Village of Charlo control of animals.

ATTENDU QUE l'adoption du présent arrêté abroge l'arrêté (s) suivant(s) ;
- ARRÊTÉ No. 601-18 : Arrêté de la ville de Dalhousie régissant la garde et le contrôle des animaux.

"Microchip" means an encoded identification device implanted in an animal by a veterinarian, which contains a unique code number that provides owner information that is stored in a central database. (micropuce)
"Muzzle" means a humane fastening or covering device of adequate strength over the mouth of the animal to prevent it from biting. (muselière)
"Owner" means any person who has an animal in their possession or harbors or permits it to remain about his premises or residence; (propriétaire)
"Running at large" means an animal which is unleashed. (errant)
- a) In a public place including a sidewalk, beaches, trail, and parks.
- b) On property other than that of the owner of the animal.
- c) In a field or wooded area while not in the company and control of the owner of the animal.
## 2. VALIDITY
If any part of this by-law is held to be invalid and struck down, it does not invalidate the remaining provisions of the by-law.
## 3. VACCINATIONS
- a) Every owner of a dog or cat over the age of 3 months must have the animal vaccinated against rabies unless written notification from a certified veterinarian that the vaccine is not recommended at that time.
2. The juvenile rabies vaccination is to be followed by a rabies booster vaccination after 1 year.

## 2. VALITY
Dans le cas où une partie du présent arrêté serait déclarée invalide et annulée, ses autres dispositions demeurent en vigueur.
## 3. VACCINATIONS
- a) Le propriétaire d'un chien ou d'un chat âgé de plus de trois mois est tenu de le faire vacciner contre la rage sauf avis écrit d'un vétérinaire certifié indiquant que le vaccin n'est pas recommandé à ce moment-là.
- i) La vaccination juvénile contre la rage doit être suivie après un an d'une injection de rappel contre la rage.
- b) Every owner of a dog over the age of 3 months must have the animal vaccinated against rabies. This vaccination is required on an annual basis.
- c) Every owner must maintain the vaccinations of his/her animal according to veterinary recommendations, or upon notification due to an epidemic.
- d) An owner who neglects or refuses to have his/her animal vaccinated under section 3 is guilty of an offence and is subject upon conviction to a fine as per schedule A of the current by-law.
- e) Where an animal is suffering from any communicable disease, the owner shall not permit the animal to be in any public place and shall not keep the animal in control with, or in proximity of, any other animal.
- 1) A person who owns an animal that is rabid, suspected to be rabid, or has been exposes to rabies, shall immediately report the matter to the District Medical Health Officer and the Animal Control Officer.
- i) A dog is known to be or suspected of being rabid shall be considered dangerous
7. ii) Despite section 7, a dog control officer shall seize and cause to be destroyed immediately any dog that is known to be or suspected of being rabid
8. iii) A dog control officer who seizes and destroys a dog under subsection (2) shall notify as soon as possible the owner, if the owner is known.
## 4. OWNER'S RESPONSIBILITIES
- a) If a dog defecates on any public or private property other that the property of the owner, the owner shall cause such feces to be removed immediately or shall be guilty of an offence as per schedule A of this by-law.
- b) No owner shall suffer, permit, allow, or for any other reason have his or her animal bark or howl excessively, or in any other manner disturb the quiet of any person.

- i) Un chien dont on sait ou soupçonne qu'il a la rage doit être considéré comme dangereux.
9. ii) Malgré l'article 7, un agent de contrôle doit saisir et faire détruire immédiatement tout chien connu ou soupçonné d'avoir la rage.

## 4. RESPONSABILITÉS DU PROPRIÉTAIRE

- i) Property owners may only trap cats on his/her own property.
6. ii) The animal control officer may lay live traps in any location throughout the town where it is deemed to be a problem area for stray cats.
- g) No owner of a dog shall permit his or her dog to;
- 1) Chase, bite, or attack any person

10. iii) Damage public or private property
## 5. LICENSE
- a) Every owner of a dog shall, before the last day of January in each year, register with the Animal Control Officer of the Town of Heron Bay, each dog which he owns, and pay the license fee as per Schedule A of the current by-law.
- b) A person who becomes an owner of a dog after the last day of January in each year shall register and license such dog immediately and pay the license fee required in Schedule A of the current by-

## 5. PERMIS
- a) Tout propriétaire de chien doit, avant le dernier jour de janvier de chaque année, enregistrer chaque chien qui lui appartient au bureau de l'agent de contrôle des animaux de la Ville de Baie-des-Hérons et acquitter les droits de permis fixés à l'annexe À du présent arrêté.
- b) La personne qui devient propriétaire d'un chien après le dernier jour de janvier chaque année fait immédiatement enregistrer et

- e) The owner shall renew the license annually with the Animal Control Officer of the municipality.
- f) No person shall remove a collar or license tag from any dog which they do not own or care for.
- g) Any person who produces evidence satisfactory to the Animal Control Officer showing that the dog is required as a guide or for assistance by a disabled person shall be exempt from paying the license fee.
- h) The Animal Control Officer shall keep a record of all dogs registered and licensed, showing the date and number or registration and license and the name and description of the dog, with the name and address of the owner.
- 1) Notwithstanding the foregoing, when any person has a dog wearing valid and current tags issued by another municipality, that person is not required to register the dog in the municipality of Heron Bay until the following calendar year of the expiration of the tags, whichever comes first.
## 6. DANGEROUS DOGS
- a) Where an Animal Control Officer believes that a dog has bitten or attempted to bite a person, the Animal Control Officer may initiate a complaint to a judge of the Provincial Court.
- b) A judge of the Provincial Court before whom a complaint has been laid alleging

- f) Nul ne peut enlever le collier ou la plaque d'immatriculation d'un chien qui ne lui appartient pas ou dont il en prend soin.
- g) Toute personne qui produit une preuve satisfaisante pour le responsable du contrôle des animaux démontrant que le chien est nécessaire comme guide ou pour l'assistance d'une personne handicapée est exonéré du paiement des frais de permis.
- h) L'agent de contrôle des animaux tient à propos de tous les chiens enregistrés et immatriculés un registre indiquant les dates et numéros d'enregistrement et d'immatriculation des chiens, leurs noms et descriptions ainsi que les noms et adresses des propriétaires.

- a) The Animal Control Officer may seize and impound:
- 1) every cat or dog running at large

- f) Where in the opinion of the Animal Control Officer, an animal seized and impounded is injured or ill and should be destroyed without delay for humane reasons or for reasons of safety to persons, the animal may be euthanized humanely if reasonable efforts to locate the owner of the animal have failed and after thorough evaluation from the veterinarian.
- g) The owner of any impounded animal may claim and take it back after meeting all the following requirements.

The council of the Town of Heron Bay hereby appoint the SPA Restigouche SPCA as the agent to administer animal control in accordance with its by- l'administration du contrôle des laws.
The SPA Restigouche SPCA and its employees are hereby appointed as municipal enforcement officers of this by-law and the said officers may exercise the powers of a By-law officer for the purpose of enforcing the animal control and related fees and fines as per this by-law and Schedule A.
The Town of Heron Bay hereby grants to the SPA Restigouche SPCA the right to collect and retain all fines and fees related to animal control.
## 9. PENALTIES

- b) A Provincial Court Judge, in addition to the penalties provided in this by-law, may, if he/she considers the offence sufficiently serious, direct or order the owner of an animal to prevent such animal from doing mischief or causing the disturbance or nuisance complained of, or have the animal removed from the city, or order the animal destroyed
- c) Any person or persons, corporation, partnership, or society who violates any of the provision of this by-law is guilty of an offence and is liable upon summary conviction to a fine of not less than $ 50 and not more than $ 2,000.
