## BY-LAW NO. 2024-02 ## A BY-LAW PREVENTING NUISANCE AND EXCESSIVE NOISE IN THE TOWN OF HERON BAY WHEREAS: The enactment of this by-law repeals the following by-law(s). - BY-LAW NO. 403-20: A By-law to prevent nuisance and noise in the Town of Dalhousie. - BY-LAW NO. 2021-09: A By-law relating to the prevention of excessive noise and nuisance in the village of Charlo. ## ARRÊTÉ N° 2024-02 ## ARRÊTÉ CONCERNANT LA NUISANCE ET LES BRUITS EXCESSIFS DANS LA VILLE DE BAIE-DES-HÉRONS ATTENDU QUE l'adoption du présent arrêté abroge l'arrêté(s) suivant(s) ; - ARRÊTÉ No. 403-20 : Arrêté de la ville de Dalhousie visant à prévenir les nuisances et les bruits excessifs. - ARRÊTÉ No. 2021-09 : Arrêté concernant la prévention des bruits excessifs et la nuisance dans le village de Charlo. BE IT ENACTED by the Council of the Town of IL EST DÉCRÉTÉ que lui confère la Loi sur la Heron Bay under the authority vested in it by the gouvernance locale, L.N.-B. 2017, ch. 18, le conseil Local Governance Act, S.N.B., 2017, c. 18, as municipal de la ville Baie-des-Hérons, édicte ce qui follows: suit: ## 1.OFFENCE - a) No person may make noise likely to cause a public nuisance or otherwise disturb the inhabitants of the Town of Heron Bay between the hours of 11:00 p.m. and 7:00 a.m. ## 2.EXEMPTIONS ## 1.OFFENCE - a) Nul de doit émettre un bruit susceptible de causer une nuisance publique ou de troubler autrement la paix des résidents de la ville de Baie-des-Hérons entre 23 h et 7h. ## 2.EXEMPTIONS - a) The provisions of this by-law shall not apply to: a) Les dispositions du présent arrêté ne s'appliquent pas : 2. (i) agents, contractors, servants or employees of the Town of Heron Bay in the course of their duties; 3. (i) construction work of an emergency nature; 4. (iv) snow removal equipment; 5. (iii) emergency vehicles; 6. (v) public transit vehicles; 7. (vi) church bells for religious services; 8. (vii) alarms sounding not more than twenty minutes; 9. (viii) trucks operating on a designated truck route. 10. (ix) festivals, events and activities organized by, on behalf or in partnership with the Municipality. ## 3.REGULATIONS - a. No person shall shout, or yell, or blow horns, or encourage fighting or quarrelling, or make any unnecessary or unusual noise or disturbance, of - i) aux mandataires, aux entrepreneurs, aux commettants ni aux employés de la ville de Baiedes-Hérons dans l'exercice de leurs fonctions; 3. iii) aux véhicules d'urgence; 4. ii) aux travaux de construction urgents; 5. iv) à l'équipement d'enlèvement de la neige; 6. vi) aux cloches d'église pour les services religieux; - v) aux véhicules de transport public; 8. vii) aux alarmes qui retentissent moins de 20 minutes; 9. viii) aux camions qui suivent un itinéraire désigné. 10. ix) les festivals, les événements et les activités organisés par, au nom ou en partenariat avec 1 nunicipalite ## 3.RÈGLEMENTS - a. Il est interdit de crier, de hurler ou de donner des coups de klaxon, d'encourager bagarres ou querelles, de faire des bruits inutiles ou inhabituels, de faire du sing boisterous or indecent songs, or provoke any other person to commit any such breach of the peace at any time, in any place other than in a building or public assembly within the Town of Heron Bay. - b. No person shall loaf of loiter on or along any Street, sidewalk, lane or thoroughfare, or about or around, the entrance, steps or corridors of any church, hall, public building or place of public entertainment, recreation or resort, within the municipality limits, nor run, nor race, in a reckless manner on any street or sidewalk or in any way obstruct public travel thereon; nor shall any number of persons remain in groups or crowds on any street or sidewalk, or other public grounds within the Town after having been requested or ordered by the Town, or any Police Officer or other Peace Officer to disperse or move along. ## 4.ENFORCEMENT & PENALTIES - a. Any peace officer or by-law enforcement officer is hereby authorized to take such action or issue such tickets as they may deem to be necessary to enforce any provisions of this bylaw. - b. Any person who violates any other provision of this by-law is guilty of an offence, and liable on conviction of a minimum fine of $100.00, maximum fine of $1,070.00. ## INTO EFFECT This by-law comes into effect on the date of final passing thereof. Tout agent de la paix ou agent d'application des arrêtés est habilité à prendre les moyens ou à donner les contraventions qu'il estime nécessaires à l'application des dispositions du présent arrêté. - b. Quiconque enfreint toute autre disposition du présent arrêté commet une infraction et est passible, sur déclaration de culpabilité, d'une amende allant de 100 $ à 1,070 $. ## ENTRÉE EN VIGUEUR Le présent arrêté entre en vigueur le jour de son adoption définitive.
