## BY-LAW A-08 ## A BY-LAW RESPECTING THE PROVISION OF DOG CONTROL SERVICES IN MAPLE HILLS RURAL COMMUNITY The Council of Maple Hills, under the authority vested in it through the Local Governance Act and Amendments thereto, hereby makes and enacts this by-law as follows: ## 1) TITLE This by-law may be cited as the "Dog Control Services By-law" of Maple Hills Rural Community. ## 2) DEFINITIONS In this By-law, unless otherwise indicated, the following definitions are required: - "Act" means the Local Governance Act, S.N.B 2017, Chapter 18. - "Community" means the Maple Hills Rural Community. - "Council" designates the mayor and the councillors of the Maple Hills Rural Community. "Dog at large" means an unleashed dog: - a) In a public place, - c) In a forest or wooded area while not in the company or under the supervision of the owner. ## ARRÊTÉ NO. Le - b) On private property other than the owner's, or without any discrimination and to lighten the text. genre masculin est utilisé sans aucune discrimination et dans le but d'alléger le texte. ## 3) RESPONSIBILITY It is the Community's responsibility pursuant to the Local Governance Act ("the Act") to make a by-law imposing a requirement that dogs be vaccinated against rabies and prescribing: - a) a schedule for the vaccinations, - b) a schedule for the assessment of the effectiveness of a previous vaccination, or - d) prescribing requirements for the proof of vaccination of dogs or requirements for the assessment of the effectiveness of a previous vaccination. - c) a combination of the schedules set out in subparagraphs (a) and (b); and ## 4) DOG CONTROL OFFICERS The Community shall appoint dog control officers for the purpose of this By-law. ## 5) REGISTRATION OF DOGS - 5.1 No person shall be the owner of a dog that is not registered in accordance with subsection (2) or (5). - 5.2 A person who becomes the owner of a dog shall register the dog with the society or a dog control officer within 30 days by completing the form provided by the society and paying a fee referred to in subsection (3). - 5.3 An owner shall pay to the society or a dog control officer one of the following fees: - a) If registration is for one year period, $ 15; - c) If registration is for a three-year period, $35. - b) If registration is for a two-year period, $25; or - 5.4 A registration shall expire at the end of the period referred to in paragraph (3). - 5.5 An owner shall renew a registration of a dog efore the registration expires, and th rovisions of this section apply with th necessary modifications to the renewal. ## 6) PROOF OF REGISTRATION - 6.1 On registration or renewal of a registration of ## 3) RESPONSABILITÉ Il incombe à la Communauté, en vertu de la Loi sur la gouvernance locale (« la Loi »), d'établir un règlement imposant l'exigence que les chiens soient vaccinés contre la rage et prescrivant : - a) un calendrier pour les vaccinations, - b) un calendrier pour l'évaluation de l'efficacité d'une vaccination précédente, ou - c) une combinaison des calendriers énoncés aux sous-paragraphes (a) et (b) ; et - d) prescrire les exigences concernant la preuve de vaccination des chiens ou les exigences concernant l'évaluation de l'efficacité d'une vaccination précédente. ## 4) AGENTS DE CONTRÔLE DES CHIENS La Communauté désignera des agents de contrôle des chiens aux fins de ce règlement. ## 5) IMMATRICULATION DE CHIENS - 5.1 Il est interdit d'être propriétaire d'un chien qui n'est pas immatriculé en conformité avec le paragraphe (2) ou (5). - 5.2 Quiconque devient propriétaire d'un chien le fait immatriculer auprès de la Société ou d'un agent de contrôle des chiens dans les trente jours qui suivent, en remplissant la formule qu'établit la Société et en payant les droits prévus au paragraphe (3). - 5.3 Le propriétaire paie à la Société ou à l'agent de contrôle des chiens l'un des droits d'immatriculation suivants : - a) s'agissant d'une immatriculation pour un an, - c) s'agissant d'une immatriculation pour trois ans, 35 $. - 1) s'agissant d'une immatriculation pour deux ans, 25 $; - 5.4 L'immatriculation expire à la fin de la période visée à l'alinéa (3)a), b) ou c), selon le cas. - 5.5 Le propriétaire renouvelle l'immatriculation de son chien au plus tard à sa date d'expiration, les dispositions du présent article s'appliquant avec les adaptations nécessaires. ## 6) PREUVE D'IMMATRICULATION - 6.1 À l'immatriculation ou au renouvellement de · a dog, the society or the dog control officer shall issue to the owner a certificate or receipt of registration and a tag showing the number under which the dog is registered. - 6.2 On receiving a registration tag, an owner shall attach and keep attached the tag to the collar of the dog. - 6.3 On application by the owner and on payment of a fee of $5, a registration tag which is lost may be replaced by the society or a dog control officer. ## 7) WEARING A COLLAR An owner of a dog shall ensure that the dog wears a collar at all times, other than when the dog is in an enclosed such as a kennel or the owner's residence. ## 8) VACCINATED AGAINST RABIES An owner of a dog that has not been vaccinated against rabies shall cause the dog to be vaccinated against rabies within ten (10) days after: - b) the dog has reached the age of three (3) months. - a) acquiring the dog if the dog is three (3) months of age or more, or ## 9) SEIZURE OF DOG AT LARGE - 9.1 A dog control officer shall seize an impound any dog at large and: - a) if the owner is known, notify the owner that the dog is seized and impounded, or - b) if the owner is not known or the owner is known but cannot be located, give public notice, including by or through the website of the society or by any other public information media, that the dog is seized and impounded. - 9.2 A notice under paragraph (1) a) or b) shal! state that the dog has been impounded and may be sold, placed for adoption or destroyed seventy-two (72) hours from the time giving the notice, unless the owner, or anyone on the owner's behalf, claims the dog and pays the costs set out in subsection (3). - 9.3 Before releasing a dog that has been seized, or after destroying a dog in accordance with this By-law, as the case may be, a dog l'immatriculation d'un chien, la Société ou l'agent de contrôle des chiens délivre au propriétaire un certificat ou un reçu faisant foi de l'immatriculation ainsi qu'une médaille sur laquelle figure le numéro d'immatriculation. - 6.2 Le propriétaire attache la médaille d'immatriculation au collier de son chien dès qu'il la reçoit et veille à ce qu'elle y reste attachée. - 6.3 La Société ou l'agent de contrôle des chiens peut, à la demande du propriétaire, remplacer une médaille d'immatriculation perdue moyennant paiement d'un droit de 5 $. ## 7) PORT DU COLLIER Le propriétaire veille à ce que son chien porte un collier en tout temps, sauf lorsque celui-ci se trouve dans un enclos tel un chenil ou à l'intérieur de sa résidence. ## 8) VACCINS CONTRE LA RAGE Le/la propriétaire vielle vacciner son chien contre la rage, s'il n'a pas déjà été ainsi vacciné, dans les dix (10) jour qui suivant : - a) Soit la date de son acquisition, s'il est âge de trois (3) mois ou plus; - b) Soit la date à laquelle il atteint l'âge de trois (3) mois. ## 9) SAISIE DE CHIENS ERRANTS - 9.1 L'agent de contrôle des chiens saisit et en fourrière tout chien errant et : - a) si l'identité du propriétaire est connue, il l'en avise; - b) si l'identité du propriétaire n'est pas connue ou si son identité est connue mais que celui-ci ne peut être retrouvé, il en donne un avis public à l'aide des médias, notamment par affichage sur le site Web de la Société. - 9.2 L'avis prévu à l'alinéa (1) a) ou b) indique que le chien en question a été mis en fourrière, que le propriétaire ou toute personne agissant pour son compte dispose de soixante-douze (72) heures à partir du moment où l'avis a été donné pour le réclamer et payer la somme fixée au paragraphe (3) et qu'à la fin de cette période, le chien pourra être vendu, placé en adoption ou abattu. - 9.3 Avant de libérer le chien saisi, ou après l'avoir abattu conformément au présent règlement, le cas échéant, l'agent de contrôle des chiens control officer shall collect from the owner a sum of $15 for each day or part of a day during which the dog has been impounded and maintained. - 9.4 lf an owner, or anyone on behalf of the owner, does not claim within seventy-two (72) hours from the time giving the notice under paragraph (1) a. or b. or does not pay the costs set out in subsection (3), a dog control officer may sell, place for adoption or destroy the dog. - 9.5 When a dog control officer sells a dog or places a dog for adoption, the dog control officer shall collect from the person who purchases or adopts the dog, at the time of the sale or adoption, the total of all costs of seizing, impounding and maintaining the dog. ## 10) DOG KNOWN TO BE SUSPECTED OF BEING RABID - 10.1 A dog that is known to be or suspected of being rabid shall be considered dangerous. - 10.2 Despite section 9, a dog control officer shall seize and cause to be destroyed immediately any dog that is known to be suspected of being rabid. - 10.3 A dog control officer who seizes and destroys a dog under subsection (2) shall notify as soon as possible the owner, if the owner is known. ## 11) DOG ALLEGED TO HAVE BITTEN - 11.1 A dog control officer may seize a dog that is alleged to have bitten or to have attempted to bite a person and impound the dog until the proceedings under subsection (2) are resolved, but if the proceedings are not brought thirty (30) days after seizing the dog, the dog control officer shall return the dog to the owner. - 11.2 A judge of the Provincial Court before whom a complaint has been laid alleging that a dog has bitten or attempted to bite a person may summon the owner to appear and show cause why the dog should not be destroyed and may, if from the evidence produced it appears that the dog has bitten a person, make an order directing: - (a) that the dog be destroyed, or - (b) that the owner of the dog keeps the dog under control. - 11.3 A person to whom an order is directed shall comply with the order within the time, if any, specified in the order. perçoit auprès du propriétaire la somme de 15 $ pour chaque journée ou partie de journée où le chien a été gardé en fourrière et entretenu. - 9.4 Si le propriétaire ou la personne agissant pour son compte ne réclame pas le chien saisi dans les soixante-douze (72) heures qui suivent le moment où l'avis prévu à l'alinéa (1)a) ou b) a été donné ni ne paie la somme fixée au paragraphe (3), l'agent de contrôle des chiens peut le vendre, le placer en adoption ou l'abattre. - 9.5 Au moment de vendre un chien ou de le placer en adoption, l'agent de contrôle des chiens recouvre auprès de la personne qui l'achète ou l'adopte la somme correspondant aux frais de sa saisie, de sa mise en fourrière et de son entretien. ## 10) CHIEN ATTIENT DE LA RAGE - 10.1 Tout chien que l'on sait ou soupçonne être atteint de la rage est considéré comme étant un animal dangereux. - 10.3 L'agent de contrôle des chiens qui saisit et fait abattre un chien en application du paragraphe (2) en avise son propriétaire dès que possible, si - 10.2 Par dérogation à l'article 9, l'agent de contrôle des chiens saisit et fait abattre sur-le-champ tout chien qu'il sait ou soupçonne être atteint de la rage. - l'identité de ce dernier est connue. ## 11) MORSURE ALLÉGUÉE DE CHIEN - 11.1 L'agent de contrôle des chiens peut saisir un chien qui aurait mordu ou tenté de mordre quelqu'un et le mettre en fourrière jusqu'à ce que soit réglée l'instance visée au paragraphe (2), mais il est tenu de le remettre au propriétaire si l'instance n'est pas intentée dans les trente jours de la saisie. - 11.2 Le juge à la Cour provinciale qui est saisi d'une plainte portant gu'un chien aurait mordu ou tenté de mordre quelqu'un peut sommer son propriétaire de comparaître et de faire valoir les raisons pour lesquelles le chien ne devrait pas être abattu et, s'il apparaît selon la preuve déposée qu'il l'a effectivement mordu, ordonner : - a) qu'il soit abattu; - b) que son propriétaire veille à le maîtriser. - 11.3 Quiconque fait l'objet d'un ordre s'y conforme dans le délai qui y est imparti, le cas échéant. ## 12) TRANQUILIZING DEVICES AND MANNER OF 12) FUSILS TRANQUILLISANTS ET MÉTHODES DESTROYING DOGS UTILISÉES POUR ABATTRE UN CHIEN - 12.1 In the course of carrying out their duties under the By-law, a dog control officer is authorized to make use of tranquilizer guns and other tranquilizing devices on dogs. - 12.2 When destroying a dog under this Regulation, a dog control officer shall do so in a humane manner in accordance with the standards specific in Schedule B of the New Brunswick Regulation 2000-4 under the Society for the Prevention of Cruelty to Animals Act. ## 13) PROHIBITIONS ## 13.1 An owner shall not: - a)Allow their dog at large, - b)Allow their dog to chase or run after pedestrians or motor vehicles, or - c) Allow their dog to bark incessantly to the extent that annoyance is caused to the public. ## 13.2 No person shall - a) Interfere or attempt to interfere with a dog control office while the officer is seizing or impounding a dog in accordance with the Act or this By-law, or - b) Not being the owner, remove a collar or registration tag from a dog. Le présent arrêté entre en vigueur le 1er janvier 2025.
