VILLAGE OF MCADAM BY-LAW NO. 42 A BY-LAW PROHIBITING THE MAKING OF CERTAIN NOISES PASSED: AUGUST 3, 1978 WHEREAS, by paragraph 11 (1) (1) of the Municipalities Act, C. M-22, of the Revised Statutes of New Brunswick, 1973, as amended, a municipality is authorized to make by-laws regulating or prohibiting within the municipality the making of noise likely to cause a public nuisance or otherwise disturb inhabitants; AND WHEREAS, it is deemed expedient by the council of the Village of McAdam for the peace, order and good government of the Village of McAdam and for promoting the health, safety and welfare of the inhabitants of the Village of McAdam, that this by- law be enacted. THEREFORE BE IT ENACTED, by the Council of the Village of McAdam as a by-law thereof as follows: Short Title 1. This By-Law may be cited and referred to as the "Anti-Noise By-Law". Definitions 2. In this By-Law "firearm" means firearm as defined in the Game Act, C. G-1 of the revised Statutes of New Brunswick, 1973, as amended. Prohibition 3. No person shall, within the Village, through the discharge of a firearm or other means, make a noise causing or likely to cause a public nuisance or disturbing or likely to disturb inhabitants of the village. Offences and Penalties 4. Every person who violates any provision of the By-Law is guilty of an offence and liable on summary conviction to a fine of not less then Twenty-five Dollars ($25.00) and not more then Two Hundred Dollars ($200.00) This By-Law passed and enacted on the 3rd day of August A.D. 1978 IN WITNESS WHEREOF the Village of McAdam has caused the corporate seal of the said Village to be affixed this By-Law on the 3rd day of August A.D., 1978 and signed by: Original signed by: Frank M.
