DEFINITIONS
1(a) "All-terrain vehicle" shall mean an a//-
terrain Vehicle as defined in the Off'Road
Vehicle Ad, R.S.N.B. ch.0-1.5 and
amendments thereto.
1(b) Off-Road vehicle" shall mean an Off-
Road Vehicle as defined in the Off-Road
Vehicle Act, R.S.N.B. ch.0-1.5 and
amendments thereto.
1(c) "Street" shall mean the entire width
between the boundary lines of every legally
designated street owned, or under the care
and control of the City of Miramichi.

GENERAL PROVISIONS
2. All persons operating an Off-Road Vehicles
must operate such in accordance with the
Off-Road Vehicle Act and any amendments
thereto

3. No person shall drive an all-terrain vehicle
on streets withln the City of Miramichi, with
the exception of the following locations:

Manse Street as shown in Schedule "A-2"
c) crossing Wellington Street, 90 m west of
LeBreton Drive, as shown on Schedule "A-

Howard Mclean Street, as shown on
Schedule "A-4"
e) crossing Wellington Street, 25 m east of
St. Andrews Street, as shown on Schedule
"A-5"
f) crossing Walsh Avenue, at the intersection
of the old Napan Road as shown on

g) crossing NB Highway No. 11, at the
intersection of Cripps Road as shown on
Schedule "A-7"
h) crossing the Sutton Road at the

with Ray Barrieau Lane as shown on

j) On Water Street, beginning 190 meters

4. Use of Clty streets by All-terrain vehicles
as set out in Section 3 above shall be limited
to the distances and locations set out in
Schedule "A".

5. Use of City streets by All-terrain vehicles
as set out in Section 3 above shall be subject
to the following condltions:
a) the driver or any occupant of the All-
terrain Vehicle must be properly wearing
a helmet that complies with the standards
prescribed by Regulations under the
Motor Vehicle Ad.
b) the All-terrain Vehicle must be outfitted
with the necessary equipment as
described in the Off-Road Vehicle Ad.
c) Except when crossing the street, All-
terrain Vehicles must operate in the same
direction as traffic and travel in a single
file to the extreme right of the street at a
maximum speed of 30 km per hour.
d) All-terraln Vehicles shall cross streets at
right angles to the roadway, on a line
which provides the shotest route from
shoulder to shoulder.
e) The operators of All-terrain Vehicles shall
give the appropriate signals as required
under the Motor Vehicle Act and obey all
traffic control devices.
f) Any other vehicle utilizing the street shall
have the right-of-way.
g) All-terrain vehicles must display a current
trail permit issued by an AW Club
federated in New Brunswick or in another
province member of a reciprocal
agreement with New Brunswick. This
permit must be in the form of a sticker
which must be clearly and permanently
displayed on the ATV or on the side-by-
side.
h) All-terrain vehicles must display a current
license plate issued by a Provincial
government body and the operator must
immediately provide proof of current
registration upon request by any city
employee or agent authorized to enforce
this By-law.
i) All-terrain vehicles must be insured and
the operator must lmmediately provide
proof of insurance upon request by any
city employee or agent authorized to
enforce this 8y-law.
5. L'utilisation des rues de la Ville par les

c) Sauf lorsqu'ils traversent la rue, les
v6hicules tout-terrain doivent circuler
dans le m6me sens que la circulation et
dolvent se d6placer en file unique, d
l'extreme droite de la rue i une vitesse
maximale de 30 km i lheure;
d) Les vdhicules tout-terrain doivent
traverser les rues i angle droit par
rapport i la chauss6e, en suivant le
trajet le plus court d'un accotement i
l'a utre;
e) Les conducteurs de vdhicules tout-terrain
doivent 6mettre les signaux approprl6s,
comme requis par la Loi sur les vdhicules
e moaur, et respecter tous les dispositifs
de rdgulation de la circulation;
0 Tout autre vdhicule circulant sur la route
est prioritaire;
g) Les vdhicules tout-terrain doivent
afficher un permis de sentier valide
d6livr6 par un club de Vfi affili6 dans la
province du Nouveau-Brunswick ou dans
une autre province membre d'une
entente de r6ciprocit6 avec le Nouveau-
Brunswick. Ce permis doit revetir la
forme d'un autocollant qui doit 6tre plac6
de manidre permanente et clairement
visible sur le Vfi ou sur le v6hicule c6te
i c6te;
h) Les vdhicules tout-terrain doivent avoir
une plaque d'immatriculatlon en cours de
validit6 d6livr6e par un organisme
gouvernemental provinclal et le
conducteur doit imm6diatement fournir
une preuve d'immatriculation valide i la
demande de tout employ6 ou agent
municipal autoris6 i faire appliquer le
pr6sent arr6t6;

OFFENCE
INFRACTION
6.(1) Any person who violates sections 2, 3, 4
or 5 of this by-law is guilty of an offence.

6.(2) The minimum fine for an offence
committed under this by-law is $100 and the
maximum fine for an offence commltted
under this by-law is $2,100.

6.(3) If an offence committed under this by-
law continues for more than one day:
(a) the minimum fine that may be imposed is
the minimum flne established in this by-
law multiplied by the number of days
during which the offence continues; and,
(b) the maximum fine that may be imposed is
the maximum fine established in this by-
law multiplied by the number of days
during which the offence continues.
6.(3) Si une infraction commise en vertu du

7.(1) The City may issue an administrative
notice requiring a penalty to be paid with
respect to a violation of a provision of this
by-law.

7.(2) A person who violates any provision of
this By-law, and who is issued an
administrative notice, may pay to the City,
within 45 calendar days from the date of
such violation, an administrative penalty of
one hundred dollars ($100.00) and upon such
payment, the person who committed the
violation is not liable to be prosecuted
therefore.

ENFORCEMENT
APPLICATION
8.(1) Every person duly appointed by Council
as by-law enforcement officer is hereby
authorized to carry out any inspection that is
necessary for the administration or
enforcement of this by-law.
8.(2) Any peace officer or by-law
enforcement officer is hereby authorized to
take such actions, exercise such powers and
peform such duties, as may be set out in
this by-law, or in the Local Governance Act
and as they may deem to be necessary
to enforce any provisions of this by-law.

10. Upon enactment of this by-law, By-Law
No. 122, and any other by-laws regarding All-
Terrain Vehicles in the City of Miramichi are
hereby repealed.
