A BY.LAW RESPECTING THE
PREVENTION OF EXCESSIVE NOISE
WITHIN THE CITY OF MIRAMICHI
ARRETE CONCERNANT LA PREVENTION
DU BRUIT EXCESSIF
DANS LA VILLE DE MIRAMICHI
WHEREAS pursuant to Section 10 of the
Local Governance Ad, Council may pass
by-laws for municipal purposes respecting
nuisances, including noise, pollution and
waste in or on public or private property.
BE IT ENACTED by the City Council of the
City of Miramichi, subject to the provisions of
the Local Governance Act, under Section 15:

DEFINITIONS
"City" means the City of Miramichi. (Vi/le)
"Council" means the Mayor and Councillors of
the City of Miramichi, (Conseill
"Dwelling" means:
i) the whole or any paft of a building or
structure that is kept or occupied as a
permanent or temporary residence and
includes an apaftment, and a motel or
hotel room;
ii) a unit designed to be mobile and to be
used as a permanent or temporary
residence and that is being used as
such a residence. (logementl
"Motor vehicle" means every vehicle that is
self-propelled and includes a motorcycle and
snowmobile. (vdhicule d moteull
"Public address system" means any system of
loud speakers, amplifiers, microphones, or
reproducers, or any combination of any such
equipment, used in the reproduction or
amplification of music, speech, or other
sounds, when used for communication to, or
othenruise addressing or enteftaining a

GENERAL
1. No person shall within the City during the
times set forth herein emit, or cause, or
permit the emission of a sound or sounds
resulting from an act hereinafter listed
which is likely to cause a nuisance or

tranquility of the inhabitants of the City:
a) the unnecessary idling or rewing of a
motor vehicle engine, at any time;
b) the blowing of a motor vehicle horn at
any time, except when required or
authorized by law or in accordance
with good safety practices;
c) the operation of any combustion
engine or pneumatic device without an
effective exhaust or intake muffling
device in good working order and in
constant operation, at any time;
d) the operation of any item of
construction equipment without an
effective muffling device in good
working order and in constant
operation, at any time;
e) the operation of domestic outdoor
power tools, with the exception of
domestic snowblowers or
snowthrowers, between the hours of
10:00 otlock in the evening and 6:00
in forenoon of the next following day;
f) the operation of construction or tree
harvesting equipment, including chains
saws, between the hours of 10:00
otlock in the evening and 6:00 otlock
in the forenoon of the next following
daY;
g) the operation of a public address
system for the purpose of adveftising
or for gain or othenarise within six
hundred feet of any public hospital at
any time or during school hours within
three hundred feet of any school;
h) the operation of any public address
system, gramophone, radio, or other
device or apparatus for reproducing or
amplifying sound at any time, unless
authorized in writing by the Chief of
Police;
i) the carrying out of any works in
connection with the construction,
reconstruction, alteration or repairing
of any building or structure; of any
evacuation; or excavation works with
any mechanical device, without
permission in writing from the City
Engineer between the hours of 10:00
otlock in the evening and 6:00 otlock
in the forenoon of the next following
day;
j) the operation or permitting the
operation of legal racing competitions
between motor vehicles anywhere
within the City after the hour of 11:00
otlock in the evening.
2. Except as othenruise herein provided, no
person shall allow propety belonging to
him/her or under his/her control to be
used in contravention of this by-law.

domestiques ext6rieurs, i l'exception des
souffleuses i neige ou des souffleuses A
neige domestiques, entre 22 h et 7 h;
f) le fonctionnement du mat6riel de
construction ou d'abattage des arbres, y
compris les trongonneuses, entre 22 h et
7h;
g) l'exploitation d'un systdme de
sonorisation i des fins publicitaires ou i
des fins lucratives ou autrement i moins
de six cents pieds d'un h6pital public, en
tout temps ou pendant les heures de
classe, i moins de trois cents pieds d'une
6cole;
h) le fonctionnement de tout systdme de
sonorisation, gramophone, radio ou
autre dispositif ou appareil pour
reproduire ou amplifier le son en tout
temps, sauf autorisation 6crite du chef
de police;
i) l'ex6cution de tout travail li6 i la
construction, i la reconstruction, i la
modification ou i la r6paration d'un
bAtiment ou d'une structure; de toute
6vacuation; ou des travaux d'excavation
avec tout dispositif m6canique, sans
l'autorisation 6crite de l'ing6nieur
municipal entre 22 h et 7 h;
j) l'exploitationoul'autorisationd'organiser
des comp6titions de course l6gales entre
v6hicules automobiles n1mpofte oir dans
la ville aprds 23 h.
2. Sauf disposition contraire des pr6sentes,
nul ne peut permettre que des biens lui
appaftenant ou sous son contr6le soient
utilis6s en violation du pr6sent arr6t6.
3. The provisions of this by-law shall not
apply to:
a) agents, servants or employees of the
City, who are engaged in the reasonable
execution of their duties in doing work
which may be described as being of an
essential or emergency nature and
carried out at the request of the City;
b) noises in connection with authorized
athletic and recreational activities on
municipal propefi;
c) noises in relation to traditional, festive,
and religious activities (including church
bells);
d) noises in relation to parades, street
dances, and other community activities
authorized by the Chief of Police;
e) noises caused by motor vehicles or
equipment being used for emergency
purposes;
f) alarms sounding less than 20 minutes.
g) snow plowing or snow blowing done
during, or reasonably after snowfalls.
3. Les dispositions du pr6sent arr6t6 ne

OFFENCES
INFRACTIONS
4. Any person who violates any provision of
this by-law is guilty of an offence and is liable
on conviction to a fine.

5. The minimum fine for an offence
committed under this by-law is $140 and the
maximum fine for an offence committed
under this by-law is $2,100.

6. If an offence committed under this by-law
continues for more than one day:
a) the minimum fine that may be
imposed is the minimum fine
established in this by-law

during which the offence
continues; and,
b) the maximum fine that may be
imposed is the maximum fine
established in this by-law
multiplied by the number of days
during which the offence
continues.

7. The City may issue an administrative
notice requiring a penalty to be paid with
respect to a violation of a provision of this
by-Law.

MAYOR/MAIRE
8. A person who violates any provision of this
by-law, and who is issued an administrative
notice, may pay to the City, within 45
calendar days from the date of such violation,
an administrative penalty of one hundred and
fifty dollars ($150.00) and upon such
payment, the person who committed the
violation is not liable to be prosecuted
therefore.

9. Every person duly appointed by Council as
by-law enforcement officer is hereby
authorized to carry out any inspection that is
necessary for the administration or
enforcement of this by-law.

10. Any peace officer or by-law enforcement
officer is hereby authorized to take such
actions, exercise such powers and peform
such duties, as may be set out in this by-law
or in the Local Governance Actand as they
may deem to be necessary
to enforce any provisions of this by-law.

SEVERABILITY
DIVISIBILITE
11. Where a Couft of competent jurisdiction
declares any section or paft of a section of
this by-law invalid, the remainder of this
bylaw shall continue in force unless the Court
makes an order to the contrary.

d6clar6e invalide par un tribunal comp6tent,
le reste du pr6sent arr6t6 demeure en

12. This By-law shall come into effect on
January L6,2023.
