<!-- image --> ## By-law #24-02: ATVs on Municipal Roads Under the powers granted by the Off-Road Vehicle Act, S.N.B. 1985, c.-0-1.5 and its amendments, the Council of Nashwaak duly assembled enacts as follows: ## Definitions: 1. "Off-road vehicle" means all vehicles included in the definition of "Off-road vehicle" as defined in the aforementioned Off-Road Vehicle Act, in this by-law, as an All-Terrain vehicle, a side by side or a mule, except for amphibian vehicles. ## General Conditions : 1. Off-road vehicle members of QuadNB and its reciprocal partners who have a valid trail permit are permitted to operate an Off-road vehicle on all the municipal streets listed below: Giants Glen Road within former Village of Stanley boundaries Ward Settlement Rd. within former Village of Stanley boundaries Bridge St., Stanley Lower end of Main St. (as far as Centennial St.), Stanley Centennial St., Stanley Mick Rd., Stanley 2. It is permitted for off-road vehicles to travel on Stanley streets by respecting the indicated speed limits without exceeding 40 km/h in the areas where the speed limit is higher. 3. All off-road vehicle drivers must come to a complete stop before crossing a street. 4. Any off-road vehicle driver must be able to provide when requested by a Peace Officer: - a. A valid trail permit of a federated ATV Club in New Brunswick or in another province that has a reciprocal agreement with QuadNB; this permit being in the form of a sticker which must be clearly and permanently displayed on the ATV or on the side by side. - b. A valid registration document for the vehicle, a visible license plate with the current year sticker - c. A valid insurance document - d. Respect all regulations specified in the Motor Vehicle Act as they apply to the Off-Road Vehicle Act. 5. The driver or any occupant of the off-road vehicle must be properly wearing a helmet that complies with the standards prescribed by Regulations under the Motor Vehicle Act. 6. The off-road vehicle must be outfitted with the necessary equipment as described in the Off-Road Vehicle Act. 7. The off-road vehicles must operate in the same direction as traffic and travel in single file to the extreme right of the street. 8. The off-road vehicles shall give the appropriate signals as required under the Motor Vehicle Act and obey all traffic control devices. 9. Any other vehicle utilizing the streets shall have the right of way. 10. Anyone who violates this By-law commits a punishable offence and is liable to enforcement measures under the Off-Road Vehicle Act by a fine of a maximum of $100. Completed in good faith, the Nashwaak Rural Community affixes its seal to this municipal By-law.
