## Garbage Service By-law for the Nashwaak Rural Community
## Purpose
1. The purpose of this by-law is to establish regulations and requirements for the collection and disposal of garbage within the Nashwaak Rural Community.
## Definitions
in this by-law:
- (a) "Garbage" means any domestic or residential waste, including but not limited to food waste, paper, cardboard, glass, metal, and plastics;
- (c) "Person" includes an individual, corporation, partnership, association, or organization;
- (b) "Municipality" means the Nashwaak Rural Community;
- (d) "Property" means land, building, structure, or premises.
- (e) "Residential" means any property with 4 or less residential or seasonal units.
## Collection and Disposal of Garbage
- (a) The Municipality shall provide a garbage collection and disposal service for all residential properties within its boundaries.
- (b) Garbage shall be collected from each property at least once a week.
- (c) No person shall place or leave any garbage on any public property or on any property other than their own without the express permission of the owner of the property.
- (d) No person shall burn or bury any garbage within the Municipality.
## Separation and Recycling of Garbage
- (b) No person shall place any hazardous or toxic materials, including but not limited to batteries, chemicals, paint, and electronics, in the garbage container or bag.
- (a) No person shall mix garbage with recyclable materials.
- (c) The Capital Region Service Commission provides a separate collection service for recycling and for hazardous or toxic materials.
## Fees and Charges
- (a) The Municipality may charge fees for garbage collection and disposal services.
- (b) The fees charged shall be reasonable and reflect the actual costs incurred by the Municipality in providing the services.
## Offences and Penalties
- (a) Any person who contravenes any provision of this by-law commits an offence.
- (c) Every day that an offence continues shall constitute a separate offence.
- (b) Every person who commits an offence under this by-law is liable, upon summary conviction, to a fine not exceeding $10,000 or to imprisonment for a term not exceeding six months, or to both.
## Severability
If any provision of this by-law is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
## Repeal
Any by-law or part of a by-law that is inconsistent with this by-law is hereby repealed.
## Effective Date
This by-law shall come into force and take effect on the date of its final passing.
