## Parking By-Law 24-06
- "Community" refers to the Nashwaak Rural Community.
- "Emergency Vehicle" means a vehicle operated by the fire department, ambulance service, or police service.
- "Council" means the Council of the Nashwaak Rural Community.
- "Municipal Road" refers to any street, road, lane, or other public way under the jurisdiction of the Nashwaak Rural Community.
- "Traffic Control Device" means any sign, signal, marking, or device placed or erected under the authority of this By-law for the purpose of regulating, warning, or guiding traffic.
- "Parking" means the stopping or standing of a vehicle, whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the directions of a police officer or traffic control device.
- "Vehicle" includes any means of transportation, whether motorized or not, capable of being driven, ridden, or moved on a highway or street.
## 3.0 GENERAL PROVISIONS
## 3.1 Traffic Control Devices
- The Council may authorize the installation of traffic control devices at any location on municipal roads to regulate traffic and parking in the community.
## 3.2 Compliance with Traffic Control Devices
- No person shall operate or park a vehicle contrary to the instructions of any traffic control device installed by or on behalf of the Nashwaak Rural Community
## 3.3 Parking Restrictions
- Vehicles shall not be parked in a manner that obstructs access to a fire hydrant, emergency vehicle access, or any other essential municipal infrastructure.
- No person shall park a vehicle in any location where a traffic control device indicates that parking is prohibited.
- No parking is permitted on municipal roads between the hours of 12:00 a.m. and 6:00 a.m. from November 1 to April 30 to facilitate snow removal and road maintenance.
## 3.4 Special Parking Areas
- Council may designate areas within the Community as reserved parking zones

for residents, visitors, or specific purposes (e.g., disabled parking, loading zones). · Any person parking in such a designated area without proper authorization or permit shall be subject to fines and towing.
## 4.0 ENFORCEMENT
## 4.1 Authority to Enforce
- Enforcement of this By-law may be carried out by the Nashwaak Rural Community's By-law Enforcement Officers, as well as any peace officers as defined by the Motor Vehicle Act of New Brunswick.
## 4.2 Offences
- Any person who contravenes or fails to comply with this By-law is guilty of an offence and is liable, on summary conviction, to a fine as outlined in Section 5.0.
## 5.0 PENALTIES
## 5.1 Fines
- A person convicted of an offence under this By-law is subject to the following penalties:
· For parking violations: A minimum fine of $50 and a maximum fine of $250. o For parking in a fire lane or obstructing emergency services access: A
minimum fine of $100 and a maximum fine of $500.
- 5.2 To vehiles found in violation of this Bylaw may be towed at the owners expense it they are obstructing traffic, emergency services, or are parked in violation of the snow removal provisions.
## 6.0 SEVERABILITY
If any section, subsection, or part of this By-law is declared by a court of competent jurisdiction to be invalid, such section, subsection, or part shall be deemed to be severed from this By-law, and the remaining parts of the By-law shall continue in full force and effect.
## 7.0 REPEAL AND TRANSITION
## 7.1 Repeal
- Upon adoption of this By-law, the former Village of Stanley's Parking and Traffic By-law is hereby repealed.
## 7.2 Transition
- Any fines, fees, or enforcement actions commenced under the repealed by-law

shall remain in effect and be enforceable under this By-law.
## 8.0 EFFECTIVE DATE
This By-law shall come into force on the date of enactment by the Council of the Nashwaak Rural Community.
