TOWN OF RIVERVIEW
BY-LAW 600-10
A BY-LAW OF THE MUNICIPALITY OF THE TOWN OF RIVERVIEW RESPECTING PEDLARS
Be it enacted by the Council of the Town of Riverview under authority vested in it by
the Municipalities Act (R.S.N.B. 1973, c.M-22, Section 168(1)) as follows:
1. No person within the limits of the Town of Riverview shall sell or offer to sell, other than
at the place of business of such person, directly to the consumer, goods, wares or
merchandise by sample, card, specimen or otherwise, without first having obtained a
licence issued under the provisions of this By-Law.
2. A Pedlar's Licence is valid only for the peddling or carrying from place to place for the
purpose of peddling the class or type of goods or merchandise expressly described or
referred to on the face of the Pedlar's Licence.
3. An application for a Pedlar's Licence shall be submitted to the Town Clerk in such a form
and manner and shall contain such information as prescribed in the application attached
to this By-Law in Appendix "A".
4. Any person applying for a licence to peddle any type of food or food product for human
consumption, except as permitted in Section 9 of this By-Law, shall obtain all necessary
provincial or federal licences or approvals to do so and shall provide evidence of this
prior to being granted a Pedlar's licence under this By-Law.
5. Upon receipt of any application for a licence, the Town Clerk shall either issue the licence
forthwith or shall refer the application to the Town Council, which Council shall decide
to accept or reject such application.
6.
The fee for a Pedlar's Licence shall be $100.00 per year.
7. A Pedlar's Licence issued under the provisions of this By-Law shall be valid from January
1st to December 31st of that calendar year.
8. (a) Where, in the opinion of the Town Clerk, it is in the best interests of the residents of
the Town of Riverview, the Town Clerk shall, in addition to any other remedy or penalty
prescribed herein, by notice served upon the pedlar, revoke a pedlar's licence issued
under the provisions of this By-Law.
(b) The notice referred to in subsection (a) shall be sufficiently served upon the pedlar
if it is delivered personally to the pedlar, or if it is mailed prepaid registered post to the
last known residence or place of business of the pedlar.
(c) Service of the notice referred to in subsection (b) by registered post shall be
deemed to have been effected five days after the notice was deposited in the mail.

This By-Law does not apply to:
(a) a person peddling fruits, vegetables, meats, or other products harvested by his/her
from his farm or garden;
(b) a fisherman peddling fish, oysters or any product harvested by his/her from the
sea; or
(c) persons employed by any benevolent or religious society in the Province for the
peddling or selling of religious publications under the direction of such society, to the
exclusion of other goods and merchandise.
10. (a)
Any Peace Officer or By-Law Enforcement Officer is hereby authorized to take
such action or issue such tickets as they may deem necessary to enforce any
provision of this by-law.
(b)
Any person who is convicted of violating any provision of this by-law shall pay a
fine not to exceed the maximum amount payable under Part II of the Provincial
Offences Procedure Act as a Category C offence.
11. A By-Law of the Municipality of the Town of Riverview By-Law No. 6, and all
amendments thereto, respecting pedlars, is hereby repealed.
