CONSOLIDATED VERSION BY-LAW NO. 15 & 15-1 A BY-LAW OF THE MUNICIPALITY OF SALISBURY RELATING TO TRAFFIC WHEREAS Section 10(1)(o) of the Local Governance Act, S.N.B., Ch. 18, authorizes the Municipality to make a By-law for the purposes respecting Traffic; WHEREAS the Council of the Town of Salisbury, pursuant to Section 113 of the Motor Vehicle Act, SNB c M-17 has the authority to make a By-law respecting traffic, parking, and other traffic regulations; BE IT ENACTED by the Council of the Municipality of Salisbury under the authority vested in it by the Local Governance Act, S.N.B. 2017, ch.18, as follows: 1. TITLE a) This By-law shall be cited as "Traffic By-Law". 2. APPLICATION a) This By-law applies to the geographic limits of the Town of Salisbury, as established under Section 33 of Regulation 2022-50 of the Act and as shown in Schedule A. 3. DEFINITIONS a) "Act" means the Local Governance Act, S.N.B., Ch. 18 and all amendments thereto; b) "Bicycle" means human-powered or electric motorized wheel-based vehicle" refers to any mode of transport consisting of one or more wheels, which can be propelled by human effort or electricity. This definition encompasses a range of vehicles including, but not limited to, unicycles, bicycles, tricycles, and multi-wheeled vehicles, each differing in the number of wheels and the nature of propulsion; c) "Bridge" means any structure used or intended to be used for the purpose of carrying traffic on a highway, over or across a river, stream, ravine, railway or other highway, and having a length between abutments not less than three meters, and includes the approaches thereto; d) "Bus stop" means a street or portion of a street set aside for the exclusive parking of buses for the purpose of allowing passengers to enter or alight therefrom; e) "By-law Enforcement Officer" means a By-law Enforcement Officer for the Town, appointed under Section 72 of the Act ("Officer"); f) "Clerk" means the Officer appointed as the Clerk, pursuant to section 374(1) of the Local Governance Act, SNB 2018, c.18; g) "Council" means the Mayor and Council of the Town of Salisbury; h) "Designated parking space" means a parking space which has specifically been marked or painted in a parking lot to facilitate the parking of vehicles in a neat and orderly fashion; i) "Event" means any planned or organized gathering, activity, or occurrence taking place under the responsibility or purview of the Municipality, which may include but is not limited festivals, parades, concerts, sporting events, markets, demonstrations, or social gatherings; j) "Emergency" means and includes a situation in which there is imminent danger to public safety or of serious harm to premises or to a building or other structure; k) "Highway" means the entire width between the boundary lines of every street, road, lane, alley, park, parking lot, school yard, picnic site, and includes the bridges thereon; (route); l) "Loading zone" means a street or portion of a street set aside for the exclusive parking of commercial vehicles for the purpose of loading and unloading of merchandise; m) "Motorized Vehicle" means, for the purposes of this vehicle, every vehicle that is self propelled, but does not include e-bikes or e-scooters; n) "Motor Vehicle Act" means the words defined in Section 1 of the Motor Vehicle Act R.S.N.B. 1973, c.M-17, and amendments thereto, in the Town of Salisbury o) "Municipality" means the Town of Salisbury, as incorporated under Section 33 of Regulation 2022-50 in the Local Governance Act and all amendments thereto; p) "Person" means and includes a corporation, partnership or society and the heirs, executors, administrators or other legal representatives of a person, having ownership, possession, occupancy, charge or control of premises, dwelling unit or other structure; q) "Premises" means premises, property or land with all its appurtenances and structures thereon; r) "Provincial highway" means a highway built and maintained by or under the supervision of the Department of Transportation, the New Brunswick Highway Corporation or a project company, whether or not such highway lies within the geographical boundaries of a local authority; s) "School zone" means a portion of a highway designated as such by the Municipality pursuant to Section 142(2), or as-designated by the Province of New Brunswick pursuant to Section 140(2), of the Motor Vehicle Act and any amendments thereto; t) "Structure" means anything that is erected, built, or constructed of parts joined together; u) "Town" means the Town of Salisbury, or the area contained within its municipal boundaries as the context requires; 4. TRAFFIC CONTROL BY A PEACE OFFICER, SIGNALS OR SIGNAGE a) The Department of Transportation and Infrastructure must approve all signs and their locations, with respect to the sign's function as part of a designated highway, prior to installation on a provincial highway or regional highway within the Town. b) The Town's "Welcome To" signs are installed in accordance with guidelines of the Department of Transportation and Infrastructure. c) The driver of a vehicle shall obey the requirements of the Motor Vehicle Act and any amendments thereto, unless otherwise directed by a By-law Enforcement Officer, Authorized Police Officer, or unless traffic control signals exhibiting permissible directions stipulate otherwise. 5. THROUGH HIGHWAYS a) Highways and portions of highways designated as through highways are listed as through highways on Schedule B of this By-law. Stop signs shall be erected at all entrances thereto and at all entrances other than those listed in Schedule B for all highways under the control of the Municipality, as noted in Schedule B. b) The Municipality shall only be responsible for highways within its jurisdiction area under their control, pursuant to Section 21 of the Local Governance Reform Act. 6. NO STOPPING, STANDING, OR PARKING OF A VEHICLE a) No Person shall stop, stand or park a vehicle on any highway within the Town not designated as a provincial highway, except in accordance with this by-law and no person shall stop, stand or park a vehicle on any street or portions thereof: i. having a measured width between curbs, or roadside in the absence of curb(s), of less than 6.5 meters; ii. set aside for the exclusive parking of buses for the purpose of allowing passengers to enter or alight therefrom; iii. to prevent or obstruct the passing of other vehicles; iv. within three (3) meters of an entrance to a church, school, hotel or theatre, motel, hotel or post office; v. within five (5) meters of a fire hydrant, pedestrian crossing, or intersection; or vi. in any areas of a parking lot not designated for parking; vii. No person shall park a vehicle in a parking lot other than in a designated parking space; viii. All limited parking areas, streets and portions of streets, or any parking area described as reserved parking area or parking marked and designated as a time limited parking by an appropriate sign or markings showing the time limits of permitted parking; ix. On any highway or portions of highway within the Town of Salisbury designated as "No Parking" zones, signed accordingly, as shown in Schedules "I" of this By-Law. b) A By-law Enforcement officer may move or cause any vehicle found stopped or parked in violation of the provisions of this by-law to be moved on any highway within the Town. A vehicle so moved under this section shall be stored in such a place as the traffic officer may direct and the registered owner of such vehicle at the time shall be liable for the costs and charges for the moving and storage thereof. 7. WINTER PARKING a) From November 15 to April 15, for the purposes of ensuring snow removal operations, no person shall park a vehicle unattended on any highway between the hours of 12:00 am and 07:00 am of any day. b) The Council, or its designate, or By-Law Enforcement officer may move or cause to be moved any vehicle found impeding winter maintenance, plowing of snow, stopped or parked in violation of the provisions of this by-law on any highway within the Town. A vehicle so moved under this subsection shall be stored in such a place as the Council or its authorized designate, or a traffic officer may direct and the registered owner of such vehicle at the time shall be liable for the costs and charges for the moving and storage thereof. 8. FIRE LANES a) No person shall stop, stand or park a vehicle, whether attended or unattended, within areas marked as "FIRE LANE". b) No person shall stop, stand or park a vehicle, whether attended or unattended, within six (6) meters of the exterior wall of a mall or plaza or other building where a fire lane has been designated. 9. NUISANCES a) No person shall place upon any highway any goods, wares ,vehicles or merchandise, whether for sale or display, or solicit and receive orders for same. b) No person shall deposit or cause to be deposited, by shoveling, scooping, or plowing, any snow, grass, brush, or foreign material, upon or across any street, sidewalk, crosswalk, or near any fire hydrant. c) No person shall remove or attempt to remove, dig up, cut down destroy or in any manner damage or injure any trees in or upon any highway or public place. d) No person shall park a motor vehicle on any street at any time to impede traffic and if a traffic officer or person designated by the Council orders the vehicle removed, the owner of the vehicle shall be liable for any removal, towing and storage charges. e) No person shall place or park on any street, at any time, a motor vehicle for the purpose of sale, or display for offer of sale and if a traffic officer or person designated by Council orders the vehicle removed, the owner of the vehicle shall be liable for the cost of removal, towing and storage of the vehicle. f) No person shall abandon a vehicle or leave a vehicle standing for a period of more than twenty-four hours on any of the Town's highways. 10 AUTHORIZED EMERGENCY VEHICLES a) Upon the immediate approach of an authorized emergency vehicle equipped with at least one lighted lamp exhibiting a flashing red light visible from the front of such vehicle, and when the driver is giving an audible signal by siren, exhaust whistle, or bell, the driver of every other vehicle shall yield the right-of-way to such authorized emergency vehicle and shall immediately drive to a position parallel to, and as close as possible to, the right-hand edge or curb of the roadway clear of any intersection and shall stop and remain in such position until the authorized emergency vehicle has passed, except when otherwise directed by a peace officer. b) The driver of every vehicle shall yield the right-of-way to a police vehicle which is being used as an authorized emergency vehicle in the manner provided in subsection (1) when the driver of such police vehicle is giving an audible signal by siren, exhaust whistle or bell, and whether or not such police vehicle is equipped with a flashing red light visible from the front thereof. 11. IMPOUNDING OF VEHICLES a) A By-law Enforcement Officer may remove and impound any vehicle which is found to be parked or abandoned on any street in contravention of any provision of this By-law and no person shall take possession of a vehicle so removed or impounded until all costs and charges for removal, towing and storage of such vehicle have been paid. 12. POLLUTION a) No driver or person in control of or in charge of a vehicle or off-road vehicle shall cause or make any unnecessary or unreasonable noise as per section 109 of the Motor Vehicle Act. b) No driver or person shall cause or permit any load from dropping, sifting, leaking or otherwise escaping from the vehicle and or trailer. 13. PARADES AND PROCESSIONS a) Pursuant to Section 113(1)(c) of the Motor Vehicle Act, the Municipality shall regulate processions and assemblages on highways. b) Any person wishing to hold a parade, marathon, or assemblage on a street within the Municipality shall apply, included in Schedule C, at least 40 days prior to the event. c) In the event that a parade, marathon, or assemblage requiring a full or partial street closure is within or on a provincial road or highway, the Town shall request a Letter of Permission from the Department of Transportation and Infrastructure. d) For any planned closure, the Town shall be responsible for informing emergency services of any planned closure(s). e) Upon receipt of an application referenced in Section C of this By-law, completion of the notification and approval process (when applicable) referenced in Section C of this By-law, and once authorized by resolution of Town Council, the Town shall issue a permit to hold or carry on the event. f) No parade, assemblage, marathon, or any planned closure may occur without the appropriate application and permit from the Municipality. 14. NON-VEHICULAR TRAFFIC a) Pedestrians shall obey the provisions of the Motor Vehicle Act. b) No motorized vehicles, except those authorized by the Town, are allowed on lands designated as parks, playgrounds, walking paths, trails, boardwalks, beaches, green areas, ball fields, lawns, nature preserves, land for public purposes or open spaces, except in those areas designated as driveways and parking lots. c) Anyone riding or driving a bicycle must follow the provisions of the Motor Vehicle Act. 15.SCHOOL ZONE a) The Town shall designate a school zone on municipal roads in proximity to any school, as shown in Schedule C. Pursuant to Section 140.1(1.1) of the Motor Vehicle Act, the Minister of Transportation and Infrastructure has designated the portion(s) of provincial highway indicated in Schedule D as a school zone. b) School zones, whether designated by the Municipality or the Minister of Transportation and Infrastructure, are subject to provisions of Subsection 140 of the Motor Vehicle Act, its subsections, and any and all amendments thereto. c) No person shall park, stop, or stand a vehicle on portions of Douglas Street, shown in Schedule D, between the hours of 7:30 am to 8:30 am and from 1:30pm to 3pm on any school day. This No Parking requirement includes the side of highway opposite that on which the school premises lie. d) No person shall park, stop, or stand a vehicle on portions of River Road, shown in Schedule D, between the hours of 7:30 am to 4:00 pm on any school day. This No Parking requirement includes the side of highway opposite that on which the school premises lie. e) The Town shall employ a school crossing guard, pursuant to the provisions of Section 169.1 of the Motor Vehicle Act, at the designated crosswalk(s) shown in Schedule D of this By-law. 16. COMMERCIAL VEHICLES a) The driver of any commercial vehicle having a gross mass of forty-five hundred (4500) kilograms or more shall not be permitted to park and leave the vehicle on any municipally owned street or parking area. b) The provisions of this section do not apply to: i. Vehicles owned by or under contract to the Town; ii. Vehicles owned by the Salisbury Fire Department; iii. Vehicles owned by the Province of New Brunswick; and iv. Vehicles owned by a public utility. 17. CROSSWALKS a) The Municipality is responsible for the installation, maintenance, signage, and painting of crosswalk lines at the designated crosswalks. b) The Council of the Municipality shall be responsible for the determination of crosswalk locations, which are shown in Schedule E. c) Pursuant to Section 121(1) of the Motor Vehicle Act, pedestrians shall obey the directions indicated by any special pedestrian control signals that exhibit any symbol prescribed by regulation, such as crosswalks. d) Pursuant to Section 169(2) of the Act, the Town prohibits the crossing of any roadway on a highway within the Town except in a cross walk. e) Pursuant to Section 171(1) of the Act, a crosswalk exists at a stop intersection, even when unmarked, or when a marked crosswalk exists. f) The installation of pedestrian crosswalks on provincial highways requires the approval of the Department of Transportation and Infrastructure (DTI). g) Prior to installation of a crosswalk, the Town shall undertake an evaluation to determine if a location warrants a crosswalk using national standards of the Transportation Association of Canada (TAC) at the recommendation of a certified Traffic Engineer. Such evaluation shall include, but is not limited to, determination of available stopping sight distance, the number and type of pedestrians crossing the roadway, and the number and speed of motor vehicles in the area. 18. EVENT PARKING a) In the event of an Event, the Town may, at its discretion, initiate Event Parking Procedures to ensure emergency vehicle access and safe traffic flows in residential areas in the proximity of events. b) Areas of the Municipality which may be subject to event parking are listed in Schedule F of this By-law. c) In the event that the Town initiates Event Parking procedures, the Town shall follow the procedures outlined in Schedule G of this By-law. d) When Event Parking is initiated, no person shall park, stop, or stand a vehicle on any side of the road which is designated as no-parking for the duration of the event. 19. TRAFFIC RULES a) No Person Shall willfully fail or refuse to comply with any order or direction of a By-Law Enforcement Officer or Peace Officer given in respect to the direction, control or regulation of traffic. b) Every driver of a vehicle shall, immediately upon being signaled or requested to stop by a By-Law Enforcement Officer or Peace Officer, bring the vehicle to a stop and keep it at a stop until directed to proceed. c) A driver to whom a request has been made under subsection (c) shall forthwith present and deliver to the officer for inspection such documentation that he or she has in their possession and that has been requested by the officer. 20. VALIDITY a) If any part of this by-law is held to be invalid and struck down, it does not invalidate the remaining provisions of the By-law. 21. VIOLATIONS AND OFFENCES a) Any person who violates a provision(s) of this By-law has contravened this by-law and is liable to a penalty outlined in Schedule H, to be paid within 30 days of the date in which a penalty is given, and in which shall not exceed fifteen hundred dollars ($0.00-$1,500.00), or whatever is permissible by law. b) Any person who fails to pay the administrative penalty within the time prescribed is guilty of an offence and is liable on summary conviction to an additional fine of, at minimum, $140.00 but that shall not exceed $2,100.00 ($140.00-$2,100.00), or whatever is permissible by law. c) Any person commits an offence under this by-law if they interfere or attempt to interfere with any Officer authorized to enforce provisions of this By-law. 22. EFFECTIVE DATE a) This By-Law comes into effect on the date of the final passing thereof. Read a first time this ___ day of ________, 2025. Read a second time this ___ day of ________, 2025. Notwithstanding the list of streets below, reasonable efforts shall be maintained to ensure the list is as up to date. Highways that are under the control of the Minister of Transportation and Infrastructure shall not be the responsibility of the Municipality and are not included herein. Notwithstanding the speed limits below, any temporary modifications pursuant to Section B-3 of this Schedule shall be denoted with appropriate signage. SCHEDULE F Event Parking Area(s) SCHEDULE G Event Parking Procedure(s) In the event that the Town, at its sole discretion, deems it necessary to initiate Event Parking procedures, pursuant to Section 19 of this By-law, the Town shall: a. Issue a public notice on the Town's website, salisburynb.ca, approximately 48 hours before the event b. Issue a public notice on the Town's social media channels, approximately 48 hours before the event, specific to the Event Parking procedures c. No later than four (4) hours of the commencement of the event, install signage at approximately 25-feet intervals on all sides of street in which event parking procedures are in effect. Such signage shall stipulate: I) No Parking II) Event Parking Provisions in Effect III) More information: salisburynb.ca d. Approximately 48 hours before the event, issue a door knocker to the properties on the street(s) that will be subject to event parking procedures e. One day before the event, notify emergency services (Salisbury Fire Rescue, Ambulance New Brunswick, RCMP (Caledonia Detachment) of the event, event parking provisions, and emergency access if needed As part of event planning procedures, the Town is encouraged to communicate parking and options to access events, even outside of the formal procedures for event parking contained herein. While the Town will make every reasonable effort to communicate parking provisions proactively, certain instances may result in the Town being unable to meet these standard timelines, in which instance the Town shall endeavor to meet as many of the standard notification protocol(s) as possible. At no point will the Town enforce or initiate event parking provisions in the absence of temporary on-site signage, as per the provisions of this By-law.
