## BY LAW R-1 DISTURBANCE BY NOISE
The Council of the Municipality of the Village of Perth-Andover, under the authority vested in it by Section 11(1) of the Municipalities Act R.S.N.B. 2003, c M-22, hereby enacts as follows:
## 1. REGULATION
No person shall make, permit or continue, or cause to be made, permitted or continued any noise of such volume as likely to cause a public nuisance or otherwise disturb the inhabitants of the Village.
## 2. SPECIAL EXCEPTIONS
Without restricting the generality of Section 1, this By-law does not apply to:
- a) Street and sidewalk installation and/or maintenance
- b) Protection or preservation of property
- c) Protection or preservation of health, safety, life or limb of person
- e) Noises relative to organized traditional, festival, and religious activities, when so authorized or sponsored by the Village of Perth-Andover.
- d) Noises relative to athletic and recreational activities taking place on recognized sports fields
- f) Construction equipment and machinery between 6:00 AM & 10:00 PM Monday to Saturday.
- g) Property Owners doing maintenance and repairs between 6:00 AM & 10:00 PM.
## 3. OFFENCES
Any person who violates or breaches any provision of the by-law is guilty of an offence.
## 4. PENALTIES
- a) Every person who violates any provision of this By-Law is guilty of an offence and is liable on summary conviction to a fine of not more than Two Hundred Dollars ($200.00) and in default of payment to imprisonment in accordance with Subsection 31(3) of the Summary Conviction Act.
- b) Every person charged with an offence under this by-law may, on or before the hearing scheduled for entering a plea before the Provincial Court, may make a voluntary payment of $70 (seventy dollars), in cash, certified cheque, bank draft or money order, to the Clerk
or other person(s) so designated by Council, by mail or in person, at which time the person committing the violation is not to be prosecuted or further prosecuted therefore.
## 5. BY-LAW REPEALED
By-Law # 10 of Village of Perth-Andover enacted on January 4'h , 1983 is hereby repealed.
