BY-LAW NO. 262
A BY-LAW TO REGULATE STREET TRAFFIC
The Mayor and Council of the Town of Sackville enacts as follows:
1 INTERPRETATION
In this By-Law:
1.1 Words used in this By-Law which are not herein defined shall have that meaning
as set out in the provisions of the Motor Vehicle Act, R.S.N.B. 1973, Chapter M-
17 and amendments thereto as if such words were fully set out in this By-Law;
"By-Law Enforcement Officer" means a person designated by Council and
sworn-in by the Province of New Brunswick to enforce the By-Law's of the
Town of Sackville;
"Council" means the Council of the Town of Sackville;
"Cross Walk" means that part of a roadway at an intersection lying between
imaginary lines connecting the lateral lines of the sidewalk on opposite sides of
the streets and any portion of a roadway at an intersection or elsewhere directly
indicated for pedestrians crossing by lines or other markings on the surface;
"Director of Engineering and Public Works" means the Director of Engineering
and Public Works for the Town of Sackville or his/her designate;
"Person" means and includes all corporations, partnerships, associations,
societies, and/or sole individual persons;
"Public Place" means and includes any place, building or conveyance to which
the public has or is permitted to have access, as well as any highway, street, lane,
park or any place of public amusement;
"RCMP" shall mean the Royal Canadian Mounted Police;
"Sidewalk Café" is any group of tables, chairs and authorized decorative
accessory devices situated and maintained upon the public sidewalk for use in
connection with the consumption of food and beverages by the public from or in
an adjoining indoor food or beverage serving establishment. The definition does
not apply to the use of the road surface;
"Town" where hereinafter used shall mean and include all the areas within the
boundary limits of the Town of Sackville;

"Traffic Authority" shall mean the Town of Sackville.
"Traffic Control Device" means a device, signal or sign for the regulation,
warning or guidance of traffic.
1.2 Subject to obtaining the sanctions of the Lieutenant Governor in Council
when the resolution related to a portion of a provincial highway, the Council
may from time to time amend by resolution Schedules "A" through "J"
inclusive of this by-law.
2 STOP SIGNS & YIELD SIGNS
2.1 The streets and portions of streets as set out in Schedule "B" to this by-law are
designated through streets, and except where otherwise provided herein, stop
and/or yield signs shall be erected at all intersections therewith.
3 LANE HIGHWAYS
3.1 The highways or portions of highways named in Schedule "C" are lane highways
and divided into lanes for vehicular traffic by means of dotted or solid lines or by
means of traffic control devices suspended above the highway, or both.
4 ONE-WAY HIGHWAYS
4.1 The highways and portions of highways listed in Schedule "D" are designated
one-way highways and all vehicles thereon shall move, or be moved, only in the
direction indicated in Schedule "D".
5 TRAFFIC CONTROL SIGNALS
5.1 There shall be erected, placed and maintained to regulate, warn or guide vehicular
and pedestrian traffic, Traffic Control Devices at the intersections designated in
Schedule "E".
5.2 All Traffic Control Devices shall be in conformity with those requirements as
provided in the Motor Vehicle Act, R.S.N.B. 1973, Chapter M-17, and all
amendments thereto.
6 NON-VEHICULAR TRAFFIC
6.1 Roller blades and/or bicycles shall not be used on any sidewalks in the Town of
Sackville.

6.2 Skateboards are only to be used in the Town of Sackville's designated Skate Park
located on Dufferin Street. They are not permitted on any sidewalks or roadways
in the Town of Sackville.
6.3 No person shall ride or operate a bicycle on a highway unless the person is
wearing a bicycle helmet in accordance with the regulations in the Motor Vehicle
Act, and the chinstrap is securely fastened under the person's chin.
6.4 No parent or guardian of a person who is under sixteen years of age shall
authorize or knowingly permit that person to ride on or operate a bicycle on a
highway unless the person is wearing a helmet in accordance with section 6.3.
7 SPEED
7.1 No person shall drive a vehicle on the following highways or parts of highways
designated in Schedule "F" at a speed in excess of 40 Kilometers per hour.
7.2 No person shall drive a vehicle in a school zone on the following highways or
parts of highways as listed in 7.2(a) and 7.2(b); in excess of 30 Kilometers per
hour during the hours of 7:30 a.m. to 4:00 p.m. on the days during which a school
in the vicinity of a school zone is in session;
7.2(a) On Queens Road from the intersection of Lorne Street to the intersection
of Salem Street in both directions,
7.2(b) On Main Street from the entrance onto Highway #2, which leads to Nova
Scotia to the intersection of Main Street and Odgen Mill Road in both
directions.
8 PARKING
8.1 Unlimited parking time will be granted to all motorized vehicles displaying a
valid Veteran's license plate except as outlined in Section 8.6.
8.2 Except where otherwise provided in this By-Law, no person shall stop, stand or
park a vehicle, whether attended or otherwise, for a period of time longer than that
designated in Schedules "G" and "H". These restrictions apply every day, except
Sunday, on any of the designated highways or parts of highways, or on any public
parking lot owned or maintained by the Town of Sackville between the hours of
8:00 a.m. and 6:00 p.m.
8.3 Notwithstanding any other provisions of this By-Law, no person shall stop, stand
or park a vehicle, whether attended or otherwise, on any of the highways or
portions of highways as designated in Schedule "I".
8.4 No person shall stop, or park a motor vehicle on any sidewalk or portion of
sidewalk.

8.5 No person shall park a vehicle on a highway in a location reserved for parking by
disabled persons unless there is displayed on or in the vehicle a disabled person
identification plate, permit or placard issued by the Registrar of Motor Vehicles.
8.6 No person shall stop, stand or park a vehicle on any highway or any public
parking lot owned or maintained by the Town of Sackville or portion thereof
during the following times:
8.6.1 Commencing at 12:01 a.m. on the first day of December in any year and
ending at 12:01 a.m. of the first day of May in the following year between
the hours of 1:00 a.m. and 6:00 a.m. on each day, or
8.6.2 At any other time so as to interfere with snow plowing or snow removal
operations conducted by the officers, employees, agents or independent
contractors of the Town of Sackville.
8.7 No person shall stop, stand or park a motor vehicle whether attended or otherwise,
except when necessary to avoid conflict with other traffic or in compliance with
law or the direction of a By-Law Officer, Peace Officer or Traffic Control Device
in any of the following places.
8.7.1 In front of a public or private driveway in part or in whole, or
8.7.2 On or within 3 metres in any direction of a crosswalk, unless so indicated
as a place to park, or
8.7.3 Facing in the opposite direction of traffic on either side of the road,
8.7.4 Within 5 metres of any fire hydrant, or causing impediment to access of
any fire hydrant, unless so indicated as a place to park
8.7.5 On any street, portion of a street or any public parking lot owned or
maintained by the Town of Sackville designated as a fire lane by a traffic
control device erected by the Town of Sackville or by the owner of the
land.
8.8 No vehicle may park as to cause obstruction to traffic on any street, road, highway
or parking lot. Vehicles found illegally parked may, by order of an RCMP Officer
or By-Law Enforcement Officer, have the vehicle removed and impounded.
8.9 In addition to any other penalty herein provided, any person whose vehicle has
been moved shall pay to the Town or the towing company, the amount of all
towing, moving and storage charges before such vehicle is returned to him.
8.10 The Town of Sackville, RCMP, or the Town of Sackville By-Law Enforcement
Officer assumes no liability for any damages occurring to a vehicle moved or
impounded under Section 8.9.

PROCESSION

9.1 No person shall operate, hold or conduct a procession except a funeral procession,
or assemblage, parade or event upon any highway in the Municipality of the Town of
Sackville unless a valid permit has been issued in writing from the CAO or designate.
The permit shall set out the hour, date, and route or location of the funeral procession,
assemblage, parade or event to be held.
9.2 It shall be an offense under this By-Law for any person to organize, hold, conduct
or partake, in any manner, a procession, except a funeral procession, assemblage,
parade or event, without a valid permit in writing from the Town's CAO or designate.
Any contraventions of any of the conditions of the permit, or other laws, shall make
the permit immediately invalid.
9.3 Where a procession or assemblage, including a funeral procession, is being held
under the provisions of this section, no person shall walk or drive a motor vehicle,
bicycle, motorcycle or animal into, or through, the said procession or assemblage.
9.4 When a funeral procession is in motion, the driver or operator of a motor vehicle
shall immediately pull the vehicle to the nearest curb and remain there until the
procession has passed.
10 OTHER RESTRICTIONS
10.1 No person shall assemble with others on any highway so as to obstruct the
passage of other pedestrians or vehicles over or upon the highway.
10.2 No person shall deposit or cause to be deposited, by shoveling, scooping, or
plowing, any snow or foreign material, upon or across any street, sidewalk, crosswalk
or near any fire hydrant.
10.3 No person shall pile or otherwise place snow to the extent that it is likely to
become a nuisance or to endanger public safety. Any person who does not remove the
snow pile within 24 hours of being notified shall, in addition to the penalty referred to
in section 11.8, be liable to the Town for all costs incurred by the Town in order to
rectify the situation.
10.4 No person shall stand or loiter on a sidewalk or any public place so as to obstruct
the view of the store window, or to interfere with pedestrian traffic, or block the
entry way to any building.
10.5 No person shall operate a sidewalk café unless it meets all requirements as
prescribed in the latest approved edition of the "Town of Sackville Sidewalk Café
Operating Procedures", Schedule "A".
10.6 The regulation of vehicular and pedestrian traffic and the control of parking in
the Town of Sackville shall be under the supervision of the By-Law Enforcement

Officer whose duty it shall be to enforce the provisions of this and other By-Law's
relating thereto.
10.7 The RCMP of the Town of Sackville shall have full power and authority to erect
or to remove, or cause to be erected or removed, as may from time to time be
necessary, such signs or other Traffic Control Devices for the purpose of directing
and regulating traffic on highways or portions of highways within the Town of
Sackville, provided that this section shall not apply to those highways or portions of
highways that are designated pursuant to the provisions of the Highway Act.
10.8 Notwithstanding anything in this By-Law to the contrary, the By-Law
Enforcement Officer may direct traffic on any highway, or pedestrians on any
sidewalk, and the driver of any motor vehicle or pedestrian, shall obey the directions
of the By-Law Enforcement Officer.
10.9 Notwithstanding anything in this By-Law to the contrary, any member of the
Fire Department of the Town of Sackville shall, while on duty, have full power and
authority on the breaking out of a fire within the Town of Sackville to prevent
persons and vehicles passing through or across any highway in the vicinity of the fire
and to keep persons at a proper distance therefrom, and for such purposes to extend
chains, ropes or barricades, along, through or across any highway.
10.10 No person shall refuse, fail or neglect to obey the directions or commands of a
member of the Fire Department of the Town of Sackville, which may be given under
the provisions of Section 10.9.
10.11 No person shall drive a motor vehicle on any highway so as to splash water,
mud or snow on any pedestrian using a sidewalk or crosswalk at the time.
10.12 Except for emergency services personnel, no person shall open the gate at the
northeast end of Balser Place that provides access to the Town's arena property (PID
70337290).
10.13 No vehicle shall turn east onto Willow Lane while travelling in a southerly
direction.
11 PENALTIES
11.1 A person sixteen years of age or older who violates or fails to comply with
section 6.3 and 6.4 of this By-law is guilty of an offense and liable to a fine of
twenty-one dollars.
11.2 Any person who violates any provision of this By-Law, except Section 6 is liable
on conviction to a fine of not less than $50 and not more than $500. All such fines

shall be recoverable under the Provincial Offences Procedures Act, S.N.B. 1987, c.P-
22.1.
11.3 Any person who violates any provision of this By-Law, except Section 6, for a
second time within a twelve-month period from the time of the last offence is guilty
of a fine of not less than $100 and not more than $1,000. All such fines shall be
recoverable under the Provincial Offences Procedures Act. S.N.B. 1987, c.P-22.1.
11.4 Any person who violates any provision of this By-Law, except Section 6 for a
third and subsequent offence within a twelve-month period from the time of the last
offence is guilty of a fine of not less than $250 and not more than $2,500. All such
fines shall be recoverable under the Provincial Offences Procedures Act. S.N.B.
1987, c.P-22.1.
11.5 Any person who violates section 6.1 or 6.2 of this by-law is liable on conviction
to a fine of not less than $20 and not more than $200. All such fines shall be
recoverable under the Provincial Offences Procedures Act, S.N.B. 1987, c.P-22.1.
11.6 Any person who violates section 6.1 and 6.2 of this by-law for a second time
within a twelve-month period from the time of the last offence is guilty of a fine of not
less than $50 and not more than $500. All such fines shall be recoverable under the
Provincial Offences Procedures Act, S.N.B. 1987, c.P-22.1.
11.7 Any person who violates section 6.1 and 6.2 of this by-law for a third and
subsequent offences within a twelve-month period from the time of the last offence is
guilty of a fine of not less than $100 and not more than $1,000. All such fines shall be
recoverable under the Provincial Offences Procedures Act, S.N.B. 1987, c.P-22.1.
11.8 Any person who violates Sections 10.3 of this By-Law is liable to a fine of
$250.00.
12 OTHER
12.1 It is hereby agreed and understood that wherever in these presents the masculine
gender is used it shall be deemed to be and shall be as the feminine gender or neuter
genders if the context so requires; and the feminine gender shall be deemed to be and
shall be at the masculine gender or neuter genders if the context so requires.
13 REPEAL

13.1 By-Law No. 231, A By-Law to Regulate Street Traffic, and all amendments
thereto, are hereby repealed.
This By-Law comes into force on the date of final passing thereof.

SCHEDULE "A"
-TOWN OF SACKVILLE SIDEWALK CAFÉ OPERATING PROCEDURES-
1.0 DEFINITIONS
"sidewalk café" - is any group of tables, chairs and authorized decorative accessories
situated and maintained upon the permanent public portion of the sidewalk for use in
connection with the consumption of food and beverages by the public from or in an
adjoining indoor food or beverage serving establishment. The definition does not
apply to the use of the road surface.
"sidewalk" - that portion of a highway or street between the curb lines or the lateral
lines of the roadway, and the adjacent property lines set apart for the use of
pedestrians, and includes any part of a highway set apart or marked as being for the
exclusive use of pedestrians.
"temporary sidewalk" - is a sidewalk that is removable and constructed of an
acceptable material such as wood, which extends beyond the limits of the existing
curb face, for the purpose of providing an unobstructed public pedestrian passageway.
2.0 PURPOSE
The purpose of this procedure is to regulate the use of the public right-of-way to enable
the operation of sidewalk cafés.
3.0 PROCEDURE
3(1)
Sidewalk cafés are permitted within the Downtown Business District
between May 1st and October 31st subject to the approval of Council and/
or staff.
3(2) Application Process
(a) An application to utilize the public sidewalk for a sidewalk café may
be obtained from the Southeast Planning.
(b) The completed application form must be submitted to the Southeast
Planning along with the following:
a.
A detailed plan drawn to scale showing: the existing
restaurant/café face, extent and layout of the proposed
sidewalk café, barriers, trash receptacles,

umbrellas/awnings, placement of chairs and tables, adjacent
sidewalk and curb, exits, parking, utility poles, fire
hydrants, doors of adjacent businesses, landscaping, any
item located within 4.57 meters (15 feet) of the proposal,
and any other necessary information to process the
application;
b.
A fee as determined by Council.
(c) Upon submission of the completed application form and the
information as required in 3(2)(b), staff of the Southeast Planning in
conjunction with the Town Engineer will assess the proposal based on
the requirements of section 3.3, Conditions of Approval. Staff will also
request written comments from the C.A.O, Fire Department, RCMP
department, the Town Engineer and any other necessary governmental
agency. Upon receipt of all comments and the proposal meeting all of
the conditions of approval outlined in 3(3) and all identified concerns
being addressed, the Southeast Planning staff and Town Engineer will
approve the sidewalk café. Where an application is unable to meet all
of the requirements of 3(3) or identified concerns cannot be addressed,
the application and all comments will be forwarded on to Council for
their consideration.
(d) In the event that Council denies the application, the Clerk will notify
the applicant in writing of the decision of Council.
(e) In subsequent years, if a completed renewal application is resubmitted
with no substantial changes, which shall include a reduction in size,
the Southeast Planning and the Town Engineer shall renew the permit
without presenting it to Council.
(f) A completed renewal application form must be submitted to the
Southeast Planning along with the following:
a. Signed renewal application
b. Copy of liability insurance naming Town as additional insured
c. Copy of previously approved detailed plan
d. Fee as determined by Council.

3(3)
Conditions of Approval
(a) The operator must agree to abide by all terms and conditions set forth
in this procedure, and any other terms and conditions imposed by
Council. Failure to comply with any or all of these terms and
conditions may result in the revoking of permission to operate the
sidewalk café. Southeast Planning and the Town Engineer reserves the
right to require the sidewalk café to be removed at any time for
reasons of noncompliance.
(b) Approval for a sidewalk café is subject to the approval of the
Department of Health, the Fire Marshall, the Liquor Licensing Board
(where applicable) and any other necessary government agency.
(c) The use of any signs shall be subject to the issuance of a building
permit and the relevant provisions of the Zoning By-law.
(d) The installation of a retractable or permanent awning or canopy is
subject to the issuance of a building permit.
(e) The hours of operation of the sidewalk café shall be limited in
accordance with the Town's Noise By-Law.
(f) The operator of the sidewalk café must carry a minimum of two
million dollars ($2,000,000) of public liability and property damage
insurance for the operation of the sidewalk café. The Town of
Sackville is to be named as an additional insured on the policy and is
to be notified 15 days prior to cancellation of the policy.
g) Sidewalk cafés must be delineated within a clearly defined limit, and
are to be developed in a manner that is compatible with the existing
establishment and the area streetscape and shall abut and must not
extend beyond the frontage of the existing café or restaurant, unless
approved by the Council and with the written consent of the affected
property and business owners.
(h) The prescribed area of the sidewalk café must be separated from
pedestrian traffic and vehicular traffic by an approved fixed and sturdy
barrier such as a wrought iron railing, fence, or a row of planters or
pots. The barrier shall be at least 0.8 meters in height and no more than
1.0 meter in height, must be free standing and only anchored in the
sidewalk upon approval and by conditions imposed by the Town
Engineer.
(i) All tables, chairs, and ornamental furniture must be made of materials
that are heavy enough to withstand wind currents. As well they should

be of uniform style and design. Damage resulting from the movement
of furniture is the responsibility of the café operator.
(j) Landscaping is encouraged provided that it is of a temporary nature
and entirely within the boundaries of the sidewalk café.
(k) Removal: All sidewalk café fencing, furnishing, landscaping, lighting
and other accessories/improvements must be of a temporary nature and
be removed during the off-season to the satisfaction of the Town
Engineer.
(l) All furniture and fixtures must be placed so as not to impede building
ingress and egress. They should also be movable and arranged to
adequately accommodate persons with disabilities.
(m) Sidewalk cafés are not permitted where they may obstruct sightlines at
an intersection, or cause any operational or safety problems on the
public road right-of-way. Where a sidewalk café is located at a street
intersection, the café shall be set back a minimum of 3 meters (10 feet)
from the corner of the building located at the intersection. A sidewalk
café must be located 1.52 meters (5 feet) from the following: a
crosswalk, driveway or alley, curb face unless a temporary sidewalk is
approved. The sidewalk café must also be 3 meters (10 feet) from any
sidewalk elevator, and 1.82 meters (6 feet) from any fire hydrant, or
fire department connection. These setback requirements may be
modified at the discretion of the Town Engineer.
(n) A minimum unobstructed pedestrian passageway of 1.52 meters (5
feet) shall be provided and maintained at all times. No physical
obstructions such as utility poles, fire hydrants, park benches, garbage
cans, tables or chairs may be located within this passageway. The
Town Engineer may require more distance, if deemed necessary, to protect
the public safety or where unusual circumstances exist and where public
safety would be jeopardized.
(o) Umbrellas shall not extend beyond the boundaries of the sidewalk
café.
(p) The floor area of the café or restaurant must exceed the floor area of
the sidewalk café.
(q) Sidewalk cafés will be considered in the Downtown Business District
only and must meet all of the requirements of the Zoning By-law.
(r) A café or restaurant located on a corner lot may utilize the adjacent
sidewalk along the side of the indoor establishment's provided that it
meets all other requirements.

(s) The sidewalk café shall remain at the existing sidewalk level unless
approved by the Council.
(t) The Town Engineer and public utility agencies reserve the right to
temporarily cancel the operation of the sidewalk café for the installation,
maintenance or repair of infrastructure. In the event of an emergency, notice
of access may not be given. For all scheduled work, every effort will be
made to provide the operator with one week's notice. Should access be
required, all sidewalk café accessories/improvements will be removed and
reinstalled at the operator's expense.
(u) The café and the area surrounding the café must be maintained in a clean and
aesthetically pleasing manner at all times. Each café must provide and
maintain their own garbage receptacles located within the café boundaries
and ensure that the customers are depositing all refuse in the café provided
receptacle. Further, the operator of the sidewalk café is responsible for the
removal of all waste/litter within these receptacles.
(v) A temporary sidewalk must remain at the same level as the permanent
sidewalk and be a minimum of 5 feet in width. All temporary sidewalks
must be approved on a site-specific basis by the Town Engineer with such
conditions as may be imposed at such time. Upon removal of the temporary
sidewalk, the café owner is responsible for the cleanup of the area around
and where the temporary sidewalk had been placed of any and all
accumulated debris.
