Definitions: The following definitions apply to this by-law: - (a) Animal means a domestic animal or pet which is maintained under the control of a person or, by habit or training, lives with said person, such as, but not limited to, dog, cat, rabbit and bird as well as the female of these animals. Does not include farm, exotic or wild animals. (Animal) - (b) Animal - exotic means birds, insects, mammals, reptiles, and other vertebrates that are not indigenous to New Brunswick and, in their natural habitat, are generally found in a wild state, such as, but not limited to the monkey, the parakeet, the tarentula, the lizard and the snake, as well as the female of these animals. (Animal exotic) - (c) Animal - wild means any animal that such as, but not limited to the racoon, wild cat, fox, moose, bear, and deer, as well as the female of these animals. (Chiens dangereux) - f) Conseil signifie le conseil municipal de Vallée-des-Rivières; (Conseil) - g) Errant signifie un animal trouvé à tout endroit autre que les lieux de son propriétaire, qui n'est pas tenui en laisse d'au plus 2 mètres de longueur ou qui n'est pas sous le contrôle de son propriétaire; (Errant) - h) Lieu public signifie un lieu où le public en général a accès incluant tout chemin, rue, ruelle, piste cyclable, sentier, jardin, parc, promenade, quai, dôme, terrain de jeux ou autre propriété municipale; (Lieu - i) Municipalité signifie Vallée-desRivières aussi connu sous le nom de ville Vallée-des-Rivières; (Municipalité) - j) Propriétaire signifie toute personne (Propriétaire) 3. (Dangerous dog) - (f) Council means the municipal council of Vallée-des-Rivières; (Council) - (g) Running at large occurs when the animal is found in any place other than the premises of its owner, not secured by a leash which is 2 m or less in length, or is not under the control of the owner; (Running at large) - (h) Public space means any space where the public has access including any road, street, alley, biking trail, trail, sidewalk garden, park, promenade, wharf, dome, playground, or other municipal property; (Public place) - (i) Municipality means Vallée-desRivières also known as the town of Vallée-des-Rivières; (Municipality) - (i) Owner means any person who has an animal in his possession, harbors, permits it to remain about his premises or residence or registers it under this by-law; (Owner) 3. Gender and number The following rules apply to all by-laws: - 3(1) The masculine form is used in this by-law to designate women, men, and non-binary people. Enregistrement et permis - chiens 4(1) Tout résident de Vallée-desRivières ne peut être propriétaire d'un chien sans être titulaire d'un permis valide de garde de ce chien tel que le prévoit le présent arrêté. - 4(2) Les redevances sont : - a) Vingt dollars (20$) pour la vie de l'animal. - b) Dix dollars (10S) pour remplacer une plaque d'identification perdue - c) Cette disposition ne s'applique pas à une personne aux prises ave des difficultés physiques psychenge ou ast animal de soutien spécialement dressé pour l'aider, nià un chien utilisé pour le maintien de l'ordre. 4(3) - a) Une demande de permis doit être faite auprès de la ville de Vallée-desRivières pour chaque chien en la possession du propriétaire. - b) Lors d'une demande de permis, la ville Vallée-des-Rivières devra délivrer un permis au demandeur avec plaque d'identification démontrant le numéro sous lequel le chien est enregistré, ainsi que le nom de Vallée-des-Rivières. 4(4) Chaque propriétaire doit s'assurer que son chien porte un collier auquel est attaché le permis courant livré aux termes des présentes pour ce chien. ## 5. Registration and licenses - dogs 4(1) No person residing in Vallée-desRivières shall own a dog without having a valid license for that dog under this bylaw. - 4(2) Registration fees are: - (a) Twenty dollars ($20) for the life of the animal. - (b) Ten dollars ($10) replacement fee for a lost tag. - (c) This provision does not apply to an individual who psychologically challenged and owns a guide-dog or an emotional support animal that has been trained specifically for the purpose of assisting that individual or a dog used to maintain order. 4(3) - (a) Applications for a license will be made to the town of Vallée-des-Rivières for each dog owned. - (b) The town of Vallée-des-Rivières, at the time a dog is registered, shall issue to Rivières. 4(4) A person who becomes the owner of a dog, shall register such dog immediately and pay the registration fees required in subsection 4 (2) (a). ## 5. This subsection shall not apply to seeingeye dogs. - 5(4) No owner shall permit an animal owned by him to be running at large. - 5(5) No owner shall walk his dog in a public place without the dog being secured by a leash having a maximum length of two (2) meters. - 5(6) An owner shall control his dog when walking the animal secured by a leash in a public place. - 5(7) No owner shall permit his animal to chase or run after pedestrians, motor vehicles, bicycles or other. - 5(8) No owner shall permit his animal to bite or attempt to bite any person or other animal. - 5(9) Any person commits an offence under this by-law if they interfere or attempt to interfere with the animal control agent, by-law enforcement officer or peace officer while exercising their functions under this by-law. - 5(10) No person, not being the owner, shall remove a collar or registration tag from any dog - 5(12) Pet-free zones: pets are not allowed on baseball fields, at the pool in the StLeonard ward, inside any municipal infrastructure and any other municipal land where it is indicated by the appropriate signage. Rage et autres maladies transmissibles - 6(1) Tout propriétaire d'un animal de plus de quatre (4) mois, qui n'a pas été vacciné contre la rage doit le faire vacciner - a) dans les dix (10) jours de l'acquisition de l'animal, s'il a plus de quatre (4) mois et chaque année subséquente ou selon les pratiques - 5(13) No person shall place or cause to be placed, on or near their property, any matter which has the effect of attracting pigeons or seagulls thereto. - 5(14) No person shall feed cats running at large thereby attracting them to a property other than their owner's. - 5(15) That an authorization be obtained from the Vallée-des-Rivières Council to harbour any animal other than a domestic animal or pet as described in section 2(a). - 5(16) No one shall keep or have in his ossession a wild or exotic animal on treet, a sidewalk or any other publi place or allow it to be in such a location, unless the animal is in a case, cage or other designed to completely confine such animal. - 5(17) No one shall ride or walk a horse in disposed of in a sealed bag in an appropriate location. - 5(18) Notwithstanding section 5(17), no one shall ride a horse in parcs and on sidewalks. - 5(20) No person shall in any manner conduct, promote or participate in a contest involving fighting between animals and all contests involving fighting between animals are prohibited. ## 6. No one will be issued a registration tag without the official receipt. 9. 6(3) An owner who neglects or refuses to have his animal vaccinated against rabies under this section is guilty of an offence. 10. 6(4) The animal constable shall seize and impound any cat or dog that is known to be rabid and cause such animal to be quarantined or destroyed. 11. 6(5) The cost for impounding and seizing such dog or cat shall be the same as described in section 7. 6(6) - (a) Where an animal is suffering from any communicable disease, the owner shall not permit the animal to be in any public place and shall not permit the animal to be with, or in proximity of, any other animal. - (b) A person who owns an animal that is rabid or suspected to be rabid or has been exposed to rabies shall immediately report the matter to the District Health Officer and the animal control agent. 7. Seizing and Impounding - dogs - 7(1) Any dog found running at large may be seized and impounded by the animal control agent. - 7(2) If the owner of a seized dog is known, the animal control agent or the Municipality shall make a reasonable attempt to notify them that their dog has been seized and impounded within 24 hours of the animal being impounded. - 7(3) Le propriétaire d'un chien mis en fourrière peut le réclamer et l'en retirer après avoir: - juge satisfaisante; - b) payé un droit de récupération tel qu'exigé par l'agent de contrôle des animaux. - c) payé les frais exigés par un chenil indépendant lorsque utilisé par la Municipalité, pour chaque jour qu'un animal est mis en fourrière. - d) payé, le cas échéant, tous les frais pour les soins ou la vaccination. 7(4) - a) L'agent de contrôle ou la tout animal mis en fourrière qui n'a pas été réclamé dans les 72 heures de sa saisie. - b) Lorsqu'un animal n'ayant pas été - c) Si un animal blessé est saisi par l'agent de contrôle, ledit animal pourra être euthanasié si le vétérinaire est d'avis: 4. (a) establish ownership to the satisfaction of the animal control agent. 9. (b) pay the reclaiming fee to the animal control agent. 10. (c) pay the boarding fee as charged by an independent kennel used by the Municipality, for each day the animal is impounded. 11. (d) pay all costs for medication and vaccinations where applicable, and 12. (e) if the seized animal is an unlicensed dog, pay the animal control agent or the Municipality the applicable fee for a license as required under this by-law. 7(4) - (a) An impounded animal which has no seen claimed within 72 hours of the time given to the care of the SPCA or destroyed. - (b) Under this section, when destroying any animal that has not been claimed or for any other reason, the animal control agent shall do so in a humane manner. - (c) If an injured animal is seized by the animal control agent, the animal may be destroyed if it is the opinion of the Veterinarian that: - (i) it is unlikely to recover from its injuries; or, - (i) it would be inhumane to impound said animal for 72 hours without treatment and the owner is unknown or cannot be found. - 7(5) The animal control agent is authorized to make use of any tranquilizing devices on an animal in the course of carrying out his duties hereunder and shall not be held responsible for any damages caused to the animal while doing so. - 7(6) Lorsque le propriétaire est connu, un animal mort (euthanasié ou par accident « roadkill ») sera remis à son propriétaire pour que celui-ci en dispose de la manière appropriée de son choix. l'animal n'a aucun propriétaire, celui-ci sera disposé dans le respect, à un endroit approprié par l'agent de contrôle des animaux. - 7(7) La personne autorisée en vertu du présent arrêté à capturer et à mettre en fourrière un animal n'est tenue de verser des dommages-intérêts à l'égar‹ les blessures ou dommages causés à ce animal pendant sa capture ou sa mise en fourrière. - 7(8) Quiconque achète un chien mis en fourrière le fait immatriculer et paie, avant de prendre possession du chien, le droit de permis prévu à l'alinéa 4(2)a). ## 8. Chiens dangereux - 8(1) Le propriétaire d'un chien dangereux doit s'assurer de ce qui suit : - a) en dehors du terrain du propriétaire, le chien doit être muselé en tout temps; b) en dehors du terrain du propriétaire, le chien doit en tout temps être retenu par une laisse d'au plus un (1) mètre e tre sous le contrôle d'une personne responsable de plus de dix-huit (18) ans; - c) sur le terrain du propriétaire, le chien doit être, soit enfermé de manière sécuritaire à l'intérieur du domicile, soit mis dans un enclos ou une structure sécuritaire fermée et verrouillée qui empêche un chien dangereux de s'échapper et une personne qui n'a pas le contrôle du chien d'y pénétrer. Cet enclos ou cette structure doit mesurer un minimum deux (2) mètres par quatre (4) mètres et les côtés et le dessus doivent être sécuritaires. Si les côtés de l'enclos ou de la structure ne sont pas rattachés au fond, ils doivent être fixés dans le sol à au moins trente centimètres (30 cm) de profondeur. L'enclos doit aussi offrir au chien une protection contre les éléments. If the animal is ownerless, it shall be disposed of with respect by the animal control agent, in an appropriate location. 3. 7(7) No person authorised under this bylaw to capture and impound an animal shall be liable in damages for any injury or damage to such animal while the same is being captured or impounded. 4. 7(8) Every person who purchases an impounded dog shall register such dog and pay the licence fee as set out in paragraph 4(2)(a) prior to taking possession of the dog. 8. Dangerous dogs 6. 8(1) The owner of a dangerous dog shall ensure that: 7. (a) at all times when off the owner's property, the dog shall be muzzled. 8. (b) at all times when off the owner's property, the dog shall be on a leash not longer than one (1) metre and under the control of a responsible person over the age of eighteen (18); 9. (c) when such dog is on the property of the owner, it shall be either securely confined indoors or in a securely enclosed and locked pen or structure, suitable to prevent the escape of the dangerous dog and capable of preventing the entry of any person not in control of the dog. Such pen or structure must have minimum dimensions of two (2) metres by four (4) metres and must have secure sides and a secure top. If it has no bottom secured to the sides, the sides must be embedded into the ground no less than thirty centimetres (30cm) deep. The enclosure must also provide protection from the elements for the dog. (b) Any peace officer or by-law enforcement officer is hereby authorized to take such actions, exercise such powers and perform such duties, as may be set out in this by-law or in the Local Governance Act and as they may deem necessary to enforce any provision of this bylaw. ## 10. Penalties and Offences 10(1) Any person or persons, corporation, partnership, or society who violates any of the provisions of this bylaw is guilty of an offence and is liable on summary conviction to a fine not to exceed the maximum fine that may be imposed for commission of an offence punishable under Part II of the Provincial Offences Procedures Act as a Category D offence. 10(2) If a person is convicted of a violation of this by-law, a judge of the Provincial Court may, in addition to or instead of imposing a fine, order that the animal in respect of which the offence was committed be disposed of or destroyed. - 10(3) Le juge d'une Cour provinciale qui est saisi d'une plainte selon laquelle un chien a mordu ou tenté de mordre une personne peut, sur constatation que la plainte est justifiée, ordonner : - a) que le propriétaire du chien le garde sous surveillance; ou - b) que le propriétaire ou gardien du chien ou autre personne euthanasie le chien aux frais du propriétaire. ## 11. Administrative penalties 11(1) The Municipality may require an administrative penalty to be paid for violating a provision of this by-law as set out in subsection 11(2). - 11(2) Unless otherwise indicated, a person who violates any provision of this by-law may pay to the municipality, within 45 calendar days from the date of such violation, an administrative penalty in the amount of $250 for the Is offence, $500 for the 2nd offence and $1,000 for the 3rd and each subsequent offence and, upon such payment, the person who committed the violation is not liable to be prosecuted thereafter. ## 12.
