L'adoption du présent arrêté abroge les arrêtés suivants : Arrêté 22-1 du village de Sainte-Anne-deMadawaska et ses modifications; Arrêté 56-2016-STL de la ville de SaintLéonard et ses modifications; 2. The id by a vot The adoption of this by-law repeals the y-law 22-1 of the village of Sainte-Anne-de adawaska and its amendments 3y-law 56-2016-STL of the town of Saint Leonard and its amendments; 2. The repeal of the by-laws mentioned above shall not affect any penalty, forfeiture, or liability incurred before such repeal or any proceeding for enforcing the same, completed or pending at the time of repeal; nor shall it repeal, defeat, disturb, invalidate or prejudicially affect any matter or thing whatsoever completed, existing or pending at the time or repeal 3. In case of a problem of interpretation, the French version shall apply. ## 1.0 DEFINITIONS - 1.1 Dans le présent arrêté, les définitions suivantes sont applicables: - a) "ACNOR" désigne l'Association canadienne de normalisation; - b) "branchement" désigne le raccordement des conduites d'eau et/ou d'égouts à partir du bien-fonds du propriétaire au réseau municipal d'eau ou d'égouts; - c) "client" désigne un propriétaire ou un abonné qui reçoit ou a reçu des services d'eau et/ou d'égouts de la municipalité et qui peut être un particulier, une association, organisation, corporation, etablissement, commerce une entreprise, société ou société en nom collectif; - b) "connection" means the linking of the water and/or sewer pipes from the owner's property to municipal water or sewer system; - c) "customer" means an owner or a consumer that is receiving or has received water and/or sewer services from the municipality and who can be an individual, association, organization, corporation, institution, business or enterprise, a corporation or a partnership; - d) "owner" means the person in whose name land is assessed under the Assessment Act and includes his heirs, successors, executors, directors and assigns; - e) "person" means an individual, association, partnership, corporation, municipality, Provincial or Federal agency, o an agent or employee thereof; - f) "code" means the National plumbing code of Canada in effect; - g) "council" means the Vallée-desRivières Town Council; - h) "contract" means an agreement use of such services by a customer also constitutes an agreement; - i) "director" means the direcror/clerk named by the council and/or his designated representatives; - i) "uncontaminated water" means water to which nothing has been added as a consequence of its use, or that no one has modified its use; - p) "operator" means the operator of any facility or activity subject to the provisions of this by-law and includes the executors, directors and assigns of such person; - 9) "service charges" means the cost of providing service per contract or established customer, that water consumption is metered, for a fixed period as specified in the rate schedule; Si aucun accès n'est aménagé, la ne sera pas des causés aux biens immobiliers résultant d'une telle omission ou négligence. ## SECTION 3 ## 3. If access installed, municipality will not be liable for any damage to property resulting from ## SECTION 3 ## 3. CONTRACT - 3.1 Any customer connected to the water and sewer services is automatically deemed to have entered into a contract with the municipality for the provision of these services. A contract is deemed to exist between the customer and the nunicipality for the supply of water and ewer services at such rates and fo such charges as are determined by this by-law. - 3.2 The owner of the building is responsible for the invoice for the water and sewer services of the property, even if the property is occupied by someone else other than the person itself or the family. No agreement between the owner and the tenant will be recognized by the municipal council. The invoices for the water and sewer services are a charge against the property and can be collected by the law as are the property taxes. perçues en loi comme le sont les taxes sur la propriété. ## SECTION 4 ## 4. La municipalité de Vallée-des-Rivières s'engage à fournir un service d'approvisionnement en eau fiable et circonstances indépendantes de sa volonté -- telles qu'un accident, une grève, un bris d'équipement, une pénurie d'eau ou tout autre événement imprévu -- pourraient entraîner une interruption temporaire du service. Dans de tels cas, la municipalité ne pourra être tenue responsable, mais elle mettra tout en uvre pour rétablir le service dans les meilleurs délais. 3. The subscriber consents to pay his or her account for the supply of water before the due date indicated on the invoice, and further agrees to comply with all applicable bylaws, all policies, rules and regulations pertaining to the water service put into force by the municipality and to the following stipulations. 2. The Municipality of Vallée-des-Rivières is committed to providing a reliable and safe water supply service. However, despite every effort, certain circumstances beyond its control such as accidents, strikes, equipment failure, water shortages, or other unforeseen events -- may lead to temporary service interruptions. In such cases, the municipality cannot be held responsible but will do everything possible to restore service as quickly as possible. 3. During the term of this agreement, the subscriber hereby authorizes free access on his or her properties to the agents or employees of the municipality in order to do the necessary work and to remove all instruments or accessories owned by the municipality. 4.
