1 TOWN OF BONAVISTA REG-03 GARBAGE AND REFUSE REGULATION REG-03 PUBLISHED BY AUTHORITY The following regulations have been made by the Town Council of Bonavista under the provisions of the Local Government Act 1966 and were approved by me on the 28th day of June A.D., 1966. B.J. ABBOTT Minister of Municipal Affairs and Supply 1. Interpretations: In these Regulations unless the context otherwise requires: a. "Act" means the Local Government Act, 1966. b. "Town means the Town of Bonavista as defined by paragraph 2 or Order-in-Council, dated the 24th day of November, A.D., 1964, and made under the Local Government Act, 1966. c. "Council" means the Town Council of Bonavista. d. "Sanitary Inspector" means any person appointed as such by the Council. e. "Garbage" means every waste, accumulation of animal, fruit or vegetable matter, liquid or otherwise that attends the preparation, use, cooking, dealing in or storing of meat, fish, fowl, fruit, or vegetables. And including tin cans, bottles, and similar food containers. 2 TOWN OF BONAVISTA REG-03 f. "Refuse" means all other miscellaneous waste material not specifically defined as garbage. g. "Owner" included agent, tenant, or occupant. 2. No person, firm or corporation shall deposit, throw sweep, or place any garbage upon any street, lane, drain, public place or private property outside of buildings within the Town, unless the dame is enclosed in suitable containers. 3. All wet garbage shall be thoroughly strained and wrapped in paper or other suitable material, and securely tied, before placing it in garbage containers. 4. Subject to Regulation 5 of these Regulations, no person, firm or corporation shall deposit, throw, sweep, or place any refuse upon any street, lane drain, public place or property outside buildings within the town unless the same is enclosed in boxes, barrels or other proper receptacles in such a manner as to in no way constitute a nuisance or announce to others. 5. All garbage and refuse shall be disposed of at intervals not exceeding one week by the owner of any building or place of business in any of the following manners: a. By placing it near the side of the street, and road or lane, or where that is impossible on the property of the owner at a distance not more than ten feet from the side of such street, road, or lane, at a time not later than 9:00 A.M. on the day designated by the Council for garbage collection. b. By disposal at the dump designated by the Council. 3 TOWN OF BONAVISTA REG-03 c. By burning or burial under and in accordance with a permit in writing from Council. Provided that garden waste and broken or discarded household furniture or furnishings may be retained and placed for collection at a period of the year to be specified by the Council as "Clean-up-week" unless otherwise ordered by the Sanitary Inspector. 6. All garbage containers shall be removed by the owner of every building or place of business as soon as possible after garbage collection. 7. No person, firm or corporation shall place in any container or receptacle, garbage or refuse intended for removal by the Council the weight of which, together with that of the container or receptacle will exceed sixty pounds. 8. Every box, barrel or other receptacle containing refuse intended for removal by the Council shall be packaged or tied in such a manner in no way hinder or impose such removal. 9. Garbage or refuse left by any builder or contractor, or owner upon any street, lane, drain, public place or private property outside of a building within the Town following the construction, alteration, or repair of such building, shall be removed by the builder, contractor, or owner as promptly as possible. 10. No person, firm or corporation shall place or cause to be placed, any garbage or refuse on a Town Dump without first having received a special permit from the Council. 11. No person, other than the employees of the Council authorized for the purpose, shall pick over, remove, disturb, or otherwise interfere with any garbage or refuse placed for removal by the Council whether or not it is enclosed in receptacles or containers. 4 TOWN OF BONAVISTA REG-03 12. No person, firm or corporation shall enter upon or remove any garbage or refuse from the Town Dump unless authorized to do so by the Council. 13. a. The Sanitary Inspector may at the time order the owner to clean up and remove any accumulation of garbage or refuse outside any building or buildings within the Town. b. If the owner neglects or refuses, when ordered by the Sanitary Inspector, to clean up and remove any accumulation of garbage or refuse from his promises, the Sanitary Inspector may cause the clean-up and removal of such accumulation at the expense of the owner. 14. Any person who is guilty of an offence against these Regulations or who acts in contravention of or fails to comply with any provision thereof, or neglects or refuses to do so shall be liable on summary conviction to a fine not exceeding One Hundred Dollars and in default of payment to imprisonment for a period not exceeding ninety days or to both such fine and imprisonment. 15. These Regulations shall come into effect on the 1st day of July A.D., 1966 and may be cited as the Town of Bonavista (Garbage and Refuse) Regulations, 1966.
