## NOISE AND NUISANCE REGULATIONS
REG-11 (2022)
## PUBLISHED BY AUTHORITY
Pursuant to the authority conferred by Section 414 of the Municipalities Act, 1999, Chapter M24, the Town of Bonavista has made the following regulations.
## 1. TITLE
Regulations". These regulations shall be known and cited as the "Town of Bonavista Noise and Nuisance
## 2. INTERPRETATION
In these regulations, unless the context otherwise requires:
- a. "Act" means the Municipalities Act.
- b. "Regulations" means the Town of Bonavista Noise and Nuisance Regulations.
- c. "Council" means the Town Council of Bonavista.
- d. "Town" means the Town of Bonavista as defined by Order-in-Council dated the 24th day of November 1964 or any amendments thereto made or continued under The Municipalities Act;
- e. "Vehicle" means a device in, upon, or by which person or property may be transported or drawn upon a highway and includes motorized snow vehicles or allterrain vehicles.
- f. "Nuisance" means anything or any condition of things which is or may become injurious or dangerous or presents an obstruction to pedestrians or vehicular traffic or anything or any condition of things that, in the opinion of Council, has an
unpleasant effect on the senses or adversely affects the amenities of the surrounding property.
## 3. REGULATIONS
- a. No person shall do or cause to be done anything which cases a nuisance, and to emit excessive noises from properties, vehicles or equipment, or odors or fumes likely to cause discomfort to members of the public.
- b. No person shall cause noise within the Town through the use of firearms or other similar noise-making devices, except as may be approved by Council and subject to the approval of law enforcement or other regulatory agencies.
- c. No person shall create noise within the municipality through the use of shouting or noise-making devices, for the purpose of selling wares, soliciting business, or attracting attention except as may be approved by Council.
- d. No person shall create noise within the town, through the use of a motor vehicle that has no muffler or a defective muffler, except as may be necessary, in the opinion of Council, to move such motor vehicle to a location for associated repairs, subject to the approval of law enforcement officials under the Highway Traffic Act.
- e. No person shall create noise within the Municipality through the squealing of tires of a motor vehicle, which in the opinion of Council, is caused by unnecessary braking, turning, or setting in motion of such motor vehicle.
- f. No person shall keep or permit to be kept in any building premises or yard or any part thereof in the Town any dog which by reason by barking or howling is a nuisance to persons in the Town.
## 4. EXCEPTIONS
Nothing in these Regulations shall be deemed to prohibit:
- a. The sounding of any bell, horn, siren, or other warning device of any vehicle the law requires, or when responding to an emergency;
- b. The ringing of church bells or chimes;
- c. Outdoor events (public worship services, concerts, festivals, etc.) involving sound reproduction devices conducted in a commercial or industrial zone or in a recreational area as approved by Council.
- d. The sounding of motor vehicle horns in a wedding procession or in parades/services permitted by Council;
- e. Musicians or performers providing outdoor entertainment involving sound reproduction devices during events staged by or on behalf of the Town;
- f. The clearing of snow by heavy equipment.
## 5. PENALTIES
In accordance with Section 419 of the Act, any person who contravenes or fails to comply with any of the provisions of these regulations is guilty of an offence and is liable on summary conviction as per Section 420 of the Act.
## 6. AMENDMENT OF RULES
Any motion to amend these rules must be presented to Council in accordance with Section 413 of The Municipalities Act.
## 7. EFFECTIVE DATE
These rules and regulations shall become effective upon the date of enactment and may be known and cited as the "Town of Bonavista Noise and Nuisance Regulations". All previous Town of Bonavista Noise and Nuisance Regulations and amendments are repealed.

Amended and adopted by the Town Council of the Town of Bonavista on the 4th day of July, 2022 and to come into effect as of the 4th day of July, 2022.
A copy of these Regulations was sent to the Minister of Municipal and Provincial Affairs on the 14th day of July, 2022.
