<!-- image --> ## TOWN OF BURIN ANIMAL CONTROL (CAT)REGULATIONS ## PUBLISHED BY AUTHORITY Pursuant and by virtue to the powers conferred by Section 8 of the Towns and Local Service Districts Act, Chapter T-6.2, the Town of Burin hereby enacts the following Regulations which were adopted at a Public Council Meeting held on May 20, 2026. ## 1. TITLE These Regulations shall be known and cited as the "Town of Burin Animal Control (Cat) Regulations." ## 2. INTERPRETATIONS The Town of Burin's Animal Control (Cat) Regulations operate under the authority of the Animal Health and Protection Act to ensure consistent standards of animal health and welfare. In these Regulations, the following words, unless the context otherwise requires, shall have the following meanings: - (a) "Act" means the Towns and Local Service Districts Act, Chapter T-6.2. - (b) "Council" means the Town Council of the Town of Burin. - (c) "Town" means the Town of Burin as defined by Paragraph 2 of an Order-in-Council dated the 18" day July A.D., 1950. - (d) "Impounder" means the Animal Control Officer or any person appointed as such by Council. - (e) "Cat" means any domestic cat. - (f) "Owner", when used in reference to the ownership of a cat, includes any person who has custody, charge or possession of a cat or who is the owner of any house or premises, or part of premises, where any cat is kept or permitted to live or remain, except where such person proves to the satisfaction of a Provincial Court Judge or Council, that he/she is not the owner of the cat. - (g) "Pound" means any building designated and maintained by the Council for the purpose of the impounding and keeping of cats. - (h) "Town Manager" means the Town Manager of the Town of Burin or his/her duly authorized agent whose duty it shall be to see that these regulations are implemented and enforced. ## 3. KEEPING OF CATS - No cat shall be allowed to cause a nuisance. The owner of every cat shall be held responsible for the behavior and keeping of such cat under control. - A cat shall be considered a nuisance if it damages, defiles or defaces private property other than the owner's or causes an annoyance to persons in the neighbourhood by loud or frequent meowing, or interferes with persons on private or public property. ## 4. SEIZING OR IMPOUNDING - The Impounder may seize and impound any cat found at large in the Town and may enter any premises to recapture any cat that may escape from his/her control. For the purpose of these Regulations, a cat shall be deemed to be at large when off the premises of its owner and not caged or kept on a suitable leash or harness or under the control of a responsible person. - Any cat found causing a nuisance (as defined in Regulation 3) on private property may be seized by the injuriously affected person or persons and held to be picked up by the Impounder. - The Impounder shall make a record on each identifiable cat impounded, indicating details on collar (if any), a basic description of the cat and the date it was impounded. - The owner may recover an impounded cat upon providing the Impounder with such evidence of ownership of the cat as the Impounder may require and upon payment of all fees in connection with the impoundment and keep of the cat. ## 5. SEIZING AND IMPOUNDING FEES The following seizing and impounding fees shall be paid by the owners of cats seized or impounded, or deducted from the proceeds of any sales of such cats: - First Offence - - Second Offence - - Third Offence - - Daily Pound Fee - $50.00 $100.00 $200.00 $25.00 - The Impounder shall keep any unclaimed cat in the pound for a period of 72 hours. After the expiration of such period, the cat may be sold or destroyed, however, the Impounder may destroy immediately any cat which has been impounded three times or more during a calendar year. - The Impounder may destroy any cat found at large within the Town, or any cat impounded, if, in his/her opinion, such cat is so diseased, injured or vicious or in such condition that it ought to be destroyed. ## 6. AUTHORIZATION TO DESTROY &amp; METHOD - Any cat to which these regulations apply may be destroyed by any Police Constable or any person authorized in that behalf, save that this Regulation shall not apply to cats under the age of four (4) months. - Where any person is authorized to destroy a cat under these Regulations, he/she shall do so in a manner as humane as possible and follow the methods approved by the SPCA. - The carcass of any destroyed cat shall be disposed of by burying or burning. It shall not be placed in the sea or in any pond, lake, river or stream or any water which flows into the sea or any watershed area. ## 7. PROSECUTION &amp; PENALTY - Prosecution for offences under these Regulations may be carried out by a Council or its agent or a Police Constable. - Every person who contravenes or fails to comply with any of the provisions of these Regulations is guilty of an offence and liable on summary conviction, where no penalty is otherwise provided, to a fine not exceeding one thousand dollars or , in default of payment, to a period of imprisonment not exceeding ninety days, or to both such fine and period of imprisonment. - The conviction of a person under this Section does not operate as a bar to further prosecution for the continued failure on the part of the person to comply with the Regulations. ## 8. REVIEW AND AMENDMENTS All section of these Regulations have been developed in accordance with the Towns and Local Service Districts Act and the Animal Health and Protection Act. These Regulations are reviewed as required following new information or knowledge. ## 9. PUBLICATION These Regulations will be published on the Town of Burin website in 2026. ## 10. ENACTMENT All previously adopted Animal Control (Cat) Regulations for the municipality are hereby repealed. These Regulations came into effect once adopted by motion of Council (Motion #202605-081), voted on by the majority of Councillors in attendance at the Town Public Council meeting on May 20, 2026.
