<!-- image --> ## TOWN OF BURIN ANIMAL CONTROL (DOG)REGULATIONS ## PUBLISHED BY AUTHORITY Pursuant and by virtue to the powers conferred by Section 8 of the Towns and Local Service Districts Act, Chapter T-6.2, the Town of Burin hereby enacts the following Regulations which were adopted at a Public Council Meeting held on May 20, 2026. ## 1. TITLE These Regulations shall be known and cited as the "Town of Burin Animal Control (Dog) Regulations." ## 2. INTERPRETATIONS The Town of Burin's Animal Control (Dog) Regulations operate under the authority of the Animal Health and Protection Act to ensure consistent standards of animal health and welfare. In these Regulations, the following words, unless the context otherwise requires, shall have the following meanings: - (a) "Act" means the Towns and Local Service Districts Act, Chapter T-6.2. - (b) "Council" means the Town Council of the Town of Burin. - (c) "Town" means the Town of Burin as defined by Paragraph 2 of an Order-in-Council dated the 18"" day July A.D., 1950. - (d) "Impounder" means the Animal Control Officer or any person appointed as such by Council. - (e) "Dog" means any dog, male or female and includes an animal which is a cross between a dog and a wolf. - (t) "Owner", when used in reference to the ownership of a dog, includes any person who has custody, charge or possession of a dog or who is the owner of any house or premises, or part of premises, where any dog is kept or permitted to live or remain, except where such person proves to the satisfaction of a Provincial Court Judge or Council, that he/she is not the owner of the dog. - (g) "Pound" means any building designated and maintained by the Council for the purpose of the impounding and keeping of dogs. - (h) "Town Manager" means the Town Manager of the Town of Burin or his/her duly authorized agent whose duty it shall be to see that these regulations are implemented and enforced. ## 3. TETHERING Every owner of a dog within the Town shall keep such dog safely tethered or penned at all times except under the following conditions: - It is held on a leash by a person capable of restraining its movements. - It is being used by a person for the purpose of lawful hunting. - It is being used by a person to work in a lawful manner with sheep. ## 4. SEIZING OR IMPOUNDING - The Impounder may seize and impound any dog found at large in the Town and may enter any premises for the purpose of recapturing any dog that may escape from his/her control. - Any dog found damaging or destroying private property may be seized by the injuriously affected person or persons and held for collection by the Impounder. - When a dog has been impounded, the Impounder shall make a record of such impounding in a book kept for that purpose and may then, but shall not be bound to, advertise that such dog has been impounded. It shall be the responsibility of the owner to find out if their pet is impounded. - The owner may recover an impounded dog upon providing the Impounder with such evidence of ownership of the dog as the Impounder may require and upon payment of all fees in connection with the impoundment and keep of the dog. ## 5. SEIZING AND IMPOUNDING FEES The following seizing and impounding fees shall be paid by the owners of dogs seized or impounded, or deducted from the proceeds of any sales of such dogs: | - First Offence - | $50.00 | |---------------------|----------| | - Second Offence - | $100.00 | | - Third Offence - | $200.00 | | - Daily Pound Fee - | $25.00 | - The Impounder shall keep any unclaimed dog in the pound for a period of 72 hours. After the expiration of such period, the dog may be sold or destroyed, however, the Impounder may destroy immediately any dog which has been impounded three times or more during a calendar year. - The Impounder may destroy any dog found at large within the Town, or any dog impounded, if, in his/her opinion, such dog is so diseased, injured or vicious or in such a condition that it ought to be destroyed. ## 6. AUTHORIZATION TO DESTROY &amp; METHOD - Any dog to which these regulations apply may be destroyed by any Police Constable or any person authorized in that behalf, save that this Regulation shall not apply to dogs under the age of four (4) months. - In any proceeding under these Regulations, the proof that a dog is under the age of four (4) months shall be upon the owner of the dog or the person having possession thereof. - Where any person is authorized to destroy a dog under these Regulations, he/she shall do so in a manner as humane as possible and follow the methods approved by the SPCA. - The carcass of any dog destroyed shall be disposed of by burying or burning. It shall not be placed in the sea or in any pond, lake, river or stream or any water which flows into the sea or any watershed area. ## 7. PROSECUTION &amp; PENALTY - Prosecution for offences under these Regulations may be carried out by a Council or its agent or a Police Constable. - Every person who contravenes or fails to comply with any of the provisions of these Regulations is guilty of an offence and liable on summary conviction, where no penalty is otherwise provided, to a fine not exceeding one thousand dollars or, in default of payment, to a period of imprisonment not exceeding ninety days, or to both such fine and period of imprisonment. - The conviction of a person under this Section does not operate as a bar to further prosecution for the continued failure on the part of the person to comply with the Regulations. ## 8. REVIEW AND AMENDMENTS All sections of these Regulations have been developed in accordance with the Towns and Local Service Districts Act and the Animal Health and Protection Act. These Regulations are reviewed as required following new information or knowledge. ## 9. PUBLICATION These Regulations will be published on the Town of Burin website in 2026. ## 10. ENACTMENT All previously adopted Animal Control (Dog) Regulations for the municipality are hereby repealed. These Regulations came into effect once adopted by motion of Council (Motion #202605-081), voted on by the majority of Councillors in attendance at the Town Public Council meeting on May 20, 2026.
