<!-- image --> ## TOWN OF BURIN LIVESTOCK REGULATIONS ## PUBLISHED BY AUTHORITY Pursuant and by virtue to the powers conferred by Section 8 of the Towns and Local Service Districts Act, Chapter T-6.2, the Town of Burin hereby enacts the following Regulations which were adopted at a Public Council Meeting held on May 20, 2026. ## 1. TITLE These Regulations shall be known and cited as the "Town of Burin Livestock Regulations." ## 2. INTERPRETATIONS In these Regulations, the following words, unless the context otherwise requires, shall have the following meanings: - (a) "Act" means the Towns and Local Service Districts Act, Chapter T-6.2. - (b) "Council" means the Town Council of the Town of Burin. - (c) "Town" means the Town of Burin as defined by Paragraph 2 of an Order-in-Council dated the 18t day July A.D., 1950. - (d) "Impounder" means the Animal Control Officer or any person appointed as such by Council. - (e) "Livestock"means any domestic sheep, goats, cows, horses, swine, fur bearing animals raised in captivity, poultry and other domestic animals kept for farm purposes but shall not be held to mean dogs and cats. - (f) "Town Manager" means the Town Manager of the Town of Burin or his/her duly authorized agent whose duty it shall be to see that these regulations are implemented and enforced. - (g) "Nuisance" means any obnoxious substance, animal waste, unsanitary matter or noise caused by any animal that has an unpleasant effect on the senses. - (h) "Peace Officer" means a member of the Royal Canadian Mounted Police in the Province. ## 3. REGULATIONS The Town of Burin's Livestock Regulations operate under the authority of the Animal Health and Protection Act to ensure consistent standards of animal health and welfare. 1. The impounder may seize and impound any animal found at large contrary to these Regulations and may enter upon any property for the purpose of capturing any animal that they were in pursuit of or had escaped from their control. 2. When an animal has been impounded, the impounder shall make a record of such impounding in a book kept for that purpose and may then, but shall not be bound to, advertise that such animal has been impounded. 3. Any animal found damaging or destroying private property may be seized by the injuriously affected person or persons and held for collection by the impounder. 4. No person shall keep, or permit to be kept, in any building, premises or yard, or any part thereto, any animal, which by that reason, then becomes a nuisance to persons in the neighbourhood. 5. Council may limit the number of animals kept on any residential or private property within the Town of Burin. 6. Any animal that has been seriously injured or diseased can be destroyed immediately, if, in the opinion of the Animal Control Officer, it is the most humane thing to do. 7. The animal owner shall be held responsible to provide medical assistance to an injured or diseased animal and in no way will the Town be held liable. 8. A Peace Officer or Animal Control Officer, who is authorized to destroy an animal under these Regulations, shall do so in a manner as humanely as possible. 9. The carcass of any animal destroyed shall be disposed of by burying or burning; it shall not be placed in the sea or any pond, lake river or stream or any water which flows into the sea. 10. Any person who has custody, charge or possession of any animal or who is the owner or occupant of any house or premises where an animal is kept or permitted to live or remain shall be deemed to be the owner of the animal for the purposes of these Regulations unless they prove that they are not the owner of the animal. ## 4. OFFENCES AND PENALTIES ## Offences A person commits an offence if they: - Allow livestock to run at large - Fail to maintain proper containment - Keep livestock in prohibited zones - Fail to comply with permit conditions - Obstruct an enforcement officer ## Penalties Council may impose: - Fines up to $500 for a first offence - Cost recovery for impoundment, transportation, and damages - Fines up to $1,000 for subsequent offences ## Inspections Council or its authorized officers may enter property at reasonable times to: - Inspect livestock conditions - Verify compliance with these regulations - Investigate complaints ## 5. REVIEW AND AMENDMENTS All section of these Regulations have been developed in accordance with the Towns and Local Service Districts Act and the Animal Health and Protection Act. These Regulations are reviewed as required following new information or knowledge. ## 6. PUBLICATION These Regulations will be published on the Town of Burin website in 2026. ## 7. ENACTMENT All previously adopted Livestock Regulations for the municipality are hereby repealed. These Regulations came into effect once adopted by motion of Council (Motion #202605-081), voted on by the majority of Councillors in attendance at the Town Public Council meeting on May 20, 2026.
