<!-- image --> ## TOWN OF BURIN SNOW CLEARING REGULATIONS ## PUBLISHED BY AUTHORITY Pursuant and by virtue to the powers conferred by Section 8 of the Towns and Local Service Districts Act, Chapter T-6.2, the Town of Burin hereby enacts the following Regulations which were adopted at a Public Council Meeting held on April 1, 2026. ## 1. TITLE These Regulations shall be known and cited as the "Town of Burin Snow Clearing Regulations." ## 2. DEFINITIONS In these Regulations, the following words, unless the context otherwise requires, shall have the following meanings: - (a) "Act" means the Towns and Local Service Districts Act, Chapter T-6.2; - (b) "Council" means the Town Council of the Town of Burin; - (c) "Town" means the Town of Burin as defined by Paragraph 2 of an Order-in-Council dated the 18th day July A.D., 1950. - (d) "Highway" means a highway as defined by the Highway Traffic Act and, for the purpose of these regulations, means a highway under the jurisdiction of Council; - (e) "Street Reservation" means the land reserved by Council for a highway, street, lane or sidewalk; - (f) "Vehicle" means a device in or upon which a person or property be transported or drawn upon a highway. ## 3. REGULATIONS - (a) During the period from the first (1) day of December in each year to and including the last day of March in the succeeding year, both days inclusive, no person shall park an unattended vehicle upon any highway/street reservation within the Town. - (b) No personal shall leave a vehicle standing upon a highway in such a position that it may hinder or impede the plowing of or removal of snow or ice from the thoroughfare. Any unattended vehicle parked on any street reservation with the Town in contravention of these Regulations may be removed and impounded by the Council and the cost of such removal and impounding may be recovered from the owner as a civil debt. - (c) During the period from the first (1) day of December in each year, to and including last day of March in any succeeding year, both days inclusive, no person shall shovel, plow, cause to be shoveled or plowed any residue snow from a driveway or parking lot onto any roadway within the municipal boundaries of the Town of Burin, which is controlled by the Town Council of Burin. - (d) Any person who violates any of the provisions of these regulations is guilty of an offence and liable on summary conviction to a penalty as prescribed by the Highway Traffic Act, plus all expenses incurred by the Town. - (e) All claims for damages must be made on or before May 15"*, for the preceding snow clearing season of each year, in writing to the Town Office. - (f) All fences have to be back a minimum of 17.5 ft. from the centre line, where there is a minimum 35 ft. right-of-way. - (g) The Town will not be responsible for any damage caused within the road right-of-way. This includes damage to fences, garbage boxes, trees, etc... - (h) The Town will not be responsible for damage caused by "weight of snow" or "lawn browning" - (i) The Town will not be responsible for any damage caused to trees on private property if they have not been properly marked and protected with poles, minimum 4 ft. high alongside trees to mark location. - (j) All previously adopted Snow Clearing Regulations for the municipality are hereby repealed. ## 4. REVIEW AND AMENDMENTS All sections of these Regulations have been developed in accordance with the Towns and Local Service Districts Act. These regulations are reviewed as required following new information or knowledge. ## 5. PUBLICATION These Regulations will be published on the Town of Burin website in 2026. ## 6. ENACTMENT These Regulations came into effect once adopted by Motion of Council (Motion #202604-043), voted on by a majority of the Councillors in attendance at the Town Public Council Meeting on April 1, 2026.
