<!-- image --> ## TOWN OF BURIN DANGEROUS OR UNSIGHTLY PROPERTIES BY-LAW BY-LAW NO.: BL-DUP-2026-009 ## ADOPTED BY COUNCIL ON: May 20, 2026 MOTION NUMBER: 202605-081 ## PUBLISHED BY AUTHORITY Pursuant to the authority vested in it under the Towns and Local Service Districts Act, SNL 2023, T-6.2, Section 8, the Town Council of Burin has adopted the following By-Law on May 20, 2026. ## TITLE This document shall be known as the "Dangerous or Unsightly Properties By-Law. ## INTERPRETATION The purpose of this By-Law is to address dangerous or unsightly properties - "Town" shall mean the Town of Burin - "Act" shall mean the Towns and Local Service Districts Act, SNL 2023, T-6.2 - "Council" shall mean the duly elected Town Council of the Town of Burin - "Management" shall mean the Town Manager and/or the Director of Public Works - "Staff" shall mean an employee of the Town of Burin - "Dangerous Property" shall mean a property, structure or other development identified as being dangerous by the Fire Chief of the Burin Volunteer Fire Department, a professional Engineer or any other professional engaged by Council. - "Unsightly Property" shall mean a property which contains the presence and accumulation of objects, vehicles and trailers that are in a wrecked, discarded and abandoned condition as well as litter, garbage, refuse and other debris as determined by Council. ## APPLICATION This By-Law applies to all properties within the municipal boundaries of the Town of Burin. ## PROCEDURE 1. Upon receipt of a complaint regarding a dangerous or unsightly property, Management will contact the property owner to advise them of the complaint received. 2. If it is determined that the property is dangerous or unsightly, correspondence will be sent to the property owner requesting that they submit a written timeline to rectify the condition of the property to the Town within seven (7) days. 3. If no timeline is submitted, the matter will be brought to Council for direction on proceeding. 4. Once the accepted deadline has passed, staff will contact the property owner. If the property owner indicates that the work has been completed, staff will schedule a site visit to confirm. 5. If the property owner indicates that the work has not been completed, or the site visit identifies that the required work has not been completed, additional time may be granted by Management or the matter may be brought to the Council for direction on proceeding, which may result in the issuance of an Order in accordance with the Towns and Local Service Districts Act. 6. At any point in this procedure, Council may issue an Order regarding a dangerous or unsightly property. ## PENALTIES Penalties may be applied in accordance with Division 6 of the Towns and Local Service Districts Act. ## REVIEW AND AMENDMENTS The Town shall, every four years, conduct a review of this By-Law and consider the areas which may be improved or amended. ## PUBLICATION This By-Law was published on the Town of Burin website in 2026. ## COMING INTO EFFECT Under the Towns and Local Service Districts Act, Section 12, this By-Law came into effect once adopted by Motion of Council (Motion #202605-081), voted on by a majority of the Councillors in attendance at the Town Public Council Meeting on May 20, 2026.
