The following regulations have been made by the Town of Carbonear under the provisions of the Section 414(2) (t) of the Municipalities Act, 1999 as amended.
Amended and adopted by the Town Council of the Town of Carbonear on the 17th day of March, 2015.

## Parking of Commercial Vehicle Regulations
1. These regualtions may be cited as the Town of Carbonear Parking of Commercial Vehicle Regulations.
2. In these regulations, unless the context otherwise requires:
3. (a) "Act" means Municipalities Act, 1999, as amended;
4. (b) "Council" means the Town Council of Carbonear;
5. (c) "Highway" means the entire width between the boundary lines of a highway, road, street, avenue, thoroughfare, right of way, parkway, driveway, lane, alley, square, place, bridge, culvert, viaduct, trestle, or causeway, whether or not it is publicly or privately owned and whether or not it is designated or intended for use by the public, if the whole or any part of it is used by the public for the passage of motor vehicles;
6. (d) "Town" means the Town of Carbonear as defined in the Town of Carbonear order O.C. 96-170;
7. (e) "Town Property" means the property, real or personal, owned by the Town;
8. (f) "Commercial Vehicle" means any vehicle that is used or
9. designed for business use or is used in conjunction with a business, trade or profession and includes a bus, truck, delivery van, or wagon, tractor, truck tractor, and trailer whether attached to a truck or not, heavy equipment, construction equipment, but does not include a passenger car, light truck, or van rated to carry less than 1.5 tonnes or recreational vehicle;
10. (g) "PARK" means to permit a commercial vehicle, whether occupied or not, to stand, otherwise than temporaily, for the immediate purpose of, and while actually engaged in loading or unloading goods or taking up or setting down passengers, on a street, highway, or private property.
3. No person shall park or permit to be parked, on land used and or zoned for residential purpose, more than one commercial vehicle whether such vehicle be parked within or
12. without any building or accessory building thereon
4. Notwithstanding s.3 herein, no person shall park any commercial vehicle carrying hazardous, contaminated, or dangerous substances or materials, waste, garbage, or which harbor vermin or pestilence, or which emit noxious, or noisome odours within 100 meters of a residential dwelling
14. unit.
5. No person shall transfer hazardous, contaminated, or dangerous substance or materials from one commercial vehicle to another within the Town of Carbonear except where written permit is provided by the Council and in accordance with approvals from applicable government departments and agencies.
6. No person shall park a commercial vehicle operating refrigeration equipment within 100 metres of a residential dwelling unit.
7. No person shall park or leave standing on any highway within the Town a commercial vehicle (i) in violation of snow clearing regulations; or (ii)in such manner as to obstruct traffic; or (iii) which obstructs the view from residential accesses or driveways of oncoming traffic
8. Nothing in these regulations shall prohibit the operation of emergency vehicles, commercial vehicles owned or operated by the Town, Public Utilities, or any contractor or materials person while engaged in emergency operations or delivery of materials, or maintenance or construction of streets, street improvements or street utilities upon any highway in the Town of Carbonear.
9. No person shall park a commercial vehicle on any highway, except in an industrial area or in a signed commercial loading zone except this does not extend to the use of a highway for deliveries to, or removals from, any premises
20. abutting the highway.
10. Except as otherwise provided herein, no person shall park or permit a commercial vehicle to be parked
22. (i) on any land zoned for residential use; or
23. (ii) in any building used for a residential purpose; or
24. (iii) on any land appurtenant to such building; or
25. (iv) in any accessory building on such land; or
26. (v) on any part of a highway which fronts or is appurtenant to any such building, land or accessory building.
27. All pervious Parking of Commercial Vehicle Regulations are
11. hereby repealed.
12. These regulations were adopted by resolution of Council at a meeting on the 17th day of March, 2015 and shall come into
30. effect on the 18th day of March, 2015.
