## SNOW CLEARING BY-LAWS - These By-Laws may be cited as the Town of CentrevilleWareham-Trinity Snow Clearing By-Laws. 2. Interpretation in these By-Laws, unless the context otherwise requires: - а. "ACT" means the Towns and Local Service Districts Act. - b. "COUNCIL" means the Town of Centreville-Wareham-Trinity - c. "TOWN" means the Town of Centreville-Wareham-Trinity - d. "TOWN ROAD" means any road, turn around, lane, cul de sac etc. which the Town of Centreville-Wareham-Trinity has identified as its responsibility and as measured by the Department of Works, Services, and Transportation as secondary roads within the municipality boundaries. - e. "VEHICLE" means any form of vehicle for the provision of transportation of people, goods or services over a public road. - f. "OBSTRUCTION" means anything placed on a town road or road reservation that may interfere with snow clearing operations. This would include snow mobiles and ATVs. - g. "SNOW CLEARING" will include the removal of snow as well as Salt/Sanding operations. 3. The Town of Centreville-Wareham-Trinity shall clear snow from all town roads within its jurisdiction, subject to the availability of financial resources, workers and equipment 4. On the first trip around town, the main priority is to open all main roads as quickly and efficiently as possible to permit access by emergency Fire and Ambulance Equipment and hence no clean up work will be done on this trip. - If a second or third trip is required, depending on conditions, a "Clean-up" will be started. During this trip employees will be doing what is required to widen town roads and will do their best - to avoid blocking driveways already cleared but will not return to areas to clear wing rolls created while clearing snow with the flyer. - No person shall park any vehicle or place any obstruction on a town road in such a manner as to interfere with, hinder or obstruct snow clearing operations and thereafter until the roads have been completely cleared of snow. - No person shall place snow on town roads in a manner to impede the flow of traffic before snow has been cleared and in no matter after the snow has been cleared. 8. During the period from the first day of December in each year to the thirty-first day of March in the succeeding year, no person shall park an unattended vehicle upon the town road between the hours of 12:00 midnight and 8:00 am. 9. All vehicles and garbage boxes shall be a minimum of two (2) meters from the edge of a town road. 10. Fences, lawns and other fixtures must be clearly marked for the town to consider any liability for damages. The marking and maintenance of the markers are the responsibility of the owner. Any damages will be repaired by the town provided it is clearly marked and the damage is the result of a direct strike by town equipment. Any fence or fixture damaged by snow pressure from the town equipment will not be repaired at the town's expense. Any liability by the town for this clause will be under the condition that the fence, lawn or fixture is the required distance from the town road reservation. 11. In accordance with regulations the equipment operator shall report, together with the make of vehicle, license number, the time and location of any vehicle parked that is interfering with snow clearing operations. The owner of any such vehicle will be contacted in an appropriate manner and if the problem isn't resolved the vehicle may be towed away at the expense of the owner. 12. In the event of storm conditions, for the safety of equipment operators and the general public the Town Clerk/Manager or his/her designate shall reserve the right to order cessation of snow clearing operations to avoid danger or injury to the employees or - general public. Operators and equipment will be on re-call for emergencies. 13. The town will consider providing snow clearing for driveways or business operations only where there is NO commercially available equipment for hire and in accordance with the Act. 14. These regulations are to be reviewed by Council Annually. 15. These Regulations were adopted by Council at a meeting held on that Day of chung : 202e and come into flect on the 16.
