## PUBLIC NOTICE
The following regulations have been made by the Town Council of the Town of Channel - Port aux Basques under the provisions of Sections 239 and 437 and any other section found enabling, of the Municipalities Act, 1990 as amended.
## CAT REGULATIONS
1. These regulations may be cited as the Cat Regulations of the Town of Channel - Port aux Basques, 1996.
## 2. INTERPRETATIONS
For the purpose of these Regulations, unless the context otherwise requires:
- (a) "Act" means the Municipalities Act, Statutes of Newfoundland, Chapter M-23 (as amended trom time to time).
- (b) "Animal Pound" means the facility operated by the Town of Channel - Port aux Basques for the keeping and disposition of stray cats.
- (c) "Running at large" means to be:
- i. in a public place; or
- ii. on premises not owned by or in the possession of the owner of the animal;
- (d) "Cat" means a member of any breed of domesticated feline or cross-breed or domesticated feline whether spayed or neutered.
- (e) "Council" means the Town Council of the Town of Channel - Port aux Basques.
- (f) "Impounder" means a person, including a Municipal Enforcement Officer, or SPCA representative, appointed by the Town Manager and authorized to enforce the Town of Channel - Port aux Basques Cat Regulations.
- (g) "Live Trap" means a cage-like devise approved by the SPCA used in the capture of Cats without injury to the animal, thus enabling the Impounder to remove these animals humanely.
- (h) "Owner" includes a person who possesses or harbours a cat and where the owner is under 18 years of age, the person responsible for the custody of the minor.
- (i) "Premises" shall mean any property within the boundaries of the town from which a complaint has been registered.

4. The Impounder may seize, capture, or impound any cat found running at large contrary to these regulations about which a complaint has been made, and enter onto any premises for the purpose of capturing any cat.
5. The owner may recover a seized or impounded cat on such proof of his/her ownership of the cat as the Council may require, and upon repayment of all fees in connection with the impounding.
- "Town" shall mean the Town of Channel - Port aux Basques as defined by Order- in-Council dated November 1945 and any amendments thereto, according to the Municipalities Act.
- (k) "Town Clerk" means the Town Clerk of the Town of Channel - Port aux Basques.
- No person shall keep any cat other than a kitten, not more than six (6) months old, within the limits of the Town, unless a license has been issued by the Council for such cat and such cat license is still in force, and unless such cat bears a numbered tag or plate indicating that such license is currently in force.
- (a) The Town shall keep a register of all cats licensed by them.
- (b) Every such license from the Town shall be non-refundable.
- The following seizing and impounding fees be paid by the owners of the cats seized or impounded or deducted from the proceeds of any sales of such cats.
Seizing and Impounding ... $25.00 for the first offence.
Seizing and Impounding ... $35.00 for any subsequent offence.
- The Impounder shall keep any unclaimed cat in the pound for a period not exceeding forty-eight (48) hours, and after the expiration of such period, the cat may be euthanized.
- Any person who interferes with or attempts to interfere with a Municipal Enforcement Officer/Animal Control Officer, or SPCA representative, in the exercise of their Leges, such person shall be demed to have committed an offence in terms of these
- (a) Office Animal Control bricer, hiA representive, eases any emeral which has been impounded, shall be deemed to have committed an offence in terms of these Regulations.
- (b) Every person requested by the Municipal Enforcement Officer/Animal Control Officer or SPCA representative shall, on request, forthwith give his/her proper name and address.
- oi Fees to be paid on issue of annual licenses shall be Six Dollars ($6.00).
10. Every license issued in accordance with the foregoing shall become due and payable on January Ist in each year, and shall be valid until the 31st day of December next following the date of issue.
11. No person shall:
- (a) tease a cat caught in a cat trap; or
- (b) throw or poke any object into a cat trap when a cat is caught therein.
12. It any cat shall howl in such a manner as to disturb the peace or to constitute an annoyance to residents in the neighbourhood, such cat shall be deemed to be a nuisance and the owner thereof shall be deemed to have committed an offence in terms of these regulations.
13. Any person who violates any of the provision of these regulations shall be guilty of an offence and shall be liable to a minimum fine of $50.00.
14. Pursuant to Section 448 of the Act, a person who:
- (a) contravenes or fails to comply with this Act or a regulation or order made under this Act; or
- (b) tears down, removes or damages a regulation, order or notice posted by Council;

15. These Regulations were passed and adopted by Council on the 7th day of November, 1995, and will come into effect on the 1st day of January, 1996 and may be cited as the Town of Channel - Port aux Basques (Cat) Regulations, 1996.
