## PUBLISHED BY AUTHORITY Pursuant to the authority conferred by Section 254 of An Act Relating Io The Establishment And Administration of Municipal Government in the Province, Chapter M-23, the Town Council of Channel - Port aux Basques has made the following regulations. <!-- image --> Apotbann MAYOR ## REGULATIONS 1. These regulations may be cited as the Town of Channel - Port aux Basques Nuisance and Noise Regulations, 1992. 2. Interpretations: In these regulations: 3. (a) "Act" means An Act Relating To The Establishment And Administration Of Municipal Government In The Province, Chapter M-23. 4. (b) "Council" means the Town Council of Channel - Port aux Basques. 5. (c) "Municipality" means the Town of Channel - Port aux Basques. 3. No person shall create a noise within the Municipality, through the use of fire-arms, fireworks or other similar noise-making devices, except as may be approved by Council and subject to the approval of law enforcement or other regulatory agencies. 4. No person shall create a noise within the Municipality, through the use of shouting or noise-making devices, for the purpose of selling wares, soliciting business or attracting attention, except as may be approved by Council. 5. No person shall create a noise within the Municipality, through the use of motor vehicle horns, except as may be reasonably necessary in the opinion of Council, for the safety and warning of traffic and pedestrians. 6. No person shall use, within the Municipality, musical equipment outside, a lawnmower, chainsaw, snowmobile or other machinery or equipment which may disturb the peace and quiet of a neighbourhood, between the hours of 10:00 p.m. of any day to 6:00 a.m. of the following day, except as may 10. otherwise be approved by Council. 7. No person shall keep or permit to be kept in any building, premises or yard or any part thereof in the Municipality any dog and/or cat which by reason of barking or howling is a nuisance to persons in the Municipality. 8. No person shall create a noise within the Municipality, through the use of a motor vehicle that has no muffler or a defective muffler, except as may be necessary, in the opinion of Council, to move such motor vehicle to a location for associated repair, subject to the approval of law enforcement officials under the Highway Traffic Act. 9. No person through the opinion shall create a noise within the Municipality. the squealing of tires of a motor vehicle, which, in of Council, is caused by unnecessary braking, turning setting in motion of such motor vehicle. 10. No person within a motor vehicle or otherwise, shall play loud music, holler or scream, in excessive amounts as to disturb persons within the Municipality, or cause nuisance or distraction within the Municipality. 11. Nothing in these regulations shall be deemed to prohibit: 16. (a) The sounding of any bell, horn, siren or other warning device of any vehicle, where the law requires, or when responding to an emergency. 17. (b) 18. The ringing of church bells or chimes. 19. (c) The sounding of motor vehicle horns in a wedding procession or in parades permitted by Council. 12. Pursuant to Section 448 of the Act, a person who - (a) contravenes or fails to comply with this Act or a regulation or order made under this Act; or - (b) tears down, removes or damages a regulation, order or notice posted by Council is guilty of an offence and liable on summary conviction, where a penalty is not otherwise provided, to a fine of not less than $50, and not exceeding $1, 000 or in default of payment to a period of imprisonment not exceeding 90 days, or to both a fine and period of imprisonment. - These regulations were adopted by resolution of Council at meeting held on the 10th day of November, A.D. 1992, and may be cited as the Town of Channel - Port aux Basques Nuisance and Noise Regulations, 1992. <!-- image -->
