Pursuant to the authority conferred in Sections 7 and 8 of the Towns and Local Service Districts Act, the Town Council of Clarenville adopted the following by-law on the 19t day of August, 2025.

## 1. TITLE
- 1.1. This document will be known and cited as the Water Conservation By-Law.
## 2. PURPOSE
- 2.1. To conserve the town's protected water supply, minimize the problem of water distribution and to promote the wise use of water.
## 3. DEFINITIONS
- 3.1. "Towns and Local Service Districts Act" means the Towns and Local Service Districts Act, as amended.
- 3.3. "Town" means the Town Council of the Town of Clarenville.
- 3.2. "Council" means the duly elected Council of the Town of Clarenville.
## 4. APPLICATION
- 4.1. This By-Law applies to those properties which are serviced by the Town's water distribution system.
- 4.2. Consumers can be alerted in several ways. A combination of these may be necessary to inform all consumers:
- Use local media outlets (e.g. radio, television);
- Town Website;
- Town Voyent alerts;
- Social Media.

## 4. PROCEDURE
- 4.1. In order to conserve the town's protected water supply, minimize the problem of water distribution and to promote the wise use of water the Town Council hereby adopts the following Water Conservation By-Law which will come into effect annually July 1 and remain in effect until October 1 or otherwise prescribed by the Town.
- 4.2. Watering of lawns and gardens is restricted to the hours between 8 pm to 10 pm, two days a week as follows:
- Odd civic numbers on Tuesdays and Saturdays
- Even civic numbers on Wednesdays and Sundays
- 4.3. Hand watering of trees, shrubs, flowers and vegetable gardens with a water can or hose with an automatic shut off nozzle is permitted at any time.
- 4.4. With prior notification to the Town, new lawns and/or landscaping can be watered daily between 8:00 p.m. and 10:00 p.m. for a period of sixty (60) days following installation and/or planting.
- 4.5. Car washing, including car wash fundraisers, siding and window washing are permitted at any time with the use of a hose with an automatic shut off nozzle.
- 4.6. Commercial car washes and commercial high-pressure water uses are exempt from this Policy.
- 4.7. The cleaning of driveways and parking lots utilizing water is prohibited, however the use of commercial sweeping equipment on commercial parking lots is permitted.
- 4.8. The Town reserves the right to temporarily suspend all conservation efforts (noted above) and implement restrictions should the need arise.
## 5. ENFORCEMENT
- 5.1. The Town of Clarenville's Municipal Enforcement Officer (MEO) or any person designated by Council may enforce these Regulations.

## 6. ORDERS
- 6.1. When in the opinion of the Town of Clarenville's MEO or any other person designated by Council to enforce these Regulations, an individual is in contravention of these Regulations, he or she will be issued an Order, as per Section 285 of the Act, in a form approved for such use by the Town, to comply with these Regulations and refrain from any unauthorized use of water as specified in the Regulations.
## 7. FAILURE TO COMPLY
- 7.1. Every person on whom an Order has been served, as authorized under these Regulations, and who refuses or fails to comply with the Order may have their water turned off by an official of the Town of Clarenville. In addition, other penalties as provided under these Regulations may also be imposed.
## 8. PENALTIES
- 8.1. A person who commits an office under Section 289 of the Act is liable on Summary Conviction to penalties under Section 290 of the Act.
- 8.2. This By-Law shall not exclude the application of other penalties not expressly listed.
- 8.3. Prosecutions for offences in this By-Law may be carried out by the Town under Section 291 (1) of the Act.
- 8.4. A Prosecution shall not be commenced by the Town with respect to an offence under the Act until an appeal period which may apply to the activity giving rise to the offence has passed.
## 9. REPEAL OF PREVIOS REGUALTIONS AND BY-LAWS
- 9.1. All previous Town of Clarenville Water Restriction Policy's are repealed.
## 10. ENACTMENT
- 10.1. This by-law shall come into effect on the 19t day of August, 2025.
