WATER METER BY-LAW
PUBLISHED BY AUTHORITY
Pursuant to the powers conferred by Chapter T-6.2, Section 8 (1) (c) of the Town and
Local Service Districts Act, the Town of Conception Bay South has made the following
By-law.

1.
TITLE
This By-law shall be cited as the "Town of Conception Bay South Water Meter
By-law".
2.
DEFINITIONS
In this By-law:
(a)
"By-law" shall mean the Town of Conception Bay South Water Meter
By-law.
(b)
"Contractor" is someone qualified to install, repair and read water
meters.
(c)
"Inspector" shall mean a person designated by the Town to carry out
the duties specified in this By-law.
(d)
"Professional Engineer" is someone registered to engage in the
practice of engineering under the Statutes of Newfoundland and
Labrador, 2008, Chapter E-12.1.
(e)
"Town" shall mean the Town of Conception Bay South.

SCOPE AND APPLICATION
(a)
This By-law shall apply to new commercial, industrial and institutional
properties.
(b)
All water supplied to a property, except that flowing for fire protection or
suppression, shall be metered.
(c)
Water shall be considered to be supplied to a property at the point of
entry into the lateral.
(d)
All water meters must be installed and certification submitted to the
Town's Planning and Development Department prior to building
occupancy.
4.
METER INSTALLATION INSPECTION AND TESTING
(a)
The property owner shall supply and install water meters.
(b)
Water meters shall be located inside the structure before any branch or
connection except branches for fire protection and must be installed
within the first 3 metres of pipe where the water service enters the
structure, unless otherwise approved by the inspector. The location
shall be a heated, non-confined space and shall be accessible by the
inspector.
(c)
Water meters must be hard wired with no switching devices between
the power supply and meter.
(d)
The pipe to which the water meter is attached shall be in a continuous,
unobstructed space and shall be accessible by the inspector. Piping
shall not be used to bypass the water meter at any time, unless
otherwise approved by the inspector.
(e)
Water meters must be inspected and tested after installation and after
any repairs. They must be inspected and tested annually from the
original date of installation by a qualified contractor. A letter of
certification must be submitted to the Town's Planning and

Development Department. Water meters not meeting manufacturers'
specifications are to be repaired or replaced immediately.
(f)
For all service lines, a professional engineer shall provide a list of all
plumbing fixtures, all calculations determining maximum flow and
specifications of the determined water meter. This information shall be
provided with a letter stamped by the professional engineer to the
Town's Planning and Development Department.
5.
RESPONSIBILITIES OF PROPERTY OWNER
(a)
The property owner shall supply power to the water meter where a
power supply is required to operate the water meter.
(b)
The property owner shall carry out all necessary modifications or
alterations to the property as directed by the inspector to allow for proper
installation of a water meter.
(c)
The property owner shall bear the cost of repairing or replacing a
damaged water meter including normal wear and tear. Any repairs or
replacements must be certified by a qualified contractor and a letter of
certification must be submitted to the Town's Planning and
Development Department.
(d)
The property owner shall notify the inspector immediately if a water
meter is to be replaced or requires repairs.
(e)
The property owner shall provide access to the inspector for the purpose
of inspection and regular meter readings.
(f)
By-passing the water meter is not permitted without written approval
from the inspector.
(g)
Tampering with, manipulation of, or interference with the water meter is
prohibited.

6.
WATER SUPPLY
The inspector may stop the supply of water to a property during the repair,
replacement or testing of the water meter.
7.
SCHEDULE AND FEES
The water meter shall be read by the Town at least twice per year and shall be
billed to the property owner at the applicable rate as per the Town's Schedule
of Rates and Fees.
8.
PENALTIES
Every person who is guilty of an offence under this By-law or who acts in
contravention of or fails to comply with any provision thereof, or neglects or
refuses to do so:
(a)
Shall be liable to penalties as stipulated in accordance with
section 290 of the Towns and Local Service Districts Act; or
(b)
Shall be subject to an order under section 285 (1) of the Towns
and Local Service Districts Act; or

EFFECTIVE DATE
This By-law shall come into force on the 22nd day of January 2025.
In witness whereof, the Seal of the Town of Conception Bay South has been affixed
herewith and the Mayor and Chief Administrative Officer have signed this By-law on
behalf of the Town Council of the Town of Conception Bay South this 22nd day of
January, 2025.
