## CITY OF CORNER BROOK STREET BY-LAW
PURSUANT to the powers vested in it under Sections 188, 192, 193, 196, 200, 201, 202, 280.1, 280.2 and 280.4 of the City of Corner Brook Act, R.S. N.L. 1990, c. C-15, as amended, and all other powers it enabling, the Corner Brook City Council, in a session convened on the 21s day of April, 2008, hereby passes and enacts the following regulations,
- These Regulations may be cited as the City of Corner Brook Street By-Law.
## Definitions
- In these Regulations
- a. "City" means the City of Corner Brook;
- b. "Council" means the Corner Brook City Council;
- c. "development" means the carrying out of building, constructing, excavating, erecting, engineering, mining, or other operations in, on, over or under land, or the making of a material change, alteration, improvement or change in the use, or the intensity of use of land, buildings or premises or any improvements attached, anchored or moored to land;
- d. "Director" means the Director of Operational Services;
- instrument and money;
- f. "roadway" means the portion of a street that is improved, designed or ordinarily used for vehicular traffic, but does not include the shoulder unless the shoulder is paved;
- g. "sidewalk" means that part of any street especially constructed or set aside for pedestrian use.
- h. "street" means a place or way within the City, including a structure forming part of the place or way, designed and intended for, or used by, the public for the passage of traffic or the parking of vehicles and includes all the space between the boundary lines of the place or way; and
- i. "vehicle" means a device in, upon or by which a person or thing may be transported or drawn upon a street.
- i. "vehicle" means a device in, upon or by which a person or thing may be transported or drawn upon a street.
## Excavation
- No person shall excavate in a street without a written permit granted either by Council or the Director.
- Council or the Director may issue a permit to excavate on a street and specify such terms and conditions as Council or the Director deems appropriate on such permit.
- Council or the Director may issue to any public utility company in a case of emergency, an emergency permit which shall permit excavation to be made on a street, on such conditions as the Council or the Director specify on the permit.
## Obstruction of Street
- A person shall not place or cause to be placed any thing upon any street or engage in action which will interfere with or tend to interfere with the free and uninterrupted passage of the public over a street except as permitted by this regulation and without restricting the generality of the forgoing no owner of property shall permit a plant on that property to grow into or over a street in such a way that it will interfere with or tend to interfere with the free and uninterrupted passage of the public over a street except as permitted by this regulation.
- A person shall not cause or permit any vehicle which is wholly or partially on any street to receive gasoline, oil or other product normally dispensed and sold by a service station or garage except in the event of breakdowns or emergency.
- A person shall not cause or permit any vehicle which is wholly or partially on any street to be repaired except for minor repairs in the event of a breakdown or emergency.
- A person shall not place or maintain an awning which extends over any street unless a plan of the same has been first submitted to and approved by Council or the Director, and the Council or the Director may at any time revoke such approval and require the owner, lessee or occupier of the property to which the awning is attached to remove the awning by a notice issued and served in terms of Section 15 of these regulations.
10. A person shall not place or maintain an awning which extends over the street except where there is a clearance of at least two (2) meters between the lowest part of the said awning and the said street.
11. A person shall not, without a permit issued by Council or the Director;
- a. place upon any street for sale or show any goods, wares or merchandise or any signboard or advertising board; or
- b. place on, suspend from or expose outside any building, goods, wares, or merchandise for sale in such a way that the said goods, wares or merchandise extend from the wall of such building more than one hundred and fifty (150) millimeters towards or into any street.
12. Council or the Director may issue a permit upon such conditions as they deem fit to;
- a. place upon any sidewalk for sale or show any goods, wares or merchandise or any signboard or advertising board; or
- b. place on, suspend from or expose outside any building, goods, wares, or merchandise for sale in such a way that the said goods, wares or merchandise extend from the wall of such building more than one hundred and fifty (150) millimeters towards or into any sidewalk.
13. A person shall not place on any street any thing or permit the same to remain thereon, so as to obstruct the right of passage of the public from such street for a longer period than is necessary to remove the said thing to or from any building or premises fronting on such street.
14. A person shall not place on any street, any step, porch, bay window, balcony, fence, railing, wall or other structure.
15. Council or the Director may by written notice direct any thing placed or growing on or over a street in breach of these regulations to be removed by the owner of the thing or by the person placing the thing on the street within the time frame specified on the notice requiring such removal.
16. If any notice issued and served under Section 15 following is not complied with within the time named in the notice, the Council or Director may carry out the directions contained in the notice through the officers, agents, employees, or contractors of Council and recover the costs of so doing as a civil debt from the person on whom the notice was served.
17. A person may with the prior approval in writing of Council or the Director place on a street, building materials and erect an enclosure on the said street to protect the same for such period as the Council or the Director permits.
18. A person to whom approval has been given to occupy part of a street for the purpose set out in Section 17 or for making any excavation, or for any other purpose whatsoever, shall provide a safe and convenient passage around, under or over the obstructions so
placed to the satisfaction of Council or the Director and shall undertake to indemnify Council and the City against liability for any injuries, loss or other damages arising in consequence of the obstruction or of the negligence of the person, his agent, employees or contractors in relation to the said obstructions or the said safe and convenient passage around, under or over the said obstruction and Council may require the person seeking approval as aforesaid to effect adequate insurance or deposit a bond as Council see fit.
19. A person shall not use a sled, skate, inline skate, skateboard or toboggan on any roadway. A sled or toboggan may be towed by a person capable of controlling the same on a sidewalk.
20. A person shall not play games involving a ball, puck or other thing passed from player to player on any street.
21. A person shall not allow a child of whom they are a parent or legal guardian to commit a breach of Section 19 or 20 of these regulations.
22. Persons waiting in any street for the purpose of attending any theatre, place of amusement, entertainment, public meeting or any other place open to the public shall do so in an orderly manner so as not to obstruct the use of the street nor the approach or access of any adjacent premises, and such person shall obey the instructions of any Peace Officer or agent or employee of the Council as to where they may stand and shall queue or line in an orderly fashion.
23. A person owning, occupying or leasing property shall not suffer or permit the door or gate to or from such property to swing outwards over the sidewalk or portion of any street.
## Street Closures
24. The Director may, whenever he or she deems it necessary in connection with the City's work on any street, temporarily close that street or any part thereof and may for that purpose authorize the erection of barriers or signs indicating that such street or part thereof is closed to traffic.
25. A person shall not interfere with any barriers or signs erected in accordance with Section 24 of these regulations.
26. A person shall not drive or attempt to drive any vehicle along a street or part thereof so closed in accordance with Section 24 of these regulations without permission of the Director or his agent.
## Sidewalks
27. A person shall not drive or park any vehicle upon a sidewalk except where the crossing of the sidewalk is necessary to obtain access to a driveway.
28. A person shall not place or move any thing on a sidewalk where such placement or movement will cause damage to the sidewalk or curb or where such rolling or placing of such thing will obstruct the free passage of the public.
29. A person shall not dump, unload, deposit or move any thing upon any sidewalk unless such sidewalk has been first protected by boards of not less than on inch thick being placed together over the surface of the sidewalk where such thing has been dumped, unloaded, deposited or moved.
30. A person shall not stand in a group or near a group of other persons on the sidewalk in any street in such a manner as to obstruct or hinder the free passage of pedestrians.
31. A person shall not jostle or crowd pedestrians on the sidewalk of any street in such a way as to cause alarm, discomfort, disturbance or confusion.
## Protection of Streets
32. A person shall not transport in any manner whatsoever, on any street, sand, stone, earth, dirt, manure, lumber, metals or rubbish or any loose fluid or semi-fluid in such manner as to cause or permit the spilling or the scattering of the same on a street.
33. A person shall not move timber or any thing on any street in such a way that the timber or thing drags along the street.
34. A person shall not on any street raise or hoist any goods, furniture, building materials, machinery or other load, to any roof, balcony, upper storey, door or window or other elevated position nor lower such goods, furniture, building materials, machinery or other load except in accordance with the terms and conditions of a permit in writing from the Council or the Director.
35. A person shall not throw any shingles, boards, slats, sand, gravel, tar or other material whatsoever from any roof or scaffolding or other elevated position into any street but shall lower the said shingles, boards, slats, sand, gravel, tar or other material in chutes or by a tackle in accordance with the terms and conditions of a permit in writing from the Council or Director.
36. A person shall not in the development of property allow excavation material to accumulate on the street. A Municipal Enforcement Officer may at any time, by a direction in writing, require the owner of such property, or the person performing the development of such property to remove at their own expense and to the satisfaction of such Municipal Enforcement Officer, all such excavation material by a specific date and time, which date and time shall be not less than twelve hours from the time of service of the written direction. In the event of the failure or neglect of such person to remove the excavation material from the street, after being directed by Municipal Enforcement Officer so to do, the Director may cause such excavation material to be cleaned up and removed and the cost of the clean up and removal shall be paid by the person directed to remove the material.
37. A person shall not make or light any fires or bonfires or light, set-off, or throw any fire crackers or other noisy offensive or dangerous things, substances or fire works in any street.
38. A person shall not pile any logs, lumber or firewood or saw or cut any logs, lumber or firewood on any street or on private property in such a manner as may cause damage to or obstruction on the street.
39. Where any street has been damaged in consequence of the development of property or by any unusually heavy equipment or by a track laying vehicle, Council may serve notice in writing upon the owner of such property or the contractor engaged in such development, or the owner or operator of such vehicle, requiring him or them to make good the damage within five (5) days from the date of service of the said notice and if the person receiving such notice fails to effect the required repairs within the said five (5) days, Council may cause the said repairs to be effected and recover the costs of so doing as a civil debt from the person to whom notice was served.
## Snow Clearing
40. A person shall not deposit snow or ice or cause snow or ice to be deposited on a roadway or sidewalk.
41. A person shall not throw or deposit snow or ice or cause snow or ice to be deposited on a portion of the street not used for traveling by vehicles or pedestrians without proper precaution to prevent injury to persons using such street.
42. The owner, occupier or tenant of a building shall not permit icicles to accumulate on the eaves, gutters or window ledges of the building, owned, occupied, or leased by such person, to the extent that such icicles may become dangerous to persons using the street on which the said building is located.
43. A person owning, occupying or leasing a place of business on streets designated in Schedule "A" attached hereto as streets from which the City will clear snow, shall keep the sidewalk in front of the place of business free of snow and ice for a distance of not less than 1.2 meters in front of the place of business and may deposit the said snow and ice in the curb-gutter area of the street to await removal by the City.
## General Regulations
44. A person shall not drive, cycle or walk upon any part of a street which has been partly or wholly covered with sod by the City.
45. No person shall install, repair or remove, or permit or cause to be installed, repaired or removed any crossing over an open ditch in the City without a written permit to do so issued by Council or the Director.
46. (a) Upon a request by the owner of a property in the City the Director may install a crossing over an open ditch in the City.
4. (b) Prior to installing the crossing the Director shall require from the property owner a deposit in the form of cash or a certified cheque, bank draft or money order, which deposit shall be equal to the amount of the estimated cost of such installing the crossing.
5. (c) The owner of the property shall pay to the City the actual costs of such installation.
47. A person owning, occupying, leasing a place of business shall as may be necessary wash the windows fronting the streets and water, wash or hose the paved sidewalk fronting the place of business and shall do so between the hours of ten p.m. and ten a.m.
48. A person owning, occupying or leasing a property shall not construct, cause to be constructed or permit to be constructed a drain from such property in such a way as to cause damage or obstruction to or ice or water accumulation on, road surfaces, curbs and gutters or sidewalks and all drains shall be constructed under the supervision of the Council or its employees.
49. A person shall not deposit any material, chemical or substance whatsoever in any ditch, culvert, catch basin or gutter, under any bridge or in any stream within the City, which may obstruct the flow of water, cause damage to the drainage system or otherwise create a public nuisance.
50. The driver, operator or owner of a commercial vehicle in excess of three thousand and four hundred (3400) kilograms maximum gross weight, shall not park such vehicle or permit such vehicle to be parked on any street except for such period as is reasonably required to load or unload the said vehicle.
51. Where any person contravenes any of the provisions of these Regulations:
11. (a) such person is guilty of an offence and liable on summary conviction to a fine or to a period of imprisonment or both in accordance with s. 438 of the City of Corner Brook Act;
12. (b) such person may be issued a violation notice pursuant to section 280.1 of the City of Corner Brook Act.
52. All Municipal Enforcement Officers are designated persons employed by Council who may issue a violation notice pursuant to section 280.1 of the City of Corner Brook Act for any contravention or failure to comply with the City of Corner Brook Street By-Law.
53. These regulations shall come into force as of the date enacted by Council and the City of Corner Brook Street By-Law, 1969 and all amendments thereto are hereby repealed upon the coming into force of these Regulations.
