CITY OF CORNER BROOK TRAFFIC REGULATIONS PURSUANT to the powers vested in it under Section 203 of the City of Corner Brook Act, R.S.N.L. 1990, c. C-15, as amended, Section 189 of the Highway Traffic Act, R.S.N.L. 1990, c. H-3, as amended, (a) delegation(s) of power by the Minister of Works, Services and Transportation dated and all other powers it enabling, the Corner Brook City Council, in a session convened on the 21" day of April, 2008, hereby passes and enacts the following regulations. 1. This regulation may be cited as the City of Corner Brook Traffic Regulations. Definitions 2. For the purpose of this regulation: a. "City" means the City of Corner Brook; b. "Council" means the Corner Brook City Council; c. "Director" means the Director of Operational Services; d. "Highway Traffic Act'' means the Highway Traffic Act, R.S.N.L. 1990, c. H-3, as amended, e. "Traffic Control Device" means any sign, signal or device erected by authority of the Council for the purpose of regulating, warning or guiding traffic and includes any signal by which traffic is directed to proceed or to stop and includes warning sign-posts, direction posts, signs, lines, marks or other devices for the guidance of persons using the highway; f. "Traffic Officer" includes a member of the Royal Newfoundland Constabulary, a municipal enforcement officer and any person designated by Council as a Traffic Officer for the purpose of the Regulations, by whatever name or title such person is known. 3. No person shall use any highway within the City unless that person complies with all the provisions of the Highway Traffic Act and Regulations made thereunder, except insofar as the Highway Traffic Act or Regulations thereunder contain an exemption for Regulations or provisions of Council, in which case such person shall comply with all applicable Regulations or provision of Council. 4. Nothing in these regulations shall prohibit the lawful parking of a vehicle in accordance with the City of Corner Brook Parking Meter Regulation. 5. Council or the Director may cause or permit Traffic Control Devices to be placed upon or near any highway within the limits of the City. 6. Without limiting the generality of Section 5 of these Regulations, traffic control devices may be used for any of the following purposes: (a) to regulate the movement of traffic; (b) to indicate the route to be followed by traffic; (c) to restrict or prohibit the use of any part of any highway within the City; (d) to indicate maximum speed limits in any area or on any part of any highway within the City; (e) to restrict or prohibit the parking of vehicles in any area or on an highway within the City and specifically to reserve particular areas for parking by specific types of vehicles or for the parking of vehicles operated by specific classes of persons; (f) to restrict or prohibit temporarily the use of any highway, or any part of any highway within the City whenever, owing to the likelihood of danger to the public or of serious damage to the highway, it appears to the Council or the Director to be necessary; and to limit the loads of vehicles owing to conditions of any highway, if the Council or Director deems it necessary, provided that the sign shall not apply to any person granted a permit in writing by the Council to use the highway in case of emergency; (g) to warn users of the highway of the need for special caution; (h) to convey information to users of the highways within the limits of the City. 7. Except where a Traffic Officer directs otherwise, drivers and pedestrians shall obey the instruction of a Traffic Control Device. 8. a) No person shall drive any motor vehicle at a speed exceeding 50 kilometers per hour within the limits of the City except in areas otherwise designated by Council. b) The Director may place restrictions on the speed at which a person shall drive a motor vehicle within the City when the Director, in his sole discretion deems it necessary to protect such street, road or highway or for public safety and the Director may cause to be placed such signs and signals as are necessary to advise persons of such restrictions, and such restriction shall remain in place until revoked by the Director or Council. c) Council may at anytime revoke a restriction placed by the Director under this section. (d) Every restriction or prohibition made by the Director under this section shall i) within two (2) days (exclusive of Sundays and holidays) be communicated by the Director to Council; and ii) Remain in full force and effect until revoked, altered, amended or varied by the Director or Council. Overnight Parking 9. No person shall park any vehicle on any highway within the City between the hours of 1:00 a.m. and 8:00 a.m. provided that these Regulations shall not apply to ambulances or fire engines nor to motor vehicles operated by medical practitioners, clergy, police officers or City agents or employees, when being used in cases of emergency. Directions of City Agents 10. The owner or operator of any motor vehicle shall move his or her vehicle on request to such position and for such time as may be reasonably required by an agent or representative of Council. Public Parking Lots 11. A motor vehicle shall not be permitted to remain in a stationary position upon any public parking lot (other than a privately-owned lot) for a period in excess of 24 hours and in no instance shall the vehicle be allowed to obstruct traffic or any municipal undertaking including but not limited to snow-clearing. Projections 12 No person shall operate any vehicle within the boundaries of the City having any object or thing projecting or extending therefrom in a lateral direction for a distance of more than 30 centimeters. Offences and Penalties 13. Where any person contravenes any of the provisions of these Regulations, such person is guilty of an offence and liable on summary conviction to a fine or to a period of imprisonment in accordance with s. 438 of the City of Corner Brook Act. 14. These regulations shall come into force as of the date enacted by Council and the City of Corner Brook Traffic Regulations 1992 and all amendments thereto are hereby repealed upon the coming into force of these Regulations.
