## TITLE
## FENCE CONSTRUCTION
This document will be known and cited as The Town of Cupids Fence Construction By Law.
Pursuant to the authority conferred in Section 8 of The Towns and Local Service Districts Act, 2025, The Town of Cupids has adopted the following regulations on June 3
## APPLICATION
1. All fences erected within the Town of Cupids shall be approved and a permit issued, before construction begins.
2. No fence shall be erected within the Town, or major repairs made thereto, unless a written permit is issued by the Council to the builder or owner.
3. Except with prior approval of Council, no person shall erect a fence:
- b. Within twenty (20) feet of the center of any secondary road within the Town.
- a. Within twenty four (24) feet of the center of any main road within the Town.
4. Shoves and posts supporting fences shall be placed on the side of the fence, remote from the road, street, highway, or lane along which the fence is erected and in such a manner as to not be a danger or hindrance to the general public.
5. All persons owning of occupying land abutting a road, street, lane or highway within the Town shall be required to keep and maintain all fences in a state of good repair.
- a. Any and all repairs to fences or walls constructed of concrete, rock, or stone shall only be affected by the owner or builder obtaining a written permit from Council.
- b. All fences shall be suitably finished to the Satisfaction of Council.
- d. The Council may order the owner or apparent owner of any fence or wall to remove it if poses a real or perceived danger to public safety.
- c. No fence to be erected within 20 feet of a waterway, (harbour, river or pond).
- e. The Council may order the owner or apparent owner of any fence or wall to effect such repairs as may be necessary to ensure the public's safety and compliance with this regulation.
## PENALTIES
2. This By-Law shall not exclude the application of other penalties not expressly listed
2. 1.Penalties may be applied in accordance with Division 6 of the Towns and Local Service Districts Act.
Review
The Town shall, every 2 years, conduct a review of this By-Law and consider the areas which may be improved.
## 10. REPEAL OF PREVIOUS BY-LAWS AND AMENDMENTS
1. Any and all previous Fence Regulations.
## 11. CAME INTO EFFECT
These Regulations first came into effect on June 2025, through a resolution of Council, #.48-2025
