## 1. TITLE This document will be known as the Town of Cupids Snow Clearing By-Law. Pursuant to the authority conferred in Section 8 of The Towns and Local Service Districts Act, 2025 The Town Council of Cupids has adopted the following By Law on May 6,2025. ## 2.INTERPRETATION/ DEFINITION - 2.1 "Act" means the Towns and Local Service Districts Act, 2025 - 2.2 "Council" means the Town Council of Cupids - 2.3 "Enforcement Authority" means Council or its authorized administrator - 2.4 "Highway" means the entire width between the boundary lines of a highway, road, street, avenue, thoroughfare, right of way, driveway, lane or alley, Whether it is privately or publicly owned and whether or not it is designed or intended for use by the public, if the whole or any part of it is used by the public. If whole or in any part of it is used by the public for passage of vehicles and includes a river or other body of water or watercourse when it is maintained or kept open at the expense of the Municipality. - 2.6 " Occupant" means any person who is an agent, tenant or occupier of a property. - 2.5 " Owner" means the legal entity having title to a property. - 2.7 "Town" means Town of Cupids - 2.9 Council may use its discretion to extend the Snow Clearing Season as a result of forecasted weather conditions by providing reasonable notice in advance. - 2.8 "Snow Clearing Period" means the first (1) day of December in each year to and including the thirty first (31) of March in any succeeding year, inclusive of both days and any other period when unusual snow/ or ice conditions prevail. - 2.10 "Vehicle " means a device in which a person or property may be transported or drawn upon a highway. - 2.12 " Regulations" means the Town of Cupids Snow Clearing Regulations. - 2.11 " Violation Notice" shall mean a notice issued pursuant to Section 6 of the TLSDA. ## PARKING No person shall park an unattended vehicle on any highway as defined above, or leave any portion protruding upon any highway within the Town of Cupids during the Snow Clearing period: Between the hours of 1a.m. and 8a.m. and at any time during a snowfall and for twenty four hours after. ## VIOLATIONS/ PENALTIES Any vehicle parked within the Town of Cupids, in contravention of these regulations may be towed away. The owner of the vehicle shall be liable for all costs associated with the towing and shall be recoverable by the Town of Cupids as a civil debt. Neither Council, nor its employees, are responsible for damages caused to any motor vehicles as a result of enforcement of these regulations. ## Town of Cupids Snow Clearing By Law ## DEPOSITING OF SNOW No person shall shovel, plow, blow or cause to be shoveled, plowed or blown any residue snow from a driveway or parking lot unto any highway, street, sidewalk within the municipal boundaries of the Town of Cupids. No person engaged in removing snow or ice from any property or other premises shall do so in any manner that obstructs vehicular traffic, or sidewalk. These provisions shall not apply to employees or contractors of the town while engaged in snow clearing operations on behalf of the town. ## RESPONSIBILITIES - of snow. The Town is not responsible for damage caused by lawn browning or the weight - The town is not responsible for damage caused within three (3) metres of the front property lines. This includes damage to fences, garbage boxes, trees, etc. - The Town of Cupids is not responsible for damage caused to trees on private property. It is advised that trees are properly marked and protected. (I.e.. Painted pole markers; minimum height of four feet). - The town of Cupids is not responsible for any damage that may be caused to a vehicle that is parked in the contravention of these regulations during snow clearing. ## PENALTIES 1. Penalties may be applied in accordance with division 6 of the Towns and Local Service Districts Act. 2. This By-Law shall not exclude the application of other penalties not expressly listed. ## REPEAL OF PREVIOUS BY- LAWS AND AMENDMENTS 1.
