Snow Clearing Regulations
1. Title
These Regulations may be cited as "The Town of Flatrock Snow Clearing Regulations".
2. Interpretation
1. "Council" means the Town Council of Flatrock
2. "Town" means the Town of Flatrock
3. "Vehicle" means a device in, upon or by which a person or property may be
transported or drawn upon a highway.
4. "Road" means highway as defined by the Highway Traffic Act 1990 and which
for the purposes of these regulations is under the jurisdiction of Council
3. During the period from the first day of November of each year, up to and including the
fifteenth day of April in any succeeding year, both days inclusive, no person shall park at
any time an unattended vehicle upon a road, road shoulder, or a turning area within the
Town.
4. During the period from the first day of November in each year, up to and including the
fifteenth day of April in any succeeding year, both days inclusive, no person shall shovel,
plow, caused to be shoveled or plowed, any residue from a driveway or parking lot into
any road, road shoulder or road ditch, within the municipal boundaries of the Town
which is controlled by the Town Flatrock.
5. Any unattended vehicle parked on any road or road shoulder within the Town, in
contravention of these regulations, may be removed and impounded by the Council, the
cost of such removal and impounding may be recovered from the owner as a civil debt.
Any snow residue that has to be removed by council on any road, road right of way or
road ditch caused by a person shoveling or plowing from a driveway or parking lot may
be recovered as a civil debt.
6. Council will not be responsible for any damage to property, fences, and garbage boxes
etc. that impede snow clearing and are located within designated Town right of ways.
7. Garbage boxes, fencing or other property items are to be at least 17.5 ft. from the center of
Town's roadway or 33 ft. from center of roads serviced by Transportation and Works in order to
be eligible for property damage reimbursement caused by snowclearing operations.
8. Coming Into Effect
These regulations shall come into effect on the 16th day of January, 2018.
9. Copy to Minister
A copy of these regulations was sent to the Minister of Municipal Affairs on the 23rd day
of January, 2018
10. Repeal of Previous Regulations and Amendments
All previous Town of Flatrock Snow Clearing Regulations and amendments are repealed.
