Town of Fogo Island By-Law 1 These By-laws have been adopted by the Town Council of the Town of Fogo Island pursuant to section 7(1)(d) of the Towns and Local Service Districts Act, SNL 2023 c T-6.2. Title These Bylaws may be cited as the Garbage Collection By-laws. PURPOSE To set guideline and direction for garbage and/or refuse collection for the Town of Fogo Island. AUTHORITY Pursuant to Section 162 Mandatory Services subsection (a) waste collection and removal; of the Towns and Local Services District Act, the Town of Fogo Island hereby enacts the following Garbage Collection By-law, which was adopted at a Public Council Meeting held on the April 29, 2025. DEFINITIONS In this By Law: a) "Act" means Towns and Local Services District Act. b) "Council" mean the Council for the Town of Fogo Island. c) "Town" means the Town of Fogo Island. d) "Street" means a street, road, highway or other way designed for the passage of vehicles and pedestrians and which is accessible by fire department and other emergency vehicles. e) "Household" means a single-family residence with or without an apartment. Curb-side residential garbage collection on a weekly basis. Collection and disposal services are provided by Central Waste Management under a service agreement. Central Newfoundland Waste Management operates a waste transfer station on the Stag Harbour Road, where all waste from Fogo Island is collected and then trucked to a landfill site off the Island. A household that has an approved home-based business or home occupation shall be treated the same as a regular household and the garbage which may contain items related to the business/occupation shall be collected, provided all other conditions are adhered to with respect to these regulations. Includes nightly and monthly rental properties that are deemed for residential occupancy. Waste must be placed curbside by 8:00 am on your scheduled collection day. Curbside means no more than 4.75m (15ft) off the road right of way as measured from the edge of the pavement or the public road. GARBAGE COLLECTION BYLAW Bylaw No: 2025-03 Motion of Council: 2025-070 Effective Date: April 30, 2025 Section: Finance & Admin Amendment Motion: Amendment Date: 2 Regular household waste must be put in CLEAR standard size refuse bags. Recyclable materials, as defined by Central Newfoundland Waste Management (CNWM), shall be placed in clear BLUE bags made for this purpose. All bags must be securely tied or closed at the top. Standard size refuse bags are 66cm x 87.5cm (26"x32.5") and should weigh less than 22kg (50lbs). Unbagged kitchen catchers or shopping bags will not be collected. Cardboard must be flattened and placed in BLUE bags or bundled & tied. Bundles may not exceed 50cm x 50cm x 75cm (20" x 20" x 30"), weigh less than 22kg (50lbs), and should be placed at the curbside on your collection day. Residents are responsible for the protection of all garbage from the time it is placed at the curb until it is picked up. All waste materials must be covered or enclosed. Residents may cover refuse bags with nets, tarps, blankets, or use portable bins (made of plastic or metal). For safety reasons waste will not be collected from garbage boxes, freezers, refrigerators, drums or similar units. Broken glass and sharps must be in a puncture proof packing marked as "Broken Glass or Sharps" and placed inside your clear refuse bag. Property owners are responsible to clean up waste from broken bags or animals. Drivers will not retrieve such waste. If above requirements are not met, then materials will not be collected. SPECIAL CONSIDERATIONS Wet Containers - if for any reason the contents of any container has not been adequately drained of all liquid or becomes wet and of a fluid consistency, the Town will not collect it. Cardboard Containers - it is unacceptable to place garbage or refuse for collection in paper containers, cardboard cartons, or in any manner not provided for by these regulations. Soot and Ashes - not to be put into regular garbage. A compost area is available at the Town Public Works depot on Range Road. Please place in steel bin provided. Syringes or other Sharp Objects - these items must be placed in puncture proof containers and securely sealed. Failure to do so will result in garbage not being collected from the location until the Town has confirmed that this procedure is being followed. Highly Combustible Materials - the Town shall not collect highly combustible material such as; floor sandings, paints, fine sawdust, oil or gasoline-soaked rags, gas containers, ammunition or other explosive matter, chemicals, acids or their residues/derivatives/by-products. The Town shall have the right to refuse other material not listed but which may be deemed dangerous. Hazardous Waste Materials - residents and homeowners are advised that harmful liquids and chemical wastes must not be included within regular household garbage for disposal. If you have products within your home/garage/etc. that are harmful, such as ammonia, acids, pharmaceutical 3 products, paints, oils, pesticides or other hazardous wastes that are to be disposed of, please contact the Town office (5352737) for further information. Residents can also drop off hazardous material at designated sites within Town on days designated for this purpose. Residents are also advised that harmful chemicals such as bleach, ammonia cleaners or other similar products are not to be sprayed or poured as an animal repellant on garbage placed for collection. These products can cause serious injury, especially when they come in contact with the face or eyes. Garbage that is sprayed or coated as listed above will not be collected by the Town. The garbage collection schedule is: TUESDAY - Stag Harbour; Little Seldom; Seldom; Island Harbour; Deep Bay & Central WEDNESDAY - Fogo THURSDAY - Tilting; Joe Batts Arm; Barr'd Islands; Shoal Bay The Waste Transfer Station is open at the following times for residential and commercial drop off: WEDNESDAY - 1:00 p.m. -- 4:30 p.m. FRIDAY - 8:00 a.m. -- 4:30 p.m. SATURDAY - 8:00 a.m. -- 12:00 p.m. The transfer station will close on most holidays - call to check. The following Fees are in effect for waste taken to the Transfer Station. You will be billed directly for the fee by Central Waste Management.
