## PUBLISHED BY AUTHORITY The following regulations have been made by the Town Council of the Town of Gambo pursuant to the provisions of Section 414(2)(s) of the Municipalities Act, Chapter M-24 of the Revised Statutes of Newfoundland 1999, as amended. <!-- image --> Amended and adopted by the Town Council of Gambo on the 29 day of OGabRR A.D., 2003. MAYOR OWN CLERK <!-- image --> The Motorized Snowmobile and All-Terrain Vehicles Regulation. - These Regulations may be cited as the Town of Gambo Motorized Snowmobile and AllTerrain Vehicle Regulations. ## 2. Interpretation: - (i) "Act" means the Municipalities Act, Chapter M-24 of the R.S.N., 1999, as amended. - (ii) "Council" means the Town Council of Gambo. - (iii) "Enforcement Officer" means a member of the Royal Canadian Mounted Police stationed in the Province of Newfoundland &amp; Labrador or any person appointed by the Town Council of Gambo to enforce these Regulations pursuant to Section 179(1)(2). - (iv) "Highway" means the entire width between the boundary lines of a highway, road, street, avenue, crescent, lane, alley, place, bridge or causeway whether it is publicly or privately owned - (v) "Motor Vehicle" means a motor vehicle required to be registered under the provisions of the Highway Traffic Act. - (vi) "Recreational Vehicle" means all motorized vehicles designed and intended for travel on or immediately over land, water, snow, ice, marsh, swampland or other natural terrain, including but not restricting the generality of the foregoing, four wheel drive or low pressure tire powered vehicles, low pressure tire motorcycles and related two, three and four wheel vehicles, snowmobiles amphibious machines, ground-effect or air cushioned vehicles, but does not include a motor vehicle.. - (vii) "Pedestrian" means a person walking, jogging, skiing, sliding, hiking or engaged, without restricting the generalities of the foregoing, in any other recreational activity - "Town" means the Town of Gambo as defined by Order in Council dated on the Day of , and any amendments made thereto or contained under the Municipalities Act. - (ix) «Traffic" means the flow or movement of recreational vehicles and the presence of pedestrians. - (x) "Designated Street" means a highway within the Town limits of the Town of Gambo designated by Council for use by recreational vehicles and shall include the following - (a) Pioneer Street. 3. No person shall operate a recreational vehicle within the Town limits unless such area has been designated by Council to allow the operation of a recreational vehicle with such conditions applicable as Council may designate. 4. Subject to subsection (3), a person may operate a recreational vehicle on a designated area subject to the following conditions: - (1) No person shall operate or being the owner, allow another person to operate a recreational vehicle on a designated area unless there is in force a policy of insurance respecting the recreational vehicle being operated with an insurance company licensed to do business in the Province of Newfoundland, with such insurance coverage for public liability and property damage being a minimum of Two hundred thousand dollars ($200,000.00). - (ii) No person shall operate a recreational vehicle on a designated area at a speed greater than 15 kilometers per hour unless otherwise posted - (їїї) The operator of a recreational vehicle in a designated area shall at all times yield the right-of-way to drivers of all classes of motor vehicle and pedestrians. - (iv) The operator of a recreational vehicle shall drive the recreational vehicle to the - right side of the designated area as close to the shoulder or sidewalk as possible. - (V) No person shall operate or ride as a passenger on a recreational vehicle unless wearing a helmet that complies with the standards of the Highway Traffic Act, and any regulations made thereunder and further, that such helmet must be properly fastened to the operator or rider. - (vi) No person under the age of 16 years shall be permitted to operate a recreational vehicle in a designated area unless that person is accompanied by or under the immediate supervision of an adult 19 years of age or older. - (Vil) No person operating a recreational vehicle shall cross a highway unless the operator has first brought the recreational vehicle to a complete stop and has yielded the right-or-way to all motor vehicles and pedestrians. - (viii) No person shall operate a recreational vehicle in any designated area having regard to all of the circumstances in a manner that is imprudent and unsafe. - (ix) No person shall operate a Motorized Snowmobile or All-Terrain Vehicle on a designated street unless they possess a valid drivers licence. 5. Every person who fails to comply with or otherwise contravenes any of these regulations is guilty of an offence and is liable on summary conviction: - (i) Where the offence is a first offence, to a fine not exceeding Two hundred dollars ($200.00) but not less than Fifty dollars ($50.00), and in default of payment of fine, to imprisonment for a period not exceeding one month, and - (ii) Where the offence is a second or subsequent offence, to a fine not exceeding Five hundred dollars ($500.00), but not less than Two hundred dollars ($200.00) and in default of payment of fine, to imprisonment for a period not exceeding three months. <!-- image --> These regulations shall come into effect on the 3Rd day of Noelember , A.D., 2003. <!-- image -->
