<!-- image --> ## Water and Sewer Regulations Resolution Number: 2024-05-27-183 ## Objective: Date Approved: May 27, 2024 The purpose of this policy is to ensure all residents and businesses receive fair and equal treatment regarding municipal water and sewer connections as well as to ensure the Town of Gambo receives accurate compensation to allow for the provision of these services. ## Scope: This regulation applies to individuals and/or businesses who would like water and sewer services to their property. ## Definitions: In these regulations, unless the context otherwise requires: - a. "Act" means the Municipality Act; - b. "Council" means the Town Council of Gambo; 3. с. "Customer" means any person, firm or corporation who or which contracts with council to be connected with the system; - d. "Municipality" means the Town of Gambo; - f. "System" means the water supply and/or sewage disposal of the Town of Gambo. - e. "Service" means water supply and/or sewage disposal of the Town of Gambo; ## REGULATIONS: 1. These regulations may be cited as the Town of Gambo Water Supply and/or Sewer Disposal Regulations. 2. No service shall be provided by the system until the prospective customer contracts with the Council to be connected to the system. 3. Every owner or occupier or both of a building or part thereof that is within the Municipality and within sixty (60) meters of the system, shall have such building or part thereof connected to the system. 4. a.) Service lines for water supply shall be 13mm ½ inch PCV for a single-family residential unit or such greater size as may be approved by Council for a single-family residential unit or such greater as may be approved by Council for multiple residential unit commercial buildings. 5. b.) Service Lines for water supply shall be installed at a minimum underground depth of 1.5m (5ft) unless otherwise approved by council. 6. c.) Service lines for sewage shall be 100mm (4 inch, SDR 24 or 35) or equivalent for a singlefamily residential unit or such greater size as may be approved by Council for multiple residential units and commercial buildings. 7. d.) Service lines for sewer disposal shall be installed at a minimum underground of 1.5m, (5ft) unless otherwise approved by Council and may be installed lateral with the service line for water supply in the same trench. 8. e.) The grade for a service line for sewage disposal shall be a minimum of 2.00% and shall be as much as possible in a continuous straight line without sags or crests; but where a bend is necessary it shall be with the use of a clean out flue. <!-- image --> ## Water and Sewer Regulations 4. There shall be only one service for water line, for water supply and only one service line for sewage disposal to each building unless otherwise approved by Council. 2. a.) Service lines from the main line to the building shall be installed by the customer or his representative with prior approval in writing of council. 3. b.) Service lines installed by the customer or his representative shall be subject to inspection by Council prior to backfilling and for this purpose the customer shall pay an inspection fee in an amount to be fixed by council. 5. No person, except an employee of council or other representative engaged for that purpose, shall connect service lines to a system. 6. Basement floor drains, weeping tile or roof drains shall not be connected to the sanitary sewer. They shall be connected to a storm sewer, rock, well or ditch. 7. All service lines for sewerage disposal shall have a minimum of one approved backflow prevention device installed between the last outlet and the boundary line. 8. No person shall indiscriminately use water nor shall sell or give water to any person except under such condition or for purposes as may be approved by council. 9. In instances where a sewer cleanout is situated beyond the curb stop on a resident's property, Public Works staff may require access to the property for clearing sewer blockages. Permission to access property for this purpose shall be provided in writing by the homeowner. This written consent serves as authorization for Public Works employees to enter the property and access the sewer cleanout. Council shall have the right to suspend service to any customer who refuses such access. 10. Council shall not guarantee an uninterrupted water supply or a sufficient or uniform pressure and shall not be liable for any damage or injury caused or done by reason of the interruption of supply, variation of pressure on account of the turning off or turning on of the water for any reason. 11. The Town shall not be liable for any loss of damage to property resulting from flooding by water occasioned by rainstorms or thaws, or the breaking of any water main or sewer pipe for any cause over which the Town has no control. 12. In the event of a leak in a water supply service line, Council may discontinue the supply of water to the service line if such action is necessary to prevent wastage of water; and, except in the case of an emergency, the customer shall be given adequate prior notice of Council's intentions to discontinue the supply of water. 14. No person, unless authorized by Council, shall open, close, cut, break or obstruct from free access to any hydrant, water main or any other part of the water system. 13. No person shall dispose of chemicals or other such material not normally used in a household into a service line for sewage disposal. 15. Property owners are responsible for the protection of their curb stops from damage. If a curb stop is damaged by the property owner or persons hired by the property owner and have to be repaired by the Town employees, all cost for labour and materials will be billed to the property owner including excavation and backfilling. This policy is to cover unnecessary damage and not curb stops that have deteriorated with time. Public Works Department Staff are willing to locate any curb stop that is not visible. 16. If trouble occurs in a line between the main and the curb stop, it shall be replaced/repaired at Council's expense; but if trouble occurs elsewhere in a service line, it shall be repaired at the customer's expense. 17. Invoices for water and sewage tax shall be rendered annually and shall be due and payable on such dates as set by council, except where special arrangements for deferred payment of bills for water and sewage tax have been made with council. <!-- image --> ## Water and Sewer Regulations 18. There will be no charge to turn on &amp; off water for emergency repairs. If a shut-off/turn-on request is made after the regular working hours of 8:00am-4:30pm, a $120.00 call-out fee will be charged for this service. There will be a $50.00 fee to turn water off for seasonal disconnect and a $50.00 fee to have it reconnected. 20. There will be a fee charged in the amount of $120.00 for a call out by a resident regarding sewer backup and other related issues after the regular working hours of 8:00am-4:30pm. If the trouble is outside the cleanout valve line, it is the Town's responsibility. If not, the resident will be charged the fee plus the time required to unplug. With regards to the new policy regarding water and sewer, the address of 6 Jacob's Lane will be grandfathered in and exempt from payment of the new fee structure. 21. The Town Council of the Town of Gambo has set a connection fee (hookup charge) of $600.00. This will also require an inspection fee of $75.00. Council will supply curb stop and saddle required for water connection. The connection fee set by Council shall be payable when the property is capable of being connected to the municipal water supply or municipal sewage supply. 22. When a property is occupied as a residence and a commercial business is operated from the same premises, and where no separate connection is required for the business, the water and sewer rate applicable shall be the minimum commercial rates as set forth on the approved schedule of rates for the Town. 23. When a building is occupied by one (1) or more family units living in separate, self-controlled apartments, the owner of the property shall be charged a separate residential water and sewer rate with respect to each apartment. 24. All vacant land capable of connecting to the town water/sewer system and is within 60 metres of the main lines will be charged a yearly fee of $231.00. 25. In the event a resident has water shut off for non-payment of taxes, a $100.00 reconnection fee will be charged before services are reconnected, after the taxpayer, in cooperation with the Town Clerk, has worked out a mutually agreed payment plan. 26. The Town Council of the Town of Gambo has set a connection fee (hookup charge) of $300.00 for hookup to water service only. A $75.00 inspection fee will also be charged. <!-- image --> ## Water and Sewer Regulations 27. The Town Council of the Town of Gambo has set a connection fee (hookup charge) of $300.00 for hookup to sewer services only. A $75.00 inspection fee will also be charged. 28. All vacant land capable of connecting to water or sewer only will be charged a yearly fee of $156.00. 29. If vacant property changes hands and a new house is built and the connection is made to the old lines, the standard hookup fee of $600.00 plus the $75.00 inspection fee still applies. 30. Water supply and/or sewer service may be discontinued within 24 hours notice to any customer whose bill for water and sewage taxes remains unpaid for a period of 90 days after the due date on the invoice. 31. If a written request is made to council for exemption from water and sewer and the electricity has been disconnected to the said property, the request for exemption will be reviewed at the discretion of Council. 32. Accessory buildings shall have no charge for water and sewer unless: 7. a.) The house/basement or accessory building contains an additional resident/apartment; 8. b.) The house contains a home-based business that requires additional water usage 9. c.) The accessory building contains a business 33. In the event that the connection of water/sewer services to a resident or business requires a cut in pavement to complete the installation of said services, the resident/business owner shall be charged an additional one time fee of $2000.00. This fee is refundable after one year providing the pavement required no additional repairs or maintenance as a result of initial cut. 34. Pursuant to Section 443 of the Act, every person who contravenes or fails to comply with any of the provisions of these regulations are guilty of an offense and are liable on summary conviction to a fine not exceeding one thousand dollars ($1000.00) or in default of payment to a period of imprisonment not exceeding 90 days or to both fine and period of imprisonment. ## Private Water/Septic Systems 1. Pursuant to Section 195 of the Act, a person shall not within the Town of Gambo; 2. Construct a private sewage disposal system; or - b. Make or use a private water supply system except in accordance with a written permit from Council. 2. Every private sewage disposal system and private water supply system shall be constructed, located and maintained in a manner which is acceptable to the Department of Digital Government and Service NL. Approved plans must be submitted to the Town Office and an application submitted to the Town and approved before construction can begin. 3. Council shall not automatically assume the responsibility of the installation of private sewage disposal systems or private water supply systems. 4. Council may, at its discretion, assume the responsibility of the cleaning and maintenance of a private sewage disposal system with the stipulation that the resident agree to pay the full amount for water and sewer taxes. - a. As of February 4"', 2021, the Town of Gambo is responsible for the following septic systems: - i. 36 Bayview Road 5. Pursuant to Section 420 of the Act, a person who contravenes or fails to comply with these regulations is guilty of an offense and liable on summary conviction to a fine of not less than $100.00 and not exceeding $500.00 or in default of payment to a period of imprisonment. <!-- image --> ## Water and Sewer Regulations ## Non-Compliance: ## Reservations or Rights: The Town of Gambo reserves the right to change, modify or cancel this regulation at any time as it deems necessary.
