## THE TOWN OF GARNISH
## PROTECTION OF WATER SUPPLY BY-LAWS, 2025
## PUBLISHED BY AUTHORITY
The following regulations have been made by the Town Council of Garnish pursuant to Section 7(2) of the Towns and Local Service Districts Act and approved by council on the And day of APRIL 2025.

## BY-LAWS
1. Interpretation: In these by-laws unless the context otherwise requires:
- i. "Act" means the Towns and Local Service Districts Act, as amended;
3. "Customer" means any person, firm or corporation who or which contracts with Council to be connected to the system;
- iii. "Council" means the Town Council of the Town of Garnish;
- iv. "Reservoir" means the public water supply reservoir of the Town of Garnish, commonly known as Witchazel Pond.
- V. "Town" means the Town of Garnish as defined by Order-in-Council dated the 5 day of August, 1971, and any amendments thereto, and made or continued under the provisions of the Act.
- vi. "Service" means water supply and/or sewerage disposal service supplied to a customer.
- vii. "System" means the water supply and/or sewerage disposal system of the Town of Garnish.
2. No person shall be permitted to erect any building or buildings on any part of the watershed of the Garnish Reservoir Area which is within 500 metres of the surface of the reservoir.
3. No person shall be permitted to use the Garnish watershed area for recreational purposes such as swimming, boating or paddling.
4. No persons shall fish in the waters of the Garnish Reservoir Area.
5. No person shall dip, soak or wash any article of clothing or any utensil or any vehicle in the waters within 500 metres of the Reservoir Area.
6. No person shall throw or cause to be thrown waste material of any kind into the water or within 500 metres of the Garnish Reservoir.
7. No person shall permit any animal of which he is the owner to enter the waters of the Garnish Reservoir Area.
8. The owner of any dead animal found within 500 metres of the waters of the Garnish Reservoir Area shall remove and properly dispose of such animal within 48 hours after he has been notified by the Council or otherwise made aware of the death of the animal in such location.
9. No person shall be permitted to cut wood within 500 metres of the Garnish Reservoir Area.
10. No water or sewerage service shall be provided by the system until a regular application form therefore has been signed by the prospective customer.
11. Every owner or occupier or both of a building or part thereof that is within the Municipality and within sixty (60) metres of the system, shall have such building or part thereof connected to the system.

- i. Service lines for water supply shall be regulation size and materials for a single family residential unit or such greater size as may be approved by Council for multiple residential units and commercial buildings.
- ii. All water supply pipes shall be laid at a sufficient depth to protect them from frost.
- ili. All underground joints on water piping from the water main to the connection inside the basement are to be flared connected.
- iv. All service lines for water shall be equipped with a shut-off valve, check valve, and/or vacuum breaker, which shall be located in an easily accessible location.
Service lines for sewerage disposal shall be 100 mn (4 inch) PVC or equivalent for a single family residential unit or such greater size as may be approved by Council for multiple residential units
13. i. and commercial buildings.
- ii. Sewerage lines shall be run as direct as possible with a fall of at least one quarter (1/4) of an inch to the foot, but not less than one-eighth (1/8) of an inch to the foot. Sewerage lines shall be laid at a sufficient depth to protect them from frost.
- iii. All service lines for sewerage shall be equipped with a pipe clean-out and a backwater valve, which shall be located in an easily accessible location.
- iv. Service lines for sewerage disposal shall be laid in a continuous straight line without sags or crests, but where a bend in necessary it shall be installed with 45 degree elbows.
14. Bills for water and/or sewerage taxes shall be rendered to each customer at the beginning of each year. All bills shall be payable monthly or quarterly with the first payment due March 31 of each year.
15. The council shall have the right to refuse or suspend service from the system to customers whose bills for water rates, sewerage rates or service charges remain unpaid for more than three months.
16. The Council may discontinue service from the system to any occupier of a building or premises or part thereof who fails to pay on the due date any taxes payable by him or her under the Municipalities Act.
17. No prospective customer shall have his home connected to the system if such customer is in the arrears of taxes.
18. Representatives of the Council shall have the right of access to all parts of a customer's property or premises at all reasonable hours for the purpose of inspecting any water or sewer pipes or fittings, or appliances or for the purpose of installing, removing, repairing, reading, or inspecting meters and the council shall have the right to suspend service to any customer who refuses such access.
19. Any customer who is disconnected from the system because of arrears shall not be reconnected until any arrears of water and sewerage rates are paid and upon payment of a reconnection charge of a minimum of $50.00.
20. When service from the system is to be disconnected for maintenance purposes, or to tie in new services, the Council shall give notice either directly to the customer or through social media. As much notice as possible will be given.
21. No customer shall permit the improper use or waste of water nor shall he sell or give water to any person except under such conditions and for such purpose as may be approved by the Council in writing.

- i. No explosive or inflammable matter shall be discharged into any sewer.
2. No storm sewers or garage floor drains shall be discharged into the sewer system.
23. If a leak or other trouble occurs in a service pipe it shall be repaired as soon as possible. If the leak or trouble occurs between the main and the curb stop, it shall be repaired by the Council at its expense. If the leak or trouble occurs elsewhere on the service pipe, it shall be repaired at the customer's expense. The council may make such repairs for any customer when requested to do so and the customer shall pay the cost of the repairs before the water is turned on. If a leak occurs on the customer's portion of the service pipe the Council may discontinue the supply of water to such service pipe, if in its opinion, such action is necessary in order to prevent wastage of water. The Council shall notify the customer affected of its intention to discontinue the supply of water.

24. If freezing occurs in a service pipe it shall be thawed as soon as possible. If freezing occurs between the main and the curb stop, it shall be thawed by the Council at its expense. If freezing occurs elsewhere in the service pipe, it shall be thawed at the customer's expense. The Council may thaw such service pipe for any customer when requested to do so and any charge made by the Council for the thawing of service pipe shall be paid by the customer directly after the work is finished.
25. No person, unless authorized by the Council, shall draw water from, open, close, cut, break, obstruct from free access to, or in any way injure or interfere with any hydrant, water main, water pipe, curb stop, meter, or other part of the system; provided, however, that nothing contained in these regulations shall be deemed to prevent an officer or member of the Fire Department, when engaged in the work of such department, from using any hydrant or other parts of the system.
26. When there are separate users of water and/or sewer from any service connection, a separate charge will be made for water and/or sewer rates (as in the case of temporary lines).
27. Any service lines installed by the customer or his representative shall be subject to inspection by Council prior to backfilling.

- i. It shall be the duty of the customer to notify The town office when any work is ready for inspection.
- ii. The inspection shall be made within two working days after receipt of notice.
- ili. If the work is not found to be satisfactory after being inspected, it shall be the customers responsibility to have the work completed to a standard acceptable to the Council.
29. The cost of and installation for which application received by Council shall be paid in full by the customer before the water is turned on from the main and the sewerage connection completed unless there is a written agreement between Council and the customer. This regulation shall not apply to any installation in respect of which previous agreements had been made with the Council.
30. For new installations, any new customer is responsible for the cost of pipes, curb stop, etc. from the main plus the cost of installation. Also, a fee of $125.00 for water connection and $125.00 for sewer connection must be paid to the Council before the water will be turned on. Customers may hire a representative to lay his line from the main to his home. However, the Council will not be held liable for damage caused by any leaks or freezing to the line from the curb stop to the home. Also, if the asphalt has to be cut and resurfaced, the customer will be charged a fee to cover the expense.
31. Pursuant to The Act, every person who contravenes or fails to comply with any of the provisions of these regulations is guilty of an offence and liable on summary conviction to the penalty set out in said Act.
32. The Council will charge unoccupied connected dwellings on the path of the main line. The Council will not charge unconnected dwellings not on the main line path. A connected dwelling on the main line path is a permanent connection either turned on or turned off.
33. Any person requesting to be connected to the Town's water and sewer system on a temporary basis will be required to pay the temporary hookup fee which is a minimum of $50.00 for water hookup and a minimum of $50.00 for sewer hookup with the balance of the hookup to be paid when connected permanent.
34. Each request for temporary hookups will be treated and dealt with by Council on an individual basis.

35. All previously adopted (water supply and/or sewerage disposal) regulations for the Municipality are hereby repealed.
36. The first regulations were adopted by a resolution of Council at a meeting held on the 25*h day of April, 1990 and came into effect on the 26" day of April, 1990. The regulations were amended to a bylaw by a resolution of Council at a meeting held on the 22"d day of April, 2025 and came into effect on the 23d day of April, 2025.
