Pursuant to the authority conferred under Section 414(2) of The Municipalities Act, S.N. 1999 Chapter M-24, the Town Council of the Town of Grand Bank has adopted the following Regulations. c. Matthews : 1. WASTE COLLECTION AND DISPOSAL REGULATIONS. 2016 These Regulations may be cited as the Town of Grand Bank Waste Regulations. ## DEFINITIONS - Interpretations: In these regulations unless the context otherwise requires: - (a) "Act" means The Municipalities Act, S.N. 1999 Chapter M-24; - b) "Town" means the Town of Grand Bank; - (c) "Manager" means the Town Manager of the Town of Grand Bank; - (d) "Designate" means the Superintendent of Works or Working Foreman or Town Clerk or Office Administrator; - (e) "Receptacle" for the purpose of these Regulations means a storage facility for the purpose of storing garbage containers during periods between collections; - (f) "Business Establishment" means the owner, occupant, lessee, tenant or the person in charge of a dwelling, mobile home, hotel, restaurant, apartment block, office building, public institution or other building; - (g) "Garbage" means all kitchen and table waste of animal or vegetable origin, resulung trom the preparation or tood; - (h) "Refuse" means bottles, broken crockery and glassware, cans, cardboard, clothing, magazines, garden waste, newspapers, waste paper, discarded material, and other similar articles but does not include non-collectible waste as described in the Burin Peninsula Regional Service Board (BPRSB) Regulations; - (i) "Bulk Items" means weighty or bulk items such as stoves, refrigerators, dishwashers, clothes washers, clothes dryers, bath tubs, carpet, hot water boilers, bed springs, furniture, boxes, trees and wood (carpet, trees and wood to be no longer than 3 feet/1m in length, tied up and weighs less than 401bs/18kgs). This does not include car parts, tires, oil tanks or drums, scrap metal, furnaces. concrete, brick, carthen materials (rock, mud, sods), sheds, roofing materials (asphalt, shingles) property renovation materials from repairs and/or renovations to a residence or building (gyproc, gutters, siding, fencing, paneling, windows, doors, roofing materials, etc.), or animal carcasses. - "Rubbish" means trade waste, industrial waste, street sweeping, fuel tanks and automobile parts and accessories; ## ADVINIS IRALIUN - The Manager or his/her designate from Council staff shall administer and enforce the provisions of these Regulations. - DAYS AND TIMES OF COLLECTION - In accordance with the BPRSB schedule which at the time these regulations were adopted the collection is the first Friday of each month. 2 | Page ## RESTRICTIONS - (a) No houscholder shall dispose of garbage or refuse in the Town except in the manner as provided in these Regulations; - (b) No householder shall permit garbage or refuse to remain on the premises occupied by him/her for a period of more than seven (7) days unless a public or statutory holiday has occurred on the seventh day when such garbage or refuse shall be prepared for the next collection; - (c) Containers shall not be put out for collection except on the day designated for collection in the area; - (d) No person, or persons shall pick over, interfere with, disturb, remove or scatter any refuse or bundle or article placed out for collection, whether containted in a covered container or otherwise; - (e) No person or persons shall permit any animal owned by him or under his control to pick over, interfere, disturb, remove or scatter any material placed out for collection ILLEGAL DUMPING - No person, firm, company or corporation shall dispose of any refuge on any land within the Municipal Boundary without the written approval of the Manager. - STORAGE AND DISPOSAL Every householder and every operator of a business establishment shall at their own expense, make adequate arrangements for the storage of garbage in receptacles that are impervious to animals. - SUITABLE GARBAGE COVERS Every householder shall make sure that all garbage is properly covered by a net, blanket, or other similar covering material or in an appropriate container. (Containers which are non-disposable shall be maintained in a good state of repair and in a sanitary condition). - TIME FOR COLLECTON - (a) All garbage and refuse being placed for collection shall not be placed earlier than 7:00 a.m. on the day designed for collection in the area. - (b) All garbage is the responsibility of the owner - if garbage is torn open, the owner is responsible to make sure it is cleaned up. - (c) Should garbage collection services be cancelled due to severe winter weather conditions, residents must bring in their garbage from curbside until the collection service is restored so the snow plows can carry out snow clearing operations ## 10. BULK ITEM COLLECTION - Bulk collection to be put out by the curb no earlier than the day of or the day before the collection. Items placed by the curb before this specified time, the Town will collect and dispose of the bulk items at the expense of the property owner. 11. VEHICLES CARRYING GARBAGE AND REFUSE (a) No person, firm, company or corporation shall transport garbage, or refuse of any an enclosed truck or container or is otherwise secured with a tarpaulin or net so kind on any street within the Town unless such garbage or refuse is transported in that it shall not fall from the vehicle or other means of transportation upon the street; - (b) Every vehicle used for the collection and transportation of garbage, refuse, rubbish or rubbish shall have a tail gate or other restraining device and shall be closed or equipped with a tarpaulin or net and such tarpaulin or net shall be used to cover such garbage refuse or rubbish while the same is being transported; 3 | Page Waste Regulations 2016 - (c) All garbage, refuse or rubbish shall be transported in such manner that such garbage, refuse or rubbish shall not spill or scatter from the vehicle transporting the same; - (d) All garbage, refuse or rubbish shall not remain in the vehicle overnight but shall be transported and disposed of on the same day as collected, unless approved otherwise by the Manager; - (e) All vehicles and containers used for the transportation of garbage, refuse or rubbish shall be hosed down daily and kept in a sanitary condition; - (f) The Manager or Designate may inspect vehicles used for garbage collection at all reasonable times to ensure compliance with these Regulations. ## INSPECTION OF PRIVATE PROPERTIES - (a) Notwithstanding anything contained in these regulations, the Manager or Designate may at any time order the owner to clean up and remove any accumulation of garbage or refuse outside any building or buildings or on any other private property within the Town; and - (b) If the owner neglects or refuses when ordered by the Manager or Designate to clean up and remove any accumulation of garbage or refuse from his/her premises, the Manager or Designate may cause the clean-up and removal of such accumulation at the expense of the property owner. 13. The Manager or his/her designate may make periodic inspections of properties within the Town for the purpose of enforcing these regulations. - In accordance with Sections 420 and 421 of the Municipalities Act, S.N. 1999 Chapter M24, every person who fails to comply with or otherwise contravenes the provisions of these regulations is guilty of an offense and for such offence he/she shall be liable on summary conviction to: - (a) for the first offence to a fine of not less than $100.00 and not more than $500.00 or to a term of imprisonment of not more than one month or to both the fine and imprisonment. - (b) for a subsequent offence to a fine of not less than $500.00 and not more than $1000.00 or to a term of imprisonment of not more than three months or to both the fine and imprisonment. 15. Every person who contravenes the provisions of these Regulations is guilty of an offense and for such offence he shall be liable on summary conviction of a fine not exceeding $1000.00 or, in default of payment, to imprisonment for a period not exceeding ninety (90) days. 16.
