## Snow Clearing Regulations
Pursuant to the authority conferred by the Minister of Works, Services and Transportation under the Highway Traffic Act, R.S.N.L, 1990, chapter H.-3, sections 189 and 190 and amendments, and pursuant to the power delegated in accordance with The Municipalities Act, 1999, chapter M-24, section 414 and amendments, the Town Council of Grand Falls-Windsor has made the following regulations.
## Snow Clearing Regulations
1. These Regulations shall be known and cited as "The Town of Grand FallsWindsor Snow Clearing Regulations.
2. The occupant or owner of a building used for commercial purposes shall remove all snow and ice from the sidewalk adjoining or adjacent to the building within twenty-four (24) hours after a snow fall or the formation of ice.
3. The owner of vacant land or premises used or once used for commercial purposes, shall clear away and remove all snow and ice from the sidewalk adjoining or adjacent to the vacant land or premises within twenty-four (24) hours after a snow fall or the formation of ice.
4. The Council or any person authorized by Council may clear away and remove snow and ice from the sidewalk adjoining or adjacent to vacant land or premises used or once used for commercial purposes at the expense of the owner of such building, vacant land or premises.
5. Where Council or any person authorized by Council has done work of clearing away and/or removing snow and ice and the owner refuses or neglects to pay the cost of such work within ten (10) days after invoicing, the Council may recover these costs from the owner by action as a civil debt due to the Council.
6. No person shall cause any damage to any sidewalk in clearing away and removing snow and ice.
7. No person, whether occupant or owner, when keeping his pathway, driveway or any other portion of his land free of snow or ice, shall throw, scoop, dump or place any snow or ice onto the roadway, sidewalk and at fire hydrant locations such that it interferes with, hinders, impedes or obstructs pedestrians or vehicular traffic or acess to fire hydrants by Town personnel.
- No person shall park an unattended vehicle on any street or Municipal parking area or Municipal owned property during or immediately after a snow fall where it impedes or hinders snow clearing operations.
- No person shall park an unattended vehicle, regardless of weather conditions upon any town street or Municipal parking area or Municipal owned property during the period from November 1 in each year to April 30, in the following year between the hours of 12 midnight and 8:00 a.m.
10. Any motor vehicle parked contrary to Section 8 and 9 may be ticketed and/or towed away by Council or their representative at the owner's risk and expense, to a place selected by the Council or person so authorized.
11. Notwithstanding the Summary Proceedings Act, any person who violates any of the provisions of these regulations, shall be guilty of an offence and shall be liable on summary conviction to a fine.
12. Pursuant to Section 420 of the Act, any person who is guilty of an offence against these Regulations or who acts in contravention of or fails to comply with any provision thereof or neglects or refuse to do so shall be liable on summary conviction;
- for a first offence to a fine of not less than $100 and not more than $500 or to a term of imprisonment of not more than one month or to both the fine and imprisonment;
- (b) for a subsequent offence to a fine of not less than $500 and not more than $1,000 or to a term of imprisonment of not more than 3 months or to both the fine and imprisonment.
